RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS CONTAINING
FINDINGS AND A REPORT OF THE DECISION OF THE COUNCIL IN REGARD
TO THE GRANTING OF A VARIANCE TO THE ZONING REGULAATIONS OF THE
CITY, AND APPROVING TENTATIVE TRACT MAP NO. 3742 WITH CONDITIONS
ATTACHED.
WHEREAS, the attached application has been submitted to the
City of Cypress for a variance in the zoning regulations of the
City, and
WHEREAS, the Planning Commission has held at least one public
hearing in regard to the application on the date shown by the files,
and
WHJHEAS, the City Council of the City of Cypress has held at
least one public hearing on said application, and
WHEREAS, the necessary public notices have been given for the
public hearings as required by ordinance of the City of Cypress,
and
WHEREAS, the City Council of the City of Cypress has fully con-
sidered and heard all evidence submitted in regard to said applica-
tion,
NOW, THEREFORE, the City Council of the City of Cypress, DOES
RESOLVE, DETftHNINE, AND ORDh:H AS FOLLOWS:
Section 1. The City Council finds that pursuant to the evidence
presented in regard to said application that in reference to said
property, the following conditions exist:
(a) That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to
the intended use of the property, which do not apply gen-
erally to other property in the same zoning district and
neighborhood:
(b) That such variance is necessary for the preservation and
enjoyment of a substantial property right of the appli-
cant, which right is possessed by other property owners
under like conditions in the same zoning district and
neighborhood:

(c) That the granting of the variance will not be materially
detrimental to the public welfare or injurious to property
and improvements in the zoning district and neighborhood
in which the property is located:
Section 2. The City Council of the City of Cypress, therefore,
does grant a variance on all land covered by said application to
permit all such land to be used for purposes of single-family
residential structures with lot size requirements of 6,000 square
feet. Such variance to become void if property has not been
developed within five years.
Section 3. The City Council of Cypress does hereby approve Tenta-
tive Tract No. 3742 subject to the following conditions:
(a) The Subdivision Ordinance of the County of Orange as it per-
tains to the filing and approval of the final map shall be
followed.
(b) The street layout shall conform to Tentative Tract No. 3742
as approved by the City Council. modifications will require
approval of the City Council.
(c) Street Sections shall conform to standards established by
the City Engineer.
(d) The curbs, gutters, and sidewalks shall be installed to
grades and shall be constructed in accordance with standards
specified by the City Engineer.
(e) Street construction design shall be determined by soil
analysis and approved by the City Engineer.
(f) Drainage within and without the tract shall be solved to
the satisfaction of the City Engineer,.
(g) All streets shall have a minimum of 4'o" sidewalks abutting
six inches from the property lines.
(h) Traffic markers and signs shall be erected by the developer
at locations determined by the City of Cypress.
(i) Street name signs and stop signs shall be erected as required
by the City Engineer.

(j) Ornamental street lights of a design and standard approved
by the Southern California Edison Company shall be installed
by the developer.
(k) A street tree shall be planted in front of each lot by the
developer.
(1) Water mains shall be installed both on-site and off-site to
the satisfaction of the City Engineer and to meet the re-
quirements of Southern California Water Company.
Domestic Water shall be secured through the Southern Califor-
nia Water Company with financial arrangements therefor to be
made by the developer with said company.
(n) Fire hydrants shall be installed as reasonably required by
the City Engineer.
(o) Disposal of sewage shall be through a public sanitary sewerage
system. Sewer lines, connection and structures shall be in-
stalled of the size, type, to the grades and in the locations
meeting the approval of the City Engineer.
(p) All Sanitary sewers and storm drainage easements found neces-
sary shall be dedicated to the City of Cypress.
(q) No improvement work shall be commenced until plans and speci-
fications, therefore, have been submitted to and approved by
the City, and a surety bond in such an amount as determined
by the City shall be deposited with the City.
(r) Six-foot public utility easements shall be shown on the final
map and provided as required by the utility companies.
(s) The minimum lot size shall be 6000 square feet with a minimum
width of 60 feet.
(t) The front setback shall be between 20 to 40 feet. Detached
building setbacks shall conform to the City Zoning Ordinance
for R-1 Zone.
(u) All pie -shaped interior lots shall have a minimum width at
the street property line, measured straight across (not

measured on the curve) of 40 feet, and a minimum width
of 50 feet at the 20 foot setback lines, also measured
straight across, and shall comply with minimum lot size
of 6000 square feet.
(v) Areas shown as other than residential are not approved for
the use indicated but leave to amend the tentative map to
incorporate such areas in the residential development is
granted,
(w) School sites for elementary schools shall be reserved as
required by the Cypress School District.
(x) Four acres of land to be reserved for park site or sites;
location to be agreed on between developer, City Council
and Cypress Park District.
(y) An ornamental concrete block wall 5' high shall be con-
structed along rear lot lines that abut on Ball Road.
All vehicular access rights to Ball Road, except at
street intersections, shall be dedicated to the City of
Cypress.
(z) Chain link fence shall be constructed along the flood
control channel as per Orange County flood control district
specifications.
