Resolution No. 116247 RESOLUTION NO. 1162 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF' ORANGE COUNTY FOR THE INITIATION OF PROCEEDINGS FOR THE DETACHMENT OF CERTAIN LNHABITED TERRITORY FROM THE MAGNOLIA MEMORIAL CEMETERY DISTRICT. WHEREAS, the District Reorganization Act of 1965 provides that the govern- ing body of an affected city may make application by resolution for the detach- ment of certain territory from a district and that such application shall be considered a mandatory application; and WHEREAS, the City Council of the City of Cypress hereby desires that pro- ceedings be initiated by the Local Agency Formation Commission of Orange County for the detachment of that certain inhabited portion of the Magnolia Memorial Cemetery District, hereinafter described, located and included within the boundaries of the City of Cypress; and NOW, THEREFORE, the City Council of the City of Cypress hereby does resolve, determine and find as follows: Section 1. This proposal is made pursuant to Division 1 of Title 6 of the Government Code of the State of California, known as "The District Reorganization Act of 1965," Section 2. The nature of the change of organization proposed hereby is a "detachment," and the name of the district tor which such change of organization is proposed is "the Magnolia Memorial Cemetery District." Section 3. The territory which is proposed to be detached from said District is located in the State of California, County of Orange, City of Cypress, and is more particularly described as: Those portions ct the sections 22 and 27, Township 4 South, Range 11 West, in the City of Cypress, County of Orange, State of Calitornra as per map filed in Decree of Paritron in Superior Court, Los Angeles County, California, Case No. 68582, a certified copy of which was recorded March 18, 1910 in Book 177, page 337 of Deeds of Orange County, California described as follows: Beginning at a point on the existing common boundary line between the City of Garden Grove, as per City of Garden Grove Annexation No, 76 and the City of Cypress, as per Osteen Annexation No. 2; said point being the intersection of the centerline of Valley View Street and the southerly line of the North half of the North half of said Section 27; thence along said southerly line South 89` 44' 09" East 5281.94 feet to the intersection of the East line of said Section 27 and said southerly line, said East line also being the centerline of Knott Street; thence North 0" 15' 47" East along said East line 2639.00 feet to the intersection of the westerly extension of the northerly line of the Southerly 95.00 feet ot Lot 4 ot the J. W. Bixby Subdivision and said east line; thence South 89' 59' 50" West 30.00 feet to the Westerly Right of Way line ot Knott Street; thence North 0` 15' 47" East 1324.82 feet to the North line of said Section 27; thence continuing along said Westerly Right of Way line of Knott Street North 0' 34' 33" East 222.65 feet to the beginning of a tangent curve concave to the East having a radius of 630.00 feet; thence along said curve and Westerly Right of Way line of Knott Street through a central angle of 24' 07' 17" an arc length of 265,23 feet; thence North 24' 41' 50" East 10.82 feet to the intersection of the common boundary line between the Rancho Los Coyotes and the Rancho Los Alamitos and said Westerly Right of Way line; thence North 69 50' 30" West along said Rancho line 2797.70 teet more or less to the intersection of the West line of the Southeast quarter of said Section 22 and said Rancho line; thence South 0 13' 28" West 1395.82 feet to the intersection of the centerline of Katella Avenue and said West line; thence South 0° 14' 13" West 2639.51 feet along the West line of the Northeast quarter of said Section 27 to the intersection of said West line and the centerline of Orangewood Avenue; thence North 89- 46' 29" West 2640.27 feet along said centerline or Orangewood Avenue to the centerline intersection of Orangewood Avenue and Valley View Street; thence South 0' 14' 15" West along said centerline of Valley View Street 1319.88 feet to the point of beginning. Section 4. The reason or reasons for this proposal are that the detach- ment of said territory from the Magnolia Memorial Cemetery District would be for the best interests of landowners and present and future inhabitants within said District based on, but notlimited to, the following findings: A. The original purpose of the Magnolia Memorial Cemetery District was to create a governmental entity with the power to provide cemetery maintenance of three cemeteries, there currently being only one cemetery, Magnolia Memorial Park Cemetery in Garden Grove, which is not. of close proximity to that area which is being taxed in Cypress. At the present time, there are other governmental agencies which are capable of providing maintenance service to the cemetery. B. Taxation for this service has increased 357 since 1965, because of the rising costs of maintenance. The costs of upkeep and maintenance function could easily be absorbed by another unit of government. C. This District represents a "phantom" government, unknown to taxpayers and community residents which levies taxes without providing benefits. D. The elimination of structures of government no longer needed both maximizes the economies which can be afforded to our citizens and removes the confusion which always exists tor the citizen in determining the agency res- ponsible for providing local governmental services. WHEREFORE, the City Council of the City of Cypress requests that proceed- ings be initiated for the change of organization proposed hereby.
