1959-09-14MINUmS OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS September 14, 1959 A regular meeting of the City Council of the City of Cypress was called to order by :Mayor Van Dyke in the City Hall, 9352 Walker Street, at 7 30 o'clock P M The Pledge of Allegiance to the Flag was led by City Attorney Howell. Councilmen Present A E Arnold, W. J. Ar•rowood, T A Baroldi, M G McCarney, and J Van Dyke Councilmen Absent• None City officials present. MINUTES City Clerk Olsthoorn, Deputy City Clerk - City Manager Wesenberg, City Engineer Neff, and City Attorney Howell Upon motion of Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the minutes of the meeting of August 10, 1959, were approved as submitted. SPYKSNA ZONE CHANGE PUBLIC HEARING The Deputy City Clerk stated that this was the time and place as noticed for the public hearing on the request of Charles 5pyksma for a change of zone from A-2 to C-2 on three (3) acres at the Northwest corner of Juanita Street and Ball Road The land is to be used for the construction of an automotive center He stated that no written protests had been received by the City Clerk's office and asked if anyone present wished to protest Upon hearing no protests, it was moved by Councilman Arrowood, seconded by Councilman i"icCarney and unanimously carried, that the public hearing is declared closed. The recommendation of the Cypress Planning `commission was stated It was moved by Councilman Arnold, seconded by Councilman McCarney and unanimously carried, that said zone change be granted as requested, with the conditin that applicant dedicate to the City of Cypress an area 40 feat from the centerline of Juanita Street and 50 feet from the centerline of Ball Road for street widening purposes for the length of the property involved. -1- September 14, 1959 SURUKI VARIANCE AMENDMENT The Deputy City Clerk presented the request of Masari Suruki, owner of the Lincoln Nursery, for an amend:r:ent to Condition No. 2 of UV -102, granted on September 10, 1957 It was explained that the County Building Department had found that it was impossible, without removing the display area, to provide off-street parking for the number of cars called for in Condition 2 of the variance Therefore, Mr Suruki requested that Condition 2 be amended to provide off-street parking for six (6) cars It was stated that the County Building Department approved of said request It was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that said amendment to Condition No 2 of UV -102 be granted as requested VAS HUNNICK VARIANCE AMENDMENT REQUEST Mrs Garrett Van Hunnick appeared to request that the Council re- consider the variance granted to them for the Trojan Dairy She wished to have the number of feet of dedication for street pur- poses reduced from 150 feet to 100 feet and she also wished the variance to be made permanent. Mrs Van Punnick brought up the fact that their sign had been placed 30 feet from the property line instead of 35 feet as required by the variance. It was moved by Councilman McCarney seconded by Councilman Arnold and unanimously carried, that the City Engineer make a corrected map showing the proposed set-up, ascertain the centerline of Miller Street, and see if the proposed measurements are correct and that this matter be brought up at the next Council meeting It was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that the sign be included in the discussion at the next meeting LINDEBOOM DEED ACCEPTANCE The City Manager presented to the Council a document conveying to the City an interest in real property. It was dated August 28, -2- September 14, 1959 1959, and signed by Eize Lindeboom. Upon motion of `'ouncilman Baroldi, seconded by Councilman Arrowood and unanimously carried, said document is hereby accepted and the City Manager is authorized and directed to certify to such acceptance and to cause its re- cordation. RESOLUTILN, HOLDER STREET CHANT:EL Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, Resolution No 100, a joint resolution with the City of Buena Park requesting County cooperation in the construction of a flood control channel along Holder Street, was adopted by the City Council REPORT OF COST OF ASPHALT CU' .BS The City Engineer presented a report on the cost of installing extruded asphalt curbs on Karen, Canip, Newman and Nelson Streets Councilman Arnold moved that the above-named streets be repaired to 32 feet and that the asphalt curbs be constructed Said motion was seconded by Councilman McCerney. Following discussion, Coun- cilman Arnold amended his motion as follows That, starting with Nelson and Newman, the above-named streets be repaved and asphalt curbs installed according to the City Engineer's recommendations, as far as the budgeted money will go, and that the City Engineer is authorized to prepare specifications and advertise for bids. Said amended motion was seconded by Councilman Arrowood and unani- mously carried. R-1 ZONE CHANGE REQUEST A Mrs Shadduck, a real estate broker, asked if the Council would be in favor of changing the zoning on 54 acres South of Lincoln near Holder to R-1 in order to subdivide the section for homes. Mrs Shadduck was instructed to take the matter up through the proper channels. DE POLTER ANNE?,ATION ORDINANCE The City Attorney presented Ordinance No 66, annexing certain -3- September 14, 1959 territory known as the De Polter Annexation to the City, for second reading and final adoption It was moved by Councilman Baroldi, seconded by Councilman McCarney and unanimously carried, that said ordinance be read by title only Whereupon, the City Attorney did read the title of said ordinance It was moved by Councilman Arnold, seconded. by Councilman Arrowood, that said Ordinance No 66 be passed and adopted, which motion was unani- mously carried by the following roll call vote AYES Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES None ABSENT None WETZEL ANNEXATION ORDINANCE The City Attorney presented Ordinance No 67, annexing to the City the territory known as the Wetzel Annexation, for second reading and final adoption It was moved by Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, that said ordinance be read by title only. Whereupon, the City Attorney did read the title of said ordinance Upon motion of Councilman Arrowood, seconded by Councilman Arnold, said. Ordinance No 67 was passed and adopted, which motion was unanimously carried by the following roll call vote* AYES Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES None ABSENT None STREET EXCAVATIONS ORDINANCE The City Attorney presented and read Ordinance No 60-A, governing excavations in the City streets. It was moved by Councilman Arrowood that said Ordinance No 60-A be passed and adopted as an urgency measure. At this point the matter was tabled until later in the evening to give the City Engineer time to read the proposed ordinance _4_ September 14, 1959 SPEED LIMITS ORDINANCE The Deputy City Clerk presented and read a proposed ordinance establishing the speed limits on the various streets in the City. Following discussion, it was moved by Councilman Arrowood, secon- ded by Councilman Arnold and unanimously carried, that the speed limit be set at 30 miles per hour on Juanita Street and that no speed limit be posted on Katella Avenue. Upon motion of Council- man McCarney, seconded by Councilman Arrowood and unanimously carried, said Ordinance No. 68 was introduced and passed on to the next Council meeting for second reading and final adoption COUNTY ORDINANCE NO 916 Following discussion, upon motion of Councilman HcCarney, seconded by Councilman Arrowood and unanimously carried, the matter was continued until the next Council meeting. STREET EXCAVATIONS ORDINANCE CONTINUED Councilman Arnold seconded Councilman Arrowood's motion to adopt Ordinance No. 60-A as an urgency measure, which motion was unani- mously carried by the following roll call vote AYES. Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES None ABSENT' None REPORT ON SOUTH BOUNDARY, LINCOLPN AVENUE The City Engineer presented maps and reported on the information he had obtained on the right-of-way line on Lincoln Avenue east of Walker Street The City Engineer stated that further infor- mation will be obtained from the State Highway Department MASTER PLAN OF HIGHWAYS DISCUSSIN The City Engineer presented a map as submitted by the County Road Department September, 1958, and explained how said map affected the various streets in the City There followed a general dis- cussion of the matter by the Council. The Council instructed -5- September 14, 1959 the Engineer to take the matter to the Planning Commission for their study REGISTER OF DEMANDS Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the Register of Demands for the month of September, 1959, was approved as submitted AUDIT REPORT The Deputy City Clerk presented to each Councilman a copy of the audit report for the 1958-59 fiscal year It was moved by Coun- cilman Arrowood, seconded by Councilman Baroldi and unanimously carried, that said audit report be received and filed. MILLER STREET REPAVING City Clerk Olsthoorn brought up the question of putting in the base and doing the complete repaving job on Miller Street now since it is all torn up by the contractor who has been laying the sewer line. There followed considerable discussion of the merits of doing the repaving now or waiting until the street has had a chance to settle Upon motion of Councilman McCarney, seconded by Councilman Baroldi and unanimously carried, the City Engineer was instructed to investigate the question ABOLISHING NAVAL AIR STATION REQUEST The Deputy City Clerk stated that a letter had been received from the Committee for the Abolishing of the Naval Air Station at Los Alamitos requesting support from the Cypress City Council in their project. It was moved by Councilman_ Arrowood, seconded by Coun- cilman Arnold and unanimously carried, that the City Council of the City of Cypress is opposed to the moving of the Los Alamitos Naval Air Base. ADJOURNMENT Upon motion of Councilman Baroldi, seconded by Councilman McCarney and unanimously carried, the meeting was adjourned at 10 35 P.
