The area to be considered for regulation of land uses is all that portion of the City of Cypress south of Ball Road The hearing will be held Thursday, December 5, 1957, at 7 00 o'clock P M at the auditorium of the Cypress Elementary School, 5202 East Lincoln Avenue, Cypress, California; and BE IT FURTHER RESOLVED that the notice of said public hearing be published and posted according to California law. RESOLVED that after public hearings as required by law, the proposed ordinance establishing land classifications and districts within the City of Cypress and regulating the uses of property therein, adopting sectional maps of said districts, defining the terms used in said ordinance, providing for the adjustment, and enforcement and amendment thereof and prescribing penalties for its violation, is hereby approved and recommended to the City Council for its consideration, that the Assistant Secretary to this Commission shall certify a copy of this proposed ordinance to said Council. Resolution No. 7 Beekman, Chairman RESOLUTION NO 8 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF CYPRESS RE STANDARD DEVELOPMENT CORPORATION It was moved by Commissioner Bordner, seconded by Commissioner Wright and unanimously carried, that the following resolution be adopted WHEREAS, there have been filed with the City of Cypress cer- tain applications on behalf of Standard Development Corporation known as Zone Change No 6, Conditional Permit No C-115, and Use Variance No UV -142 requesting a zone change and/or use vari- ance and/or conditional permit for approximately 400 acres of land located within the City of Cypress, and WHEREAS, hearings have been held, notice given as required by law, and the matter has been taken under submission by this Com- mission for decision, NOW, THEREFORE, BE IT RESOLVED that the City Planning Commission of the City of Cypress hereby finds and determines as follows 1 That all notices and hearings required by law have been given, 2. That all fees required have been paid; 3 That the property the subject of this hearing is now zoned M-1 and A-2; 4 That the present uses of the property are now and have been for some time in the past of an agricultural nature; 5 That the applicant requests permission to develop a large-scale residential and commercial development on the property comprising in excess of 1,000 homes 6 That the adjoining land use and classification within the City is not residential or commercial, but is either agricultural, manufacturing or recreational; 7 That the City is in the process of a complete land use -1- =resolution No 8 study for the purpose of reconsidering the overall plan of development for the City, 8 That the City Planning Commission and the City Council have within the last two years held over seven public hearings for the purpose of re -zoning and re-classifica- tion of the land uses within the City, and that the sub- ject property was at that time classified within its present classification with the approval of the owners, 9 That the land which is the subject of this hearing is all or substantially all usable for the use allowed by its present land use classification, 10 That there have been no maps, plot plans or outlines of any proposed development on the property which the Plan- ning Commission could consider for purposes of a use variance or conditional permit; 11 That the proposed use requested by applicant is not com- patible with the present master plan of development of the City, that the zoning law and the districting classi- fication were enacted to promote the health, safety and welfare of the City as a whole and was intended to en- courage the most appropriate use of land throughout the entire City THEREFORE, BE IT FURTHER RESOLVED as follows 1. Z-11 WHEREAS, the Planning Commission of the City of Cypress held a public hearing on January 19, 1961, regarding Zone Change Case No Z-11, and WHEREAS, the Planning Commission has studied the subject property and considered evidence submitted at the public hearing NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows SECTION I: The Planning Commission finds that the subject property is located as follows. The zoning requested by the applicant is the most suitable zoning for the land in question, at this time SECTION III: The Planning Commission recommends that the City Council approve this request for a change of zone, from A-1 to C-2 and M-1. SECTION IV• The Planning Commission finds that the subject property is suitable for the requested change of zone and such change of zone would not adversely affect the zoning plan of the City SECTION V. SECTION I: Effectively immediately, the regular meeting night of the Planning Commission of the City of Cypress shall be the first Thursday of each month. SECTION II: Regular meetings of the Planning Commission shall be held at the City Hall of the City of Cypress at 7 30 PM on the first Thursday of each month, commencing February 2, 1961. SECTION III' This Resolution was carried by the following roll call vote of the Planning Commission at its meeting of January 19, 1961. WHEREAS, the City Engineer of the City of Cypress did here- tofore prepare and submit to the Planning Commission, a certain Master Plan of Drainage dated January 4, 1961, to which reference is hereby made for further particulars, and WHEREAS, the Planning Commission of the City of Cypress con- ducted a public hearing with respect to said Master Plan of Drainage on the 19th day of January 1961, after notice duly given as required by law, and WHEREAS, the Planning Commission of the City of Cypress con- ducted a second public hearing with respect to said Master Plan of Drainage on the 2nd day of February 1961, after notice duly given as required by law NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows. SECTION I. Cha rman of Planning Commission f's.77.4z/ secretary of Planning ommission RESOLUTION NO. 15-61 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CYPRESS REGARDING USE VARIANCE CASE NO UV -161 WHEREAS, the Planning Commission of the City of Cypress held a public hearing on October 5, 1961 regarding Use Variance Case No UV -161• and WHEREAS, the Planning Commission has studied the subject property and considered evidence submitted at the public hearing, NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION OF THE CITY OF CYPRESS DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS. Section 1 The Planning Commission finds that the subject property is located as follows. Southwest corner of Cerritos and Miller Road extension, Cypress, California The subject Variance Case No Section 2 exist• property has a legal description on file with Use UV -161 The Planning Commission finds that the following conditions (a) Because of special circumstances, the strict application of the zoning ordinance of the City of Cypress is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone class- ification (b) That such conditions have been imposed upon the issuance of the variance as will insure that the variance thereby authorized does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which subject property is situated (c) That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the zone and vicinity in which the property is located (d) That the granting of such a variance will not be contrary to the objectives of the master plan or the ordinance of the City of Cypress Section 3 The Planning Commission hereby approves the application of Use Variance Case No UV -161 subject to the following conditions. 1 Dedication of all streets adjoining, a minimum of 60' on Miller, in accordance with the Master Plan of Highways 2 Improvement of Cerritos Ave 3 Sidewalks for the full width 4 Surety bond to be submitted in the amount of $5,000 for the bridge across the Flood Control Channel Section 4. RESOLUTION CF THE PLANNING COMMISSION OF THE CITY OF CYPRESS i 'PRC VING A MASTER PLAN OF DRAINAGE TO INCLUDE ALL OF THAT PROPERTY LCCATED IN THE CITY CF CYPRESS EXCLUDING THAT AREA DESIGNATED IN MASTER PLAN OF DRAINAGE 1-A, MASTER PLAN GF DRAINAGE 1-B REVISED, AND MASTER PLAN OF DRAINAGE 2-A WHEREAS, the City Engineer of the City of Cypress did heretofore prepare and submit to the Planning Commission a certain Master Plan of Drainage dated September 29, 1961 to which reference is hereby made for further particulars, and WHEREAS, the Planning Commission of the City of Cypress conducted a public hearing with respect to said Master Plan of Drainage on the 5th day of October, 1961 after notice duly given as required by law, and WHEREAS, the Planning Commission of the City of Cypress conducted a second public hearing with respect to said Master Plan of Drainage on the 2nd day of November, 1961 after notice duly given as required by law NOW THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows SECTION I The Planning Commission of the City of Cypress hereby approves and adopts said Master Plan of Drainage prepared by the City Engineer and dated September 29, 1961 SECTICN II This Resolution was carried by the following roll call vote of the Planning Commission at its meeting of November 2, 1961 AYES Commissioners Baroldi, Ferreira Garcia, Wicker, Wright and Bordner NCES Commissioners• None ABSENT Commissioners• Tuinhout ADOPTED, SIGNED AND APICR.OVED this 2nd day of November, 1961 O?•/Z.1.'C&nfrt, Secretary of the P] ning Commissio Chairman of the Planning Commission RESOLUTION NG 25-61 A RESCLUTIGN OF THE PLANNING COMMISSION CF THE CITY GF CYPRESS REGARDING ZGNE CHANGE CASE NG Z-24 WHEREAS the Flanning Commission of the City of Cypress held a public hearing on November 2 1961 regarding Zone Change Case No Z-24, and WHEREAS, the Planxung Commission has studied the subject property and considered evidence submitted at the public hearing NGW THEREFGRE, BE IT RESOLVED, that the Planning Commission of the City of Cypress does hereby resolve, determine and order as follows SECTIGN I The Planning Commission finds that the subject property is located as follows The north half of the southwest quarter of Section 22, Township 4 south, Range 11 west, except that portion thereof lying southerly of the southerly line of Rancho Los Coyotes, also except the south 300 feet thereof, also except the north 272 feet of the east 390 feet thereof• also except the west 600 feet thereof SEC TION II The Planning Commission finds that the facts in this matter are as follows, (1) At the time of the public hearing there was a written protest from the Southern Pacific Railroad Company objecting to this proposed zone change There was also a protest from the Southern Pacific Railroad who indicated that they felt a portion of this area adjacent to the railroad tracks should be reserved for industrial development (2) The proposed change of zone would not adversely affect the surrounding area (3) The zoning requested by the applicant is the most suitable zoning for the land in question at this time, except that area contiguous to the railroad be deleted from the proposed zone change for 300 feet from the center line of the railroad right of way SECTIGN III The Planning Commission finds that the subject property is suitable for the requested change of zone and such change of zone would not adversely affect the zoning plan of the City SECTION IV The Planning Commission recommends that the City Council of the City of Cypress approve this request for a change of zone from Zone A-2 to Zone R -I deleting therefrom the area heretofore described SECTION V This Resolution was carried by the following roll call vote of the Planning Commission at its meeting of November 2, 1961 P Y ES NOES Commissioners Ferreira, Garcia, Wicker and Wright Commissioners Bordner 1 ABSENT. The Planning Commission finds that the subject property is suitable for the requested change of zone and such change of zone would not adversely affect the zoning plan of the City SECTION IV: The Planning Commission recommends that the City Council of the City of Cypress approve this request for a change of zone from Zone A-2 to Zone M-1 (Industrial) SECTION V• This Resolution was carried by the following roll call vote of the Planning Commission at its meeting of December 7, 1961 AYES 5 COMMISSIONERS.
