1960-05-09MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS May 9, 1960 A regular meeting of the City Council of the City of Cypress was called to order by Mayor Baroldi in the City Hall, 9352 Walker Street, at 7 30 o'clock P. M. The Pledge of Allegiance to the Flag was led by Councilman McCarney. Councilmen present Councilmen absent* W, J. Arrowood, T A. Baroldi, J. J, Dennis M. G. McCarney, and J. Van Dyke None City officials present* City Manager -Deputy City Clerk Wesenberg, City Attorney Howell, and City Engineer Neff VAN ZANDT CONDITIONAL PERMIT LEENDMENT The Deputy City Clerk presented an amendment to conditional permit No, C-117 of William A. Van Zandt and Ivan Worthington to permit the erection of a neon sign advertising the motel to be constructed at 5662 Lincoln Avenue, Cypress. The Deputy City Clerk read the recommendation of the Cypress Planning Commission. Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unani- mously carried, said amendment to conditional permit No„ C-117 was granted as requested, ROYAL MARTEN SIGN VARIANCE The Deputy City Clerk presented sign variance application No. SV -Lk of Royal Marten (property owner) and Eddie Espinola to permit the installation of a sign in front of the business at 5441 Lincoln Avenue in the A-2 zone. The Deputy City Clerk then read the re- commendation of the Cypress Planning Commission. Upon motion of Councilman Van Dyke, seconded by Councilman McCarney and unanimously carried, said sign variance application was approved as requested. TUINHOUT CONDITIONAL PERMIT The Deputy City Clerk presented an application for conditional permit No C-120 of Ale Tuinhout (property owner) and Harvey Hettinga to permit the erection of a retail sales drive-in dairy on the west side of the proposed extension of Miller Street at -1- May 9, 1960 the Cypress -Garden Grove boundary in the A-2 zone. The Deputy City Clerk then read the Cypress Planning Commission's recom- mendation, There followed considerable discussion of the condi- tions recommended by the Planning Commission. Councilman Van Dyke requested that the aforementioned recommendation be re -read by the Deputy City Clerk., Thereupon, the Deputy City Clerk did re -read said recommendation. Following further discussion of the question of the surfacing of the street, it was moved by Council- man Van Dyke, seconded by Councilman Arrowood and unanimously carried, that the matter be tabled for the present and that the City Engineer investigate and report back to the Council on the cost of putting in the street to County Standards, ME C URO CONDITIONAL PERM I T The Deputy City Clerk presented the application for conditional permit No. C-121 of Rosina Faritta Mercuro and Tony T. Mercuro to permit the erection of a building to be used for the purpose of manufacturing snow cones, ice cream and related products in the A-2 zone at 6292 Lincoln Avenue. The Deputy City Clerk then read the recommendation of the Cypress Planning Commission. Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, said conditional permit No. C-121 was granted as requested. KUPPENS VARIANCE APPLICATION The Deputy City Clerk reported that this matter had been held over for further deliberation by the Planning Commission and was, there- fore, not ready for Council action. NOSQUITO ABATEMENT BOARD REPRESENTATIVE Mayor Baroldi appointed Councilman Job J. Denni, Jr., as the City's representative on the Orange County Mosquito Abatement District Board of Trustees. Councilman Denni accepted the appointment, Upon ;notion of Councilman Van Dyke, seconded by Councilman Arrowood and unanimously carried, the Council approved said appointment. -2- May 9, 1960 TUINHOUT EXCLUSION REQUEST The Deputy City Clerk reported that the attorney for Mr. Tuinhout had withdrawn the request. The matter, therefore, was dropped. AGREEMENT, FINANCING MILLER STREET CONSTRUCTION The Deputy City Clerk presented and read an agreement with the County of Orange providing for the mutual financing of the com- pleted Miller Street construction project, Orange to Cerritos. Upon motion of Councilman Van Dyke, seconded by Councilman Arrowood and unanimously carried, the proper City officials were authorized to execute said agreement with the County of Orange. DIP GUTTEH AND WATEK SITUATION, MIUFR STREET There followed considerable discussion of the matter of drainage water from the residential subdivision on the east side of Miller Street in Buena Park crossing Miller Street into the City of Cypress and the problems being created by said water. Following discussion, the City Manager was instructed to contact the City of Buena Park and the subdividers, if possible, to see what can be worked out to re -direct said drainage water. The City Manager is to report back to the Council on his findings, EXTENSION AND WIDENING OF MILLEK STREET, REPORT City Engineer Neff reported on approximate costs and some of the problems of extending and widening Miller Street. There followed considerable discussion of the matter. It was moved by Councilman Arrowood, seconded by Councilman Van Dyke and unanimously carried, that the City Engineer's report be accepted. COUNTY SETBACK REGULATIONS The City Attorney stated that he had not received the necessary information from the County. The matter, therefore, could not be acted upon and was continued until the next meeting. The matter of driveway access to arterial highways from residential subdivi- sions also was continued until the next meeting. -3- May 9, 1960 POLICE CHIEF'S ATTENDANCE AT STATE CONFERENCE The Deputy City Clerk presented a request from Police Chief Hansen for authorization to attend the joint zone meeting of all Chiefs of Police and Sheriffs to be held on May 16, 17, and 18, 1960, in Santa Monica, Upon motion of Councilman Arrowood, seconded by Councilman Denni and unanimously carried, Chief Hansen was authorized to attend said conference, the City to pay all necessary expenses. GARDEN GROVE ANNEXATION OF KNOTT AVENUE The Deputy City Clerk stated that the City had received an inquiry as to whether they would have any objection to having Knott Avenue, south of Katella Avenue and immediately east of the Cityts boundary, annexed by the City of Garden Grove. It was moved by Councilman Van Dyke, seconded by Councilman Arrowood and unanimously carried, that the City has no objection to said annexation of that portion of Knott Avenue by the City of Garden Grove. REGIS T -H OF DEMANDS Upon motion of Councilman Van Dyke, seconded by Councilman McCarney and unanimously carried, the Register of Demands for the month of May was approved as presented. MCCARNEY RECALL PETITION REPORT The City Attorney stated that the report on the status of the re- call petition on Councilman McCarney was ready, but, since the City Clerk was absent and had not signed it, it could not be pre- sented. He stated that the report indicated that the petition was insufficient. TRAFFIC LIGHT STATUS The City Manager reported that he had received information from the Los Angeles office of the State Division of Highways that the State is preparing to install traffic signals at Lincoln and Walker and expects early final approval from Sacramento. He stated that he expected further information in the very near future, -4- May 9, 1960 LETTER OF APPRECIATION It was moved by Councilman Van Dyke, seconded by Councilman Arrowood and unanimously carried, that the City send a letter to former Councilman A. E. Arnold in appreciation of his service to the City curing his four-year term of office The City Manager was directed to write said letter. POLICE CAR PARKING SPACE Mr. Bill Davidson rose from the audience and asked if it would be possible to reserve space in front of the City Hall for police cars only. Upon motion of Councilman Arrowood, seconded by Councilman Van Dyke and unanimously carried, the Council authorized the marking of space in front of the City Hall for police cars only. There followed considerable discussion of the problem of parking space for meetings, etc. The City Manager was instructed to investigate the matter of procuring additional space and report back to the Council. AUDIENCE PARTICIPATION Miss Shirley Gordon asked permission to take a picture of the Councilmen. Permission was granted. At this point (9:10 P. M.) the Mayor declared a recess before the Council went into executive session for the purpose of discussing personnel matters. EXECUTIVE SESSION At 9 30 P. M. Mayor Baroldi reconvened the regular session of the Council meeting. Upon motion of Councilman Arrowood, seconded by Councilman Van Dyke and unanimously carried, the Council authorized the City Manager to request the resignation of City Engineer Neff by May 20, 1960. Upon motion of Councilman Van Dyke, seconded by Councilman Denni and unanimously carried, the Council instructed the City Manager to advertise for the position of Building Department and Planning Director for the City of Cypress. -5- May 9, 1960 ADJOURNMENT There being no further business to come before the Council, upon motion of Councilman Van Dyke, seconded by Councilman Arrowood and unanimously carried, the meeting was adjourned at 10 15 o'clock P.
