1956-10-08MINUTES OF REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DAIRY CITY October 8, 1956 Council met in regular session at 7 30 P M at the City Hall, 9352 Walker Street, Dairy City, California Meeting called to order by Mayor Van Dyke COUNCILMiEN PRESENT Vice -Mayor Arnold, Arrowood, Baroldi, Van leeuwen, and Mayor Van Dyke COUNCILMEN ABSENT None City officials present. City Manager -Deputy City Clerk Wesenberg, City Clerk Olsthoorn, Deputy City Attorney Harmon, (dity Treasurer Leal and Ray Mercado of the City Engineer's staff Minutes of the last meeting were read by Deputy Clerk Wesenberg, and, upon motion by Councilman baroldi, seconded by Councilman Van Leeuwen, and unanimously carried, they were approved as read USE OF E wU IP?VIENT The Deputy Clerk said that the areement was not completely written and, therefore not ready for discussion Councilman Baroldi sug- gested that the agreement contain a one-year time limit clause so that the agreement could be renewed or not, as desired PETITIONS POR NAME CHANGE The Deputy Clerk brought up the matter of the petitions for the changing of the name of the city Vice -Mayor Arnold stated that petitions must be an action on the part of the people themselves, and, only after the necessary signatures had been obtained, could the Council take action, and suggested that the distribution of the peti- tions be handled through the Citizens' Advisory Committee Deputy City Attorney Harmon suggested that the political organizations might be of assistance in getting the signatures on the petitions ARNOLD ANNEXATION- Mr NNEXATION Mr Mercado of the City Engineer's staff, reported on the Boundary Commission's rejection of the proposed annexation on the grounds that an island of County territory was created, and presented the Boundary Commission's solution to the problem After much discussion, it was -1- October 8, 1956 moved by Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, that the city re -submit Annexation No 1 to the Boundary Commission with the addition of the remainder of Parcel 41 and the Engineer's office re -draw the map and add the legal descrip- tion for the remainder of Parcel 41, in addition to the White property on calker Street SALES TAX ORDINANCE Deputy Clerk Wesenberg gave the first reading of Ordinance No 8 by title, as follows "AN ORDINANCE OF THE CITY OF DAIRY CITY, IMPOSING A CITY SALES AND USE TAX, PROVIDING r+'O.ri THE PERFORMANCE BY THD STATE BOARD OF EQUALIZATION OF ALL FUNCTIONS INCIDENT TO THE ADi•INISTRATIJN, OPERATION AND COLLECTION OF THE SALES AND USE TAY HEREBY IMPOSED, AND PPOVIDING PENALTIES FOR VIOLATIONS THEREOF " It was moved by Councilman Arrowood, seconded by Councilman Van Leeuwen, and unani- mously carried that the ordinance be read by title only REGISTER OF D Ei SANDS Deputy Clerk Wesenberg read the checks to be paid, the amounts, and the purpose After discussion, upon motion by Councilman Baroldi, seconded by Councilman A-rrowood and unanimously carried, the Register of Demands, for the period of Au-:ust 1 to October 31 1956, was approved There followed a discussion of whether the gardener was included in the compensation insurance carried by the city Upon motion by Vice-,qayor Arnold, seconded by Councilman Arrowood, and unanimously carried, the City Manager was instructed to investigate the matter of compensation insurance for the gardener ANNEXATION FEES The City i;ana er discussed the schedule of annexati3n fees set up by the City of Pasadena Under such aschedule the city would set up -2- October 8, 1956 chanes to be assessed against the properties included in each annexa- tion, and these charges would be added to the next tax statements It was pointed out that the charges would be based on the cost of legal work involved in annexation, plus the cost of extending services to the area Upon motion of Councilman Arrowood seconded by Councilman Baroldi, and unanimously carried, the City Attorney, City Manager, and the Citizens' Advisory Committee were instructed to review the question and propose recommendations ANTI -LITTER 0_iDINANCE Deputy Clerk Wesenberg gave first reading to Ordinance No 9 Upon motion of Councilman Baroldi, seconded by Councilman Van Leeuwen, and unanimously carried the Ordinance was read by title orlly as follows. "AN 01DINANCE OF THE CITY OF DAIRY CITY PROHIBITING THE TH:OWING OF WASTE IN THE STHELTS AND THE SWEEPING OF SIDEWALK ThASH INTO THE GUTTERS " Durint the ensuing discussion, the question of deputizing Dairy City citizens was brought up It was stated that the County Board of Supervisors would look with a great deal of dis`'avor upon such a proceeding, and that the County Sheriff's Office would undoubtedly withdraw all protection presently provided In that case, it would then be necessary for the City to organize its own police force BUSINESS LICENSE ORDINANCE Deputy Clerk Wesenberg read the title of Ordinance No 7, as follows "AN ORDINANCE OF THE CITY OF DAIRY CITY, STATE OF CALIFORNIA, ESTAB- LISHING REGULATIONS FOR THE LICENSING OF BUSINESSES IN THE CITY OF DAIRY CITY " The following changes or additions were agreed upon 1 Feed Lots Add (b) 301 to 550 Head of Cattle $100.00 551 to 1,000 Head of Cattle 150 00 1,001 Head of Cattle or more 200 00 Poultry Producers - Chickens Add section headings (a) Laying Hens and (b) Meat Birds, with the proposed schedule applying to each sub -section 8 Farming Add* 26 to 50 Acres of Row Crops 50 00 October 8, 1956 -3- 8 raining Add (Continued) 50 to 100 Acres of How Crops 101 Acres of Row Crops or more 75 00 100 00 Add a section for oil well drillers at 50 00 Change Manufacturing or Processing to 25.00 Change to "Each Other Business" Insert (in Section 35) the words "manufacturinor processing It was moved by Councilman Arrowood, seconded by Councilman Baroldi, and unanimously carried, that the Council adopt the City Business License Ordinance by reading the title only It was moved by Vice - Mayor Arnold, seconded by Councilman Baroldi, and unanimously carried, that the Council adopt the Business License Ordinance with the addi- tions and changes agreed upon, as an emergency ordinance poll call AYES Arnold, Arrowood, Baroldi, Van Dyke Van Leeuwen NOES• None ABSENT None MISCELLANEOUS BUSINESS City Manager Wesenberg then brought up a list of items which are needed for the efficient operation of the City Hall The list in- cluded a fire -proof safe, blinds for the office windows, heatin» facilities janitorial service, and painting After some discussion, it was moved by Councilman Arrowood, seconded by Councilman Van Leeuwen, and unanimously carried, that the City Manager procure the above -listed items for the City Mr Krosen, a member of the press, asked that the press be informed 24 hours in advance of all special meetings of the City Council Councilman Baroldi reported that the City Seal will be ready in a few days ADJOUHNMENT Upon motion by Councilman Arrowood, seconded by Councilman Baroldi, and unanimously carried the meeting was adjourned until October 29, 1956, at 7 30 P , in the City Hall. j GLS' v l2 lfy'-'-- - qa0ob Van Dyke, 7ayoz of the D1 ty of Dairy City, California October 8, 1956 -4- ATTEST farin lsthoorn, Cit, Clerk of the City of Dairy City Burton Wesenberg, Deputy City Clerk of the City of Dairy City October 8, 1956 -5-
