1959-07-13MINUTES OF THE M; TING OF THE CITY COUNCIL OF THE CITY OF CYPRESS July 13, 1959 A regular meeting of the City Council of the City of Cypress was called to order by Mayor Van Dyke in the City Hall, 9352 Walker Street, at 8:00 o'clock P M, The Pledge of Allegiance to the Flag was led by Councilman Baroldi. Roll Call Councilmen present. W. J. Arrowood, T. A. Baroldi, M. G. McCarney, and J. Van Dyke Councilmen absent* A, E Arnold (came in at 8.35 P. M,) City officials present City Clerk Olsthoorn, Deputy City Clerk -City Manager Wesenberg, City Attorney Howell, City Engineer Neff, and Deputy City Engineer Farnham MAIONI CONDITIONAL PEHMIT The Deputy City Clerk presented conditional permit application No. C-101 of Philip and Harriet Maioni to permit the moving in of a single-family frame dwelling in the M-1 zone on Orange Avenue. The Deputy Clerk read the recommendation of the Cypress Planning Commission. Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, the Council granted Conditional Permit No. C-101, as requested, with the condition that applicants dedicate to the City of Cypress an area 40 f:.ot from the centerline of Orange Avenue for the full width of the property for street widening purposes. WEED ABATEMENT HEARING The Deputy City Clerk stated that this was the time and place as noticed for the public hearing of protests on weed abatement. He stated that no written protests had been received by the City Clerk's office and asked if anyone present wished to protest. Upon hearing none, Councilman Baroldi moved that the hearing be closed, which motion was seconded by Councilman McCarney and was unanimously carried. REVISED EXCAVATION ORDINANCE The matter was tabled due to the absence of the City Attorney at another meeting. -1- July 13, 1959 ADMISSIONS TAX ORDINANCE ADOPTION The Deputy City Clerk presented Ordinance No. 62 for second reading and final adoption. It was moved by Councilman Arrowood, seconded by Council Baroldi and unanimously carried, that said ordinance be read by title only. Whereupon, the Deputy City Clerk did read the title of said ordinance. Upon motion of Councilman Baroldi, seconded by Councilman Arrowood, Ordinance No. 62, pro- viding for a tax of ten cents (10¢) on each paid admission to the Los Alamitos Race Course, was passed and adopted unanimously by the following roll call vote. AYES Councilmen Arrowood, Baroldi, McCarney, and Van Dyke NOES* None ABSENT* Councilman Arnold MILLARD ANNEXATION ORDINANCE ADOPTION The Deputy City Clerk presented Ordinance No. 63 for second read- ing and final adoption. It was moved by Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried that said ordinance be read by title only. Whereupon, the Deputy City Clerk did read the title of said ordinance. Upon motion of Councilman Arrowood, seconded by Councilman Baroldi, Ordinance No. 63, annexing certain uninhabited territory known as the Millard Annexation, was passed and adopted unanimously by the following roll call vote* AYES: Councilmen Arrowood, Baroldi, McCarney, and Van Dyke NOES. None ABSENT: Councilman Arnold REGISTER OF DEMANDS Upon motion of Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, the Register of Demands for the month of July was approved as presented. The Deputy City Clerk presented for approval for payment two state- ments which were not on the Register of Demands. Said. statements -2- July 13, 1959 were from Kenneth G Hebard, D 0 for intoxication examinations for the month of June, 1959, in the amount of $57.50, and from Industrial Asphalt at Stanton for street maintenance material in the amount of '583.13, Upon motion of Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, these two bills were approved for payment. JUANITA STREET REPAIR It was moved by Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, that that portion of Juanita Street which had not already been resurfaced receive a road mix resurfacing immediately. At this point, Councilman Arnold joined the meeting, at 8.35 P. M. PLANNING COMMISSION MEMBERSHIP SOUTHERN CALIFORNIA PLANNING CONGRESS Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved membership in the Southern California Planning Congress for the Cypress Planning Commission and the payment of a $25.00 per year membership fee, ACCEPTANCE OF LAND DEEDS Councilman Arnold moved that all deeds of transfer of land to the City shall be verified by the City Engineer before being presented to the City Council and shall bear the City Engineer's signature and date, which motion was seconded by Councilman Arrowood and unanimously carried. BUILDING SERVICE AGREEMENT Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Mayor and City Clerk were authorized to execute the agreement with the County of Orange for Building Department services for the present fiscal year. ROAD MAINTENANCE AGREEMENT Upon motion of Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, the Mayor and City Clerk were authorized to execute the agreement with the County of Orange for continuation of the road maintenance services contract, July 13, 1959 DUANE WHEELER AND COMPANY BID ACCEPTANCE The Deputy City Clerk presented and read a bid by Duane Wheeler and Company for election supplies for the general election of April, 1960, in an amount not in excess of $167.20, Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, said bid by the Duane Wheeler Company was accepted. RESOLUTION,, ACCEPTANCE, LOT B 1HACT NO. 49 Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, the Council adopted Resolution No. 96, accepting the deed to Lot B, Tract No. 49, which was recently pur- chased by the City. LEAVE OF ABSENCE Councilman Arrowood requested permission to be absent from the City for one (1) week beginning Friday evening, July 17,. Said permission was granted. ADJOURNMENT Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, the meeting was adjourned at 9.05 o'clock P. M. until the next regular Council meeting.
