A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
PERMITTING THE HIRING OF EXPERIENCED POLICE OFFICERS AT
SALARIES ABOVE BEGINNING COMPENSATION LEVELS.
WHEREAS, resolutions of the City Council of the City of Cypress presently
in effect do not specifically permit the hiring of experienced police officers
at salaries higher than the compensation level for inexperienced police officers
or without hiring from employment lists; and
WHEREAS, there exists a need in the City of Cypress for sufficient flexi-
bility in police hiring procedures to permit the hiring of qualified experienced
police officers at salary levels commensurate with their abilities, without the
necessity of hiring from employment lists.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress
as follows:
SECTION 1. Section 1 of Resolution No. 1441 is hereby amended to read
as follows:
All employees of the City of Cypress, except the City Manager,
City Attorney, City Treasurer, Department Heads, Division Heads,
Assistants to the City Manager, and temporary and seasonal employees,
are included in a Basic Compensation Plan. Every position under
this plan shall be assigned a Range Number established by the City
Council in the annual budget or appropriate resolution. This
Range Number shall be as shown on the salary schedule described
in Section 2 below. The salary schedule shall consist of five
(5) steps within each range, except when otherwise specified.
(a) The first step is the minimum rate and is normally
the hiring rate for the class. An employee may be assigned,
upon appointment, to other than the normal entering salary
step upon the recommendation of the City Manager when it is
decided that such action is in the best interests of the City.
Police Officers with prior experience and training may be
assigned, upon hiring to the position of Police Officer, to any
salary step commensurate with their experience and training,
upon approval of the City Manager.
(b) The second step is an adjustment which may be given
at the end of the employee's probationary period, except for
Police Officers with no prior experience, who shall be eligible
for the second step at the completion of the six month period,
if recommended by the Department Head. Other employees are
eligible for this adjustment after the completion of six months
of service at the first step. The adjustment shall be made only,
if recommended by the Department Head, and, if approved by the City
Manager. Such approval by the City Manager signifies that the
employees, other than a Police Officer, is considered a permanent
City employee.
SECTION 2. Rule IV, Section 4 of Resolution No. 703 is hereby amended
to read as follows:
SEC. 4. New positions: When a new position is created, before the
same may be filled, the appointing power shall notify the Personnel
Officer, and, except in the hiring of experienced Police Officers or
as otherwise provided by ordinance or by these rules, no person shall
be appointed or employed to fill any such position until the classifi-
cation plan shall have been amended to provide therefor and an appro-
priate employment list has been established for such position.

SECTION 3, Rule VI, Section 1 of Resolution No. 703 is hereby amended
to read as follows:
SEC. 1. Announcement: All examinations for classes in the compe-
titive service, except in the hiring of experienced Police Officers, shall
be published by posting announcements in the City Hall, on official
bulletin boards, and in such other places as the Personnel Officer deems
advisable, including at least one newspaper of general circulation in
the City. The announcements shall specify the title and pay range of
the class for which the examination is announced; the nature of the
work to be performed; preparation desirable for the performance of
the work of the class; the dates, time, place andmanner of making
applications; and other pertinent information.
SECTION 4, Rule IX, Section 1 of Resolution No. 703 is hereby amended
to read as follows:
SEC. 1. Types of Appointment: All vacancies in the competitive
service shall be filled by re-employment, reinstatement, transfer,
demotion, or from eligibles certified by the City Council from an
appropriate employment or promotional list, if available. In the
absence of persons eligible for appointment in these ways, provisional
appointments may be permitted in accordance with the personnel ordinance
and these rules. The general procedure provided in this Rule IX shall
not be required to be followed in the hiring of experienced Police Officers.
The hiring of experienced Police Officers shall be governed by the provisions
of Section 8 of this Rule.
SECTION 5, Rule IX, Section 8 shall be added to Resolution 703, as follows:
SEC. 8. In filling vacancies in the position of Police Officer, the
Personnel Officer shall have the option of filling such vacancies as
provided in Sections 1 through 7 of this Rule or by hiring experienced
Police Officers without regard to the requirements of Sections 1 through
7 of this Rule. All Police Officer applicants shall be required to pass
a written examination. Applicants for vacancies in the position of Police
Officer who are experienced Police Officers may be hired without regard
to the requirements of Sections 1 through 7 of this Rule only if such
applicants have received a P.O.S,T. Basic Certificate, as authorized
in Penal Code Sections 13500-13523, and only if such applicants meet
all other qualifications in the Police Officer Position Specification
of the Position Classification Plan of the City of Cypress. Except
as otherwise provided, experienced Police Officers hired to the position
of Police Officer shall be subject to the same rules and regulations
as Police Officers with no prior experience.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 25th day of February, 1974.
