Resolution No. 1350RESOLUTION NO. 1350 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN REAL PROPERTY IN THE COUNTY OF ORANGE, STATE OF CALI- FORNIA, AND DECLARING THE PUBLIC NECESSITY THEREFOR. WHEREAS, the City of Cypress is authorized by virtue of of the State of California, to take property by condemnation and enjoy said property as necessary to the full exercise of NOW, THEREFORE, the City Council of the City of Cypress resolve as follows: the Statutes and hold, use its powers. does hereby SECTION 1. That the City Council of the City of Cypress has found and determined and does hereby find and determine that the public interest and necessity require for public use the acquisition, construction, completion, operation and maintenance by said City of Cypress of certain public improve- ments, to wit: in fee simple absolute for public park purposes and related improvements therefor. SECTION 2. That the real property, the acquisition of which is required for the public interest and necessity for the uses and purposes set forth in Section 1 hereof, is situated in the City of Cypress, County of Orange, State of California, and is more particularly described as follows, to wit: Lot 28 of Tract 5237 in the City of Cypress, County of Orange, State of California, as shown on a map recorded in Book 199, pages 39 and 40 of Miscellaneous Maps in the office of the County Recorder of said County. EXCEPTING therefrom that portion described as follows: Beginning at a point in the southerly line of said Lot 28 being also a point in the northerly right of way line of Orange Avenue as shown on said Tract Map said point being distant South 89° 35' 50" West 354.55 feet from the southeast corner of said Lot 28; thence along said southerly line of Lot 28 South 89° 35' 50" west 123.00 feet to the beginning of a tangent curve concave northeasterly and having a radius of 27.00 feet; thence northwesterly and northerly along said curve through a central angle of 90° 01' 58" an arc distance of 42.43 feet to a point in the westerly line of said Lot 28 and the easterly right of way line of Denni Street as shown on said Tract Map; thence North 0° 22' 12" West 123.00 feet along said westerly line to a line that is parallel with and distant northerly 150.00 feet measured from the southerly line of said Lot 28; thence North 89° 35' 50" East 150.00 feet along said parallel line to a line that is parallel with and distant easterly 150,00 feet measured from the westerly line of said Lot 28; thence South 0° 22' 12" East 150.00 feet along said parallel line to the point of beginning. SECTION 3. Said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 4. The firm of Rutan & Tucker, is hereby directed to bring an action in the California, in and for the County of Orange, to condemn by eminent domain proceedings the 2 hereof. attorneys for the City of Cypress, Superior Court of the State of in the name of the City of Cypress, property described in Section SECTION 5. For the purposes of bringing such an action, the firm of Rutan & Tucker is hereby empowered to incur, in the name of the City of Cypress, all obligations and expenses incidental thereto.
