RESOLUTION NO. 1151
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE
CITY COUNCIL OF THE CITY OF CYPRESS TO ANNEX TO SUCH
CITY CERTAIN UNINHABITED TERRITORY DESCRIBED THEREIN
AND DESIGNATED AS "ANNEXATION NG, 71-1" SETTING FORTH
ITS REASONS FOR DESIRING ANNEXATION AND GIVING NOTICE
OF THE TIME AND PLACE SUCH CITY COUNCIL WILL HEe,.
WRITTEN PROTESTS AGAINST SUCH ANNEXATION.
BE IT RESCLVED by the City-ounc.il of the City of Cypress as follows:
SECTION 1. That, pursuant t:. the provisions of the Annexation of Uninhabited
Territory A:t of 1939, proceedings have been initiated by the City Council
of the City of Cypress, on its own motion, to annex to the City of Cypress
all that uninhabited territory situated in the County of Orange, State of
California, herein designated as "Annexation No. 71-1" and described as
follows:
A parcel of ':and situated in the County of Orange, State of California,
and being a portion of Sections 9 and 16, Township 4 South, Range 11
West, S.B.M. described as follows:
Beginning at the intersection of the West line of the. East -half of the
northeast quarter of said Section 16 and the north line of said Section
16, as said Section is shown on a map recorded in Book 51, page 11 of
Miscellaneous Maps, Records of said Orange County, said intersection
being a point on the corporate boundary of the City of Cypress as
defined by De Polter Annexation, Ordinance No, 66;
THENCE (1) South 0° 31' 35" East along the said West line and along the
De Polter Annexation boundary and the original incorporation
boundary of the City of Cypress, approved by the Secretary
of the State of California on July 24, 1956, 582.84 feet to
the Northeasterly right of way line of the Pacific Electric
Railway;
THENCE (2) along the said original incorporation boundary the following
two courses; South 530 31' 15" East along said Northeasterly
right of way line, 155,38 feet to the South line of the North -
half of the northeast quarter of the northeast quarter of
said Section 16;
THENCE (3) North 89° 34' 18" East along said South line 77.24 feet
more or less to the West line of the East 125 feet of
the West half of the Northwest quarter of the Northeast
quarter of the Northeast quarter of said Section 16;
THENCE (4) leaving said incorporation boundary North 0° 30' 24" West
along said West line 715.80 feet more or less to the north
line cf the south 40 feet of said Section 9, said north
line being the Northerly right of way line of Lincoln Avenue
and being the corporate boundary line of the City of Buena
Park as established by Larwin Homes Annexation No.1, Ordinance
No. 1:9;
THENCE (5) South 89° 39' 45" West along said northerly right of way
line and the boundary line of said Larwin Homes Annexation
No. 1, 201.56 feet more or less to the West line of the East -
half of the East -half of said Section 9, said West line being
the corporate boundary line of the City of Cypress as defined
by said De Polter Annexation;
THENCE (6) South 0° 31' 35" East 40,00 feet along said West line to the
North line of said Section 16, being the point of beginning.
Containing 3.18 acres of land more or less.
SECTION 2. That the City Council of the City of Cypress desires to annex
said uninhabited territory to the City of Cypress for the following reasons:
The territory is contiguous to the City of Cypress; its proposed annexation
will contribute to and facilitate the orderly growth and development of both
the City of Cypress and the territory proposed to be annexed; its proposed
annexation will facilitate and contribute to the proper and orderly
layout, design and construction of streets, gutters, sidewalks, sanitary
and street sewers and drainage facilities, both within the City of Cypress
and the territory proposed to be annexed; and its proposed annexation
will provide and facilitate a proper overall planning and zoning of lands and
subdivisions of lands in the City of Cypress and in said uninhabited territory
in a manner most conducive to the welfare of said City of Cypress and said
uninhabited territory.
SECTION 3. That the Local Agency Formation Commission of Orange County,
California, on February 24, 1971, approee d "Annexation No. 71-1,"
SECTION 4a That April 26, 1971, at the hour of 8:00 p.m. in the Council
Chambers of the City Hall of the City of Cypress, County cf Orange, State
of California, located at 5275 Orange Avenue, Cypress, California, ::s
hereby fixed as the time and place when and where any owners of real
property within such territory proposed to be annexed, having any objections
to such proposed annexation, may appear before the City Council of the City
of Cypress and show cause why such uninhabited territory should not be
eo annexed to the City of Cypress, Such protest must be in writing and
may be filed at any time prior to final adjournment of such hearing on
protests. The protest shall state the name of the owner cf the property
affected and the street address or other description of property sufficient
to identify it on the last equalized assessment roll.
SECTION 5o That since there is no newspaper of general circulation published
within the City of Cypress, the City Clerk of the City of Cypress hereby is au-
thorized and directed to post a copy of this Resolution not less than twenty
(20) days before the hearing in at least three (3) conspicuous places within
such territory proposed to be annexed. The City Clerk of the City of Cypress
further is authorized and directed to rause said notice to be published
in a. newspaper of general circulation published outside the City of Cypress,
but within the County of Orange in ace ordance with Section 3531]. of the
Government Code of the State of California: The City Clerk of the City
of Cypress further is authorized and directed to cause written notice of
such proposed annexation to be mailed at least twenty (20) days prior
to the date set for such hearing, to each person to whom land within
such territory proposed to be annexed is assessed cm the last equalized
assessment roll. available on the date the prozeedings were initiated, at
the address shown on said assessment roll, or as known to the said City
Cleric, and to any person who has filed his name and address and the
designation of such lands in which he has any inteeest, either legal
or equitab]e, with said City Clerk. The City Clerk of the City of
Cypress further is authorized and directed to cause written notice to be given
to such other persons as legally may be entitled thereto in the manner
provided by law.
