1959-11-12MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS November 12, 1959 An adjourned regular meeting of the City Council of the City of Cypress was called to order by Mayor Van Dyke in the City Hall, 9352 Walker Street, at 7 30 o'clock P. M. The Pledge of Allegiance to the Flag was led by Councilman McCarney. Councilmen present A E Arnold, W J Arrowood, T. A. Baroldi (who came in late), M. G. McCarney, and J. Van Dyke Councilman absent None City officials present City Clerk Olsthoorn, Deputy City Clerk - City Manager Wesenberg, City Engineer Neff City Attorney Howell (who came in late), and Planning Commissioner Wright Councilman McCarney stated that he had received from the Citizens Committee a letter which questioned the legal qualifications of one of the Councilmen. Councilman McCarney asked for a clarification of the status of the gentleman in question. Mayor Van Dyke stated that he preferred to table this matter until the City Attorney was present. MINUTES Upon motion of Councilman McCarney, seconded by Councilman Arnold and unanimously carried, the minutes of the meeting of October 13, 1959, were approved as submitted. SOUSA DEDICATION ACCEPTANCE The Deputy City Clerk presented an easement deed from Joseph P. and Lorene Sousa for street widening purposes as required by Condition 1 of UV -137. Upon motion of Councilman Arnold, seconded by Councilman McCarney and unanimously carried, said easement was accepted and the proper City officials were instructed to effect the recordation of said deed. ViN HUNiNICK DEDICATION ACCEPTANCE The Deputy City Clerk presented an easement deed from Garrett and Anne Van Hunnick for street widening purposes as required by Condi- tion 2 of UV -134. Upon motion of Councilman McCarney, seconded by -1- November 12, 1959 Councilman Arnold and unanimously carried, said easement was accepted and the proper City officials were instructed to effect the recordation of said deed, BAKER DEDICATION ACCEPTANCE The Deputy City Clerk presented an easement deed from Mrs. Ruth T Baker for street widening purposes as reauired by Condition 2 of UV -138, Upon motion of Councilman McCarney, seconded by Councilman Arnold and unanimously carried, said easement deed was accepted and the proper City officials were instructed to effect the recordation of said deed. SPYKSMA DEDICATION ACCEPTANCE The Deputy City Clerk presented an easement deed from Charles and Gertie Spyksma for street widening purposes as required by Rezoning Permit No. 3. Upon motion of Councilman McCarney, seconded by Councilman Arnold and unanimously carried, said easement deed was accepted and the proper City officials were instructed to effect the recordation of said deed, ACCEPTANCE OF STh ET WORK The City Engineer reported that construction work on Project S9LC-23-7,8, and 9 (Moody Street from Ball to Cerritos, Moody Street one-fourth mile north of Orange, Orange Avenue from Moody to Bloomfield, Walker Street from Orange to Bali) had been com- pleted in accordance with specifications. Upon motion of Council- man Arnold, seconded by Councilman McCarney and unanimously carried, the Council accepted said Project S94 -C-2,7,8, and 9. PLANNING COMMISSION REPORT ON LINCOLN SETBACK The Deputy City Clerk reported that the Planning Commission recom- mends that the Council use the north and south property lines along Lincoln Avenue in determining setbacks. It was moved by Councilman I4icCarney, seconded by Councilman Arrowood and unanimously carried, that the Council accept the Planning Commission recommendation, -2- November 12, 1959 MARCH OF DIMES CAI:PAI GN REQUEST The Deputy City Clerk presented and read a letter from the March of Dimes Association requesting permission to conduct a fund-rais- ing campaign in the City. It was moved by Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, that per- mission be granted to conduct said campaign. AUDIT REPORT Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the audit report for the quarter ending September 30, 1959, was received. REPORT ON COUNTY REFUSE DISPOSAL PLAN The City Manager reported to the Council for their information on the County's proposed 20 -year plan for trash collection and dis- posal At this point the City Attorney arrived. ROCK BASE ON IM'MILLER STREET The City Manager reported on the result of conferences with the City Engineer on the matter of putting rock base on Miller Street from Orange Avenue to Cerritos before the sewer contractor paves the street with blacktop. He also read a letter from County Road Commissioner A. S Koch to the City Engineers of several cities on the subject of widening Miller Street. Following discussion, upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, the Council voted to offer the County Road Department the cooperation of the City as far as the City's budget will allow, authorized the City Engineer to determine the costs of establishing the grade and putting in the rock base and to nego- tiate with the County to attempt to get the County to share with Cypress the costs of the project of improving Miller, and requested that the Sanitation District not allow the contractor to resurface Miller Street until the City can determine whether it can complete its negotiations. -3- November 12, 1959 BOULEVARD STOPS Following discussion of the need for boulevard stops at the inter- sections of Holder and Orange and Juanita and Orange to control north -south traffic and a report by the Chief of Police, it was moved by Councilman McCarney, seconded by Councilman Arnold, that the matter of the boulevard stops at Holder and Orange be referred to the Orange County Traffic Safety Committee for a report and recommendation This motion was amended by Councilman Arnold, with the permission of Councilman McCarney, to include the boule- vard stop at the intersection of Juanita and Orange, which amended motion was unanimously carried. REGISTER OF DEMANDS Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Register of Demands for the month of November, 1959, was approved as submitted, CEHRITOS AVENUE REPORT The City Manager reported on the progress made by the sewer con- tractor on Cerritos Avenue and the present condition of the street. It was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that the portion of Cerritos Avenue which had been backfilled be graveled and dust oiled so that the street can be opened to traffic. POLICE CAR BIDS The City Manager presented the following bids for a car to replace the police department line car* 1 George Klimpel, Inc, Dodge Dart; price $1,265.80, delivery three to four weeks, 2, S & J Chevrolet Chevrolet Biscayne, price' $990.98, delivery information unavailable; 3. McCoy Motor Co Ford Fairlane, price $1,255.09, delivery two to four weeks. -4- November 12, 1959 It was moved by Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, that the police line car be replaced with a Dodge Dart from George Klimpel, Inc, U OF C RESOLUTION Upon. motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the Council adopted Resolution No 101, urging the Board of Regents of the University of California to establish a branch of the University of California somewhere in Orange County. QUALIFICATIONS OF COUNCILMAN Councilman McCarney again brought up the question of the qualifica- tions to hold office of one of the Councilmen and asked for clari- fication. It was pointed out that the problem was that Councilman Arrowood had moved outside the City. The City Attorney stated that he had not been authorized to make an exhaustive study of the question, but that it was his opinion that, since Councilman Arrowood intends moving back into the City as soon as possible, his temporary residence outside the City does not disqualify him as a Councilman, Following discussion, Councilman Arnold moved that Mr. Arrowood not be on the City Council, which motion failed for lack of a second, Mayor Van Dyke recognized Mr. Shubin who stated that he was the president of the newly incorporated Citizens Committee and asked that the question of Mr. Arrowood's qualifications as a Councilman be settled at this meeting. Upon advioe of the City Attorney, it was moved by Council- man Arnold, seconded by Councilman McCarney and unanimously carried, that the City Attorney is instructed to report in writing as to the qualifications of a Councilman and that a hearing will be held by the Council on December 14, 1959, to determine the qualifica- tions of Councilman Arrowood. It was moved by Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, that, un- less good cause is shown at the time of the hearing, it will be re- quired that all evidence be submitted to the City Clerk's office in affidavit form prior to the Hearing. -.5- November 124 1959 GONZALES CONDITIONAL PERMIT APPLICATION The Deputy City Clerk presented conditional permit application No. C-106 of John and Soledad Gonzales to permit the erection of two stucco frame single-family dwellings in the R-4 zone with less than the required area and in addition to two existing dwell- ings on the building site The Deputy City Clerk then read the recommendations of the Cypress Planning Commission, (At this point, 9.23 o'clock P. M , Councilman Baroldi arrived and took his seat at the Council table.) A Mr. Miller, representing the applicants, presented evidence purporting to show that an easement of 30 feet had been made by property owners abutting on Wicker Drive, an undedicated street. Councilman Arnold questioned the sufficiency of the width of the driveway and suggested that said driveway should be at least ten feet wide, The City Engineer stated that the easements presented did not include the property of the applicants. It was moved by Councilman McCarney, seconded by Councilman Arnold, that the application be granted with the condition that the driveway be made 10 feet wide and that the City Engineer will determine the status of the dedication of the 30 - foot easement for street purposes, Said motion was later rescinded by Councilman Arnold with the permission of Councilman McCarney. It was then moved by Councilman Arnold, seconded by Councilman NcCarney and unanimously carried, that the matter be continued until the question of the 30 -foot easement is settled. MILBOURN CONDITIONAL PERMIT APPLICATION The Deputy City Clerk presented Conditional Permit Application No. C-105 of Gerald M and Violet M. Milbourn to permit the location of a single story, stucco frame, single family dwelling in the A-2 zone on a building site on which one dwelling already exists, The Deputy City Clerk then read the recommendations of the Cypress Planning Commission. Upon motion of Councilman Arnold, seconded by Councilman McCarney and unanimously carried, Conditional Permit -6- November 12, 1959 No C-105 was granted as requested with the condition that appli- cants dedicate for street purposes forty feet (40') from the centerline of Orange Avenue. COUNTY ORDINANCE 916, DISCUSSION Upon motion of Councilman McCarney, seconded by Councilman Baroldi and unanimously carried, this matter was tabled until the next meeting. MI SCFT,LANEOUS A citizen who did not identify himself complained about the resur- facing job being done by the County Road Department on Newman Street The City Engineer was instructed to investigate the com- plaint and report back to the Council. ADJOURNMENT There being no further business to come before the Council, upon motion of Councilman McCarney, seconded by Councilman Arnold and unanimously carried, the meeting was adjourned at 10.20 o'clock P.
