1959-08-10MINUTES OF THE METING OF THE CITY COUNCIL OF THE CITY OF CYPRESS August 10, 1959 A regular meeting of the City Council of the City of Cypress was called to order by Vice Mayor Baroldi in the City Hall, 9352 Walker Street, at 7.30 otclock P. M. The Pledge of Allegiance to the Flag was led by Councilman Arnold. ROLL CALL. Councilmen present: A. E. Arnold, W. J. Arrowood, T. A. Baroldi, M. G. McCarney and J. Van Dyke (who came in late) Councilmen absent: None City officials present. City Clerk Olsthoorn, Deputy City Clerk - City Manager Wesenberg, City Attorney Howell, City Engineer Neff, Assistant to City Engineer Mercado, and Planning Commissioner Wright MINUTES Upon motion of Councilman Arrowood, seconded by Councilman Arnold, and unanimously carried, the Council approved the minutes of the meeting of April 28, 1959, as submitted. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved the minutes of the meeting of May 20, 1959, as submitted. Upon motion of Councilman Arrowood, seconded by Councilman Arnold. and unanimously carried, the Council approved the minutes of the meeting of June 1, 1959, as submitted. Upon motion of Councilman Arrowood, seconded by Councilman Arnold and unanimously carried, the Council approved the minutes of the meeting of June 8, 1959, as submitted. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved the minutes of the meeting of June 18, 1959, as submitted. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved the minutes of the meeting of June 22, 1959, as submitted. -1- August 10, 1959 Upon motion of Councilman Arrowood, seconded by Councilman Arnold and unanimously carried, the Council approved the minutes of the meeting of June 26, 1959, as submitted,. Upon motion. of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved the minutes of the meeting of July 6, 1959, as submitted* Upon motion of Councilman Arrowood, seconded by Councilman Arnold and unanimously carried, the Council approved the minutes of the meeting of July 13, 1959, as submitted. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council approved the minutes of the meeting of July 27, 1959, as submitted. DE POLTER ANNEXATION The Deputy City Clerk stated that this is the time and place as noticed for the hearing on the annexation of certain uninhabited territory, known as the De Polter Annexation, to the City. He stated that no written protests have been received by the City Clerk's office and asked if there was anyone present who wished to protest against the annexation. There were no protests from the floor of the Council Chamber. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the public hearing was closed. The City Attorney presented an ordinance approving the annexation of said territory, known as the De Polter Annexation, to the City. It was moved by Council- man Arnold, seconded by Councilman Arrowood and unanimously carried, that said ordinance be read by title only. Thereupon, the City Attorney did read the title of said ordinance. At this point Mayor Van Dyke arrived at the meeting and occupied the Chair. WIGHT VARIANCE The Deputy City Clerk presented yard variance application No, V-140 of Mark L. Wright to permit the building of an addition to an existing dwelling in the C-2 zone on Lincoln Avenue, Which addi- tion would have less than the required setback from the property line. The Deputy City Clerk stated the recommendation of the Cypress Planning Commission. Councilman Arnold moved that the application be approved as requested and that the City Engineer determine the exact setback from the property line, Following discussion, Councilman. Arnold amended his motion to state that the application be approved as requested, The motion as amended was seconded by Councilman Arrowood and unanimously carried. -3- August 10, 1959 It was moved by Councilman Arnold, seconded by Councilman McCarney and unanimously carried, that the City Engineer define for the City the existing property line along Lincoln Avenue in the Eastern portion of the City. TRAUTMAN VARIANCE ANCE PROBLEM DISCUSSION The Deputy City Clerk stated that this matter had been taken up by the Planning Commission and that no action by the Council was necessary at this time, LINCOLN AVENUE SUBDIVISION PLAN The Deputy City Clerk presented a map of a proposed subdivision of duplexes in County territory between Merton and Lincoln and Sumner Place, After study of the map by the Council, it was moved by Councilman Arrowood, seconded by Councilman Arnold and unani- mously carried, that the plans be received and filed, SPEED LIMIT OR DI NANCE Upon motion of Councilman Baroldi, seconded by Councilman Arnold and unanimously carried, it was ordered that each Councilman be provided with a copy of a proposed ordinance setting the speed limit on certain City streets for study and that the matter be brought up at the next Council meeting. SUMNEli PLACE-CRESCENT AVENUE REPORT The City Attorney reported on progress in reaching an agreement with Forest Lawn authorities on the Sumner Place-Crescent Avenue improvements. Upon the City Attorney's recommendation, Council- man Baroldi moved that a discussion meeting be called as soon as it is possible for all Councilmen to be present at which maps of the area will be studied to determine just that action should be taken. The Planning Commission and City Engineer are to be in. vited to attend said meeting, Said motion was seconded by Council- man Arrowood and unanimously carried, August 10, 1959 EXCAVATION ORDINANCE Upon the suggestion of the City Attorney, it was moved by Council- man Arnold, seconded by Councilman McCarney and unanimously carried, that the basic ordinance be re -written and presented to the Council at the next meeting for their action. MEDICAL INSURANCE Following a report by the City Manager, it was moved by Councilman Arrowood, seconded by Councilman Arnold and unanimously carried, that Plan No. 2, as submitted by Prudential Insurance Company, be approved for group medical insurance coverage for City employees, POLICE VEHICLES SERVICING BIDS The City Manager reported on the two (2) bids received for the servicing of the police vehicles for the next six months, said bids having been received from Sam Van Kampen's Union Oil Service and Hartts Rocket Service. Following discussion, upon motion of Councilman Arrowood, seconded by Councilman McCarney and unani- mously carried, it was ordered that the service agreement be awarded to Sam Van Kampents Union Oil Service and that a standard bid form be prepared for future use in obtaining such bids. LOT BOOK REPORT VS, CERTIFICATION Following a report by Ray Mercado, Assistant to the City Engineer, it was moved by Councilman Arnold that a log book of the lots of the City of Cypress be obtained by the City Engineer, which motion was later rescinded. It was then moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that the City Engineer is authorized and directed, whenever he receives notice of filing with the City of a request for a zone change, a variance or a conditional use permit or anything involving a dedication required by the City, to obtain from a land title cfom.. parry in Orange County a lot book report covering the property in- volved in such matter, -5- August 10, 1959 COUNTY ORDINANCE NO. 916, COMMERCIAL ZONE REGULATIONS Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the City Manager was instructed to supply the Councilmen with copies of County Ordinance No. 916 for study and the :natter is to be taken up at the next regular meeting. BUDGET HEARING, RESOLUTION ADOPTING BUDGET The City Manager presented the budget for the fiscal year 1959-60. Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, Resolution No. 99, approving the budget for the fiscal year 1959-60 for the City of Cypress, was adopted. REGISTER OF DEMANDS Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the Register of Demands for the month of August, 1959, was approved, CEdRITOS AVENUE AGREEMENT WITH COUNTY The Deputy City Clerk presented and read an agreement between the County of Orange and the City of Cypress for reconstruction of Cerritos Avenue. Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the Council authorized the proper City officials to execute said agreement. LINCOLN AVENUE JURISDICTIONAL PROBLEM The City Manager was instructed to take appropriate action with the City of Buena Park on the traffic enforcement jurisdiction problem on Lincoln Avenue and to report back to the Council. AWARDING STREET CONSTRUCTION CONTRACT The City Engineer stated that Norwalk Asphaltic Concrete Inc. had been determined to be the lowest responsible bidder on the street construction project S914C-2, 7, 8, and 9, which was put out for bids by the City. It was moved by Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, that the bid of Norwalk Asphaltic Concrete Inc, be accepted and the contract awarded to said company and that the proper City officials are authorized to execute -6.. August 10, 1959 the construction contract with said company for said project conditioned upon the company's waiving any claim of damage or adjustment in the bid amount by reason of the delay in accepting the bid. LEAGUE OF CITIES CONFERENCE Upon motion of Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the City Attorney was authorized to attend a League of Cities conference in San Francisco as a representative of the City. LINDEROOM DEED PROBLEM The Deputy City Clerk presented a proposed deed submitted by the Orange County Flood Control District, transferring title of a 30 x 120 foot strip of land on Miller Street from the City to the Flood Control District. It was moved by Councilman Arnold, seconded by Councilman Arrowood, that said strip of land be deeded back to Eize Lindeboom subject to the approval of the City Attorney as to form. This motion was later withdrawn with permission of the second. It was moved by Councilman McCarney that the Council authorize the execution and delivery of a deed to the property in question subject to the approval of the City Engineer and City Attorney, This motion was not seconded and was withdrawn. It was moved by Councilman McCarney that the property obtained be returned to Eize Lindeboom, which motion was seconded by Councilman Arrowood and failed to carry by a vote of one Aye to three Noes (Councilman Arrowood voting in the affirmative). It was moved by Councilman McCarney, seconded by Councilman Arnold, that the Council authorized the execution of a quitclaim deed to Mr. Lindeboom to the portion of the property located within the Flood Control right-of-way inadver- tently deeded to the City in exchange for a deed to the City describ- ing correctly the property according to UV -130, which motion was carried by a vote of three Ayes to one No (Councilman Arrowood dissenting), -7- August 10, 1959 MISCELLANEOUS Councilman Arnold stated that he had been asked by the Citizens Committee several questions which he could not answer and would appreciate having answered. 1. Parking of Police car in Van Kampen service station at night. The Police Chief stated that on the graveyard shift, 12.00 A.M. to 8.00 A. M., there is only one man on duty three nights a week and that the car is locked in the service station to prevent vandalism. He stated that a key was available so that the car could be used if necessary. 2. Only one car on duty in the daytime. It was explained that the police force is limited as to number and that the force is concentrated on the times when it is most needed. It was also pointed out that, since the Police Chief is on duty during the day, there are two men available for emergencies. 3. No reserves riding in the cars„ The Police Chief stated that the City has lost its reserves due to the fact that they have all become employed with other departments. A Mrs. Pat Tatro, 5616 Newman Street, Cypress, asked several questions which were answered for her. A gentlemen, '634444 -Orange Avenue, complained of the dust raised by horseback riders along the Pacific Electric right-of-way. The City Manager was instructed to investigate the :natter. Councilman McCarney brought up the matter of horses being ridden in an unsafe manner on Karen Street. The City Manager was in- structed to investigate. ADJOURNMENT There being no further business to come before the Council, upon motion of Councilman McCarney, seconded by Councilman -8- August 10, 1959 Baroldi and unanimously carried, the meeting was adjourned at 10.20 o'clock P, M. until the next regular meeting.
