Resolution No. 94RES OLUT ION NO. 94 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF CYPRESS OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "WETZEL ANNEXATION", AND GIVING NOTICE OF TIi1E AND PLACE FOR HEARING OF PROTESTS THERETO. BE IT RESOLVED BY THE COUNCIL OF TBE CITY OF CYPRESS: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter des- cribed territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Orange, was filed with the Council of the City of Cypress on May 11 , 1959. 2. That the territory which the petitioners request be annexed to the City of Cypress and which said City and its Council propose to annex is situated in the County of Orange, State of California, hereby designated "Wetzel Annexation', and described as follows: Beginning at an angle point in the existing boundary of the City of Cypress, said angle point being the inter- section of the Southerly line of Philo Street (60.00 feet wide) with the Southwesterly line of the Pacific Electric Railway Company Right -of -Way (100.00 feet wide); thence riescerly and Southerly, along said exist- ing boundary, to the Northerly line of Lincoln Avenue, as said Avenue existed June 1, 1959; thence Westerly, along said Northerly line, to the Westerly line of Watson Street (60.00 feet wide); thence Northerly, along said Westerly line, to the Southwesterly line of said Railway Company Right -of -Way; thence Southeasterly, along said Southwesterly line, to the point of beginning. Comprising 7.0 acres, more or less. 3. That the County Boundary Couiuiission of Orange County, California, did in session duly assembled on June 15, 1959, con- sider the proposed annexation boundaries of said "Wetzel Annex- ation" as above described, and as submitted to said Commission by the proponents of said annexation. 4. That August 10, 1959, at the hour of 7:30 P.M., in the Council Chambers in the City Hall in the City of Cypress, County of Orange, California, is hereby fixed as the time and place when Resolution No. 94 1. and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Cypress, and having any objections to the proposed annex- ation, may appear before the Council of the City of Cypress and show cause why such uninhabited territory should not be so ann- exed to the City of Cypress. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Cypress is hereby author- ized and directed to cause a copy of this Resolution to be posted in at least three (3) conspicuous places within the territory proposed to be annexed, said posting to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who the designation of the lands has filed his name and address and in which he has an interest, either legal or equitable, with. the Clerk, such notice to be given not less than twenty (20) days before the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. first public hearing on the Resolution No. 94 2. In the event there is upon the land proposed to be ann- exed to said City a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such proposed district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9.
