OF NOTICE OF SPECIAL MEETING OF THE
CITY COUNCIL OF THE CITY OF CYPRESS
KNOW ALL MEN BY THESE PRESENTS•
That we, the undersigned, being all the Councilmen,
by mutual consent and understanding beforehand, hereby consent
to hold a special meeting of the Council of said City at the
Cypress City Hall on the 16th day of February, 1959, at the hour
of 8 00 P M of said day, and we agree that all of the acts
and proceedings of said meeting shall be as valid as if had or
taken at a meeting duly and regularly called and noticed
We further waive all notice of the time, place, and purpose
of said meeting, whether required by the laws or otherwise

MINUTES OF THE MEETING
OF THE CITY COUNCIL OF
THE CITY OF CYPRESS
February 16, 1959
A special meeting of the City Council of the City of Cypress was
called to order in the City Hall, 9352 Walker Street at 8 15
P M with Mayor Van Dyke presiding
Councilmen present• A E. Arnold, W J. Arrowood, T A Baroldi,
M G McCarney, and J. Van Dyke
Councilmen absent None
City officials present. City Clerk Olsthoorn, City Manager -
Deputy City Clerk Wesenberg, and
City Attorney Howell
SILVA USE VARIANCE
The Deputy City Clerk stated that this was the time and place
for hearing on the use variance application UV -125 of Tony Silva,
Jr and Lois M Silva Said variance to permit the erection of
a single-family dwelling and garage in the A-2 Agricultural dis-
trict for occupancy by an agricultural employee Said dwelling
to have less than the required side yard and front yard. The
Deputy City Clerk stated that it was the recommendation of the
Cypress Planning Commission that this variance be granted with the
condition that there be an eighteen (18) foot side yard on the
East side of the dwelling in question During the discussion, the
Planning Commission Chairman, i'ir Beekman, stated that he felt that
the City was getting too far away from the regulations as set
forth in the Zoning Ordinance in too many of the variance that
have been granted He spoke in favor of the Planning Commission's
recommendation. Councilman Arnold moved that the variance be
granted as recommended by the Planning Commission The motion
failed for lack of a second Mr Arnold moved that the variance
be granted with an eight (8) foot side yard condition The
motion failed for lack of a second. Councilman Baroldi moved
that use variance 125 be granted with the condition that the East

side yard for the house and garage be five (5) feet The motion
was seconded by Councilman McCarney. The motion carried by four
(4) Ayes to one (1) No (Councilman Arrowood dissenting) During
the discussion, Councilman Arnold stated that he would always be
in favor of granting any variance requested, providing that said
variance is not detrimental to the adjoining property and does
not devaluate the adjoining property
EASE RADIO STATION
The City Manager explained that the City expects to purchase a
Police Department base radio station with the aid of the Federal
Government and Orange County. The City Manager asked the Council
if they would favor the City of Cypress paying for the full amount
which the City would be obliged to pay under the present arrange-
ment or do they wish Dairyland to pay one-third (1/3) of that
cost. By a vote of three (3) to two (2) (Mr Arrowood and Pyr Van
Dyke dissenting) the Council agreed that the City of Cypress should
pay for the entire cost of the City's share of said base radio
equipment.
WALKER STREET CLOSING
Upon motion of Councilman Baroldi, seconded by Councilman McCarney
and unanimously carried, the Council rescinded the previous order
requesting that Walker Street be closed at the same time as Miller
Street for the construction of bridges over the Carbon Creek
channel and ordered that Walker Street be open during the coming
racing event at the Los Alamitos Race Course.
FOREST LAWN SET -BACK QUESTION
Councilman Arnold brought up the question, "Should not the Forest
Lawn Cypress Cemetery have an additional set -back farther than
the sixty (60) feet from the centerline on Lincoln Avenue, which
set -back they must now have under the present zoning ordinance?"
He thought that, if Lincoln Avenue should ever be widened to six

(6) lanes, that the present set -back requirement would be insuf-
ficient Mr Ugene Blalock, appearing for Forest T.swn, stated
that the State of California knew of the cemetery set -back and
the proposed improvements along the frontage facing Lincoln
Avenue, and that the State Division of Highways had definitely
approved of their present set -back and of the proposed improve-
ments which they are about to place alons, the front of Lincoln
Avenue He stated that the State had authorized the use of the
northerly twelve (12) feet of the present State Highway right-
of-way for improvements by r'orest Lawn, providing that there be
no burials He further stated that the State does not plan to
widen Lincoln to six (6) lanes. The City Council, after dis-
cussion, felt that the present set -back is proper
ADJOURNMENT
There being no further business, the meeting was duly adjourned
at 9.30 P M
