KNOW ALL MEN BY THESE PRESENTS
That we, the undersigned, being all the Councilmen,
by mutual consent and understanding beforehand, hereby consent
to hold a special meeting of the Council of said City at the
Cypress City Hall on the 19 day of F�/ir. , 1960, at the
hour of 6 00 PM of' said day, and we agree that all of' the
acts and proceedings of said meeting shall be as valid as if had
or taken at a meeting duly and regularly called and noticed.
We further waive all notice of the time, place, and
purpose of said meeting, whether required by the laws or other-
wise

MINUTES OF THE MEETING
OF THE CITY COUNCIL OF
THE CITY OF CYPRESS
February 29, 1960
A special meeting of the City Council of the City of Cypress was
called to order by Mayor Var Dyke in the Cypress City Hall 9352
Walker Street, at 6 00 P M
Councilmen present A. E. Arnold, W J. Arrowood, M G t icCarney
and J Van Dyke Councilman T A Baroldi
came in late, during the discussion of the
first item of business
Councilmen absent None
City Officials present. City Clerk Martin Olsthoorn, City Manager -
Deputy City Clerk Burkt-n Weserberg and
City Attorney Rodger Howell
RECALL PETITIONS MARTIN G McCARNEY
The Deputy City Clerk stated that he was hereby submitting to the
Council the recall petitions and validity report of the City Glerk
regarding the recall petitions against Councilman Martin G McCarney
The Deputy City Clerk then read a letter of protest from Mr Howard
Tatro indicating that Mr Tatro felt that the petitions requesting
the recall of Councilman McCarney were actually invalid City
Attorney Rodger Howell explained that he and his workers had
checked all of the petitions against Mr McCarney and that he had
recommended to the City Clerk that the McCarney Recall Petition be
certified valid, whereby Mr Tatrc from the audience, stated that
he felt that the petition was invalid due to the fact that in his
opinion approximately 65 of the signers did not have the words
" City o.'' Cypress" after their address on the various Petition,
sheets He also stated that some of the people were not registered
voters at tre tine of their signing and that some of the petitions
had been altered after the signatures were made in regard to dates.
He also stated that one person printed his name cher than signing
it The City Attorney stated that he would have no objection to
rechecking the McCarney petition or to declaring the petition
invalid Upon motion of Councilman Arrowood, seconded by

Councilman Arnold and unanimously carried, it was ordered by the
City Council that the City Clerk's office, assisted by the City
Attorney/ recheck the McCarney recall petition Councilman Arnold
worried. during the long discussion as to whether or not the adding
of a date after a signer's signature at a later date and by another
individual would effect the validity of that signature. Mr. Howell
stated that there was no clear cut answer to that question, it
would depend upon certain circumstances Mayor Van Dyke asked if
the petition can be deemed invalid at the present moment The
City Attorney indicated in the negative.
RECALL PETITIONS
At this time the City Clerk and Deputy City Clerk subitted to the
City Council the two recall petitions of Walter J Arrowood, one
recall petition against Jake Van Dyke, one recall petition against
Thomas Baroldi and one recall petition against A. E. Arnold On
motion of Councilman Arrowood, seconded. by Councilman Baroldi and
unanimously carried, the recall petitions against Thomas Baroldi,
vdalter J Arrowood, Jake Van Dyke and A E. Arnold were received
and filed by the City Council, and it is hereby duly recorded that
the City Clerk has certified the aforementioned recall petitions
as being invalid.
Mr. Howard Tatro arose from the audience and asked the Council if
he, under State Law, should not receive a second opportunity to
recirculate Councilman Arrowood's recall petition since he had not
been notified at the time of certification by the City Clerk that
both of Mr Arrowood's petitions were invalid The City Attorney
indicated that he would investigate the answer to this question.
THE ELECTION RESOLUTION
The Deputy City Clerk presented Resolution No 105, A RESOLUTION
OF HE CITY COUNCIL OF THE CITY OF CYPRESS. REQ,JESTING TI BOARD
OF SUPERVISORS OF THE COUNTY 0H' ORANGE TO PL,AMIT THE COUNTY CLERK
OF SAID COUNTY TO RENDER SPECIWILD SERVICES TO THE CITY OF CYPRESS
RELATING 20 THE CONDUCT OF A UE_.ERAL MUNICIPAL ELEC'T'ION TO BE HELD
IN SAID CITY ON APRIL 12, 1960 Upon motion of Counci).man.Arnpld,

seconded by Councilman Arrowood and unanimously carried, Resolution
No 105 was adopted Said resolution requested the Orange County
Registrar of Voters to address sample ballot envelopes and insert
election material into the said envelopes
ELECTION RESOLUTION
The Deputy City Clerk presented Resolution No 106 , A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF CYPRESS, CALIFORNIA, ORDERING,
CALLING AND PROVIDING FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD
ON THE 12th DAY OF APRIL, 1960 Upon motion of Councilman Baroldi,
seconded by Councilman Arnold and unanimously carried, Resolution
No. 106 was adopted.
POLICE CHIEF CONFERENCE
Upon motion of Councilman Arnold, seconded by Councilman Arrowood
and unanimously carried, the City Council authorized the Chief of
Police to attend a zone chief's conference at Calexico on Wednesday,
March 2nd, at the request of the Attorney General's office.
PATROLMEN ADDITION
Upon motion of Councilman McCarney, seconded by Councilman Arnold
and unanimously carried, the Police Chief was authorized to hire
an additional patrolman as authorized by the 1959-1960 City of
Cypress Budget.
GEORGE DAKOVICH STREET MAINTENANCE BILLS
The City Manager stated that George Dakovich sewer contractor, and
the City Manager's office had ertered into an agreement whereby
commencing 11/30/59 and until such time as Cox Brothers Construction
Company commenced rebuilding of Miller Street, George Dakovich would
water 'Millar Street and Cerritos Avenue as necessary in order to
settle diort. Said agreement covered watering only However, George
Dekovich has now billed the City of Cypress for blading done on
Miller Street and Cerritos Avenue since the date 11/2b/59. The City
Manager stated that this was not in accordance with the terms of

the agreement and asked the Courcil's ooinion on the matter of
payment of these bills. Council indicated that they would like
to discuss the matter with George Dakovich in person.
ADJOURNMENT
Upon motion of Councilman Arrowood, seconded by Councilman McCErney
and unanimously carried, the Council meeting was adjourned until
the next regular meeting
