1957-02-11MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF DAIRY CITY February 11, 1957 A regular meeting of the City Council of the City of Dairy City was called to order in the Council Chambers of the City Council at 9352 Walker Street, in the City of DE:iry City, at the hour of 7 30 o'clock P M , on the 11th day of February, 1957, with Mayor Van Dyke presiding Councilmen present. A. E Arnold, W J Arrowood, T r. Baroldi, Jacob Van Leeuwen, Jr , and Jacob Van Dyke Councilmen absent None City officials present City Clerk Olsthoorn, City Attorney Howell, Deputy City Attorney Harmon, City Engineer Neff, and City Manager -Deputy City Clerk Wesenberg Minutes of the last meeting were read by Deputy Clerk wesenberg Upon motion by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, the Minutes were approved as read SOUTHERN CALIFORNIA EDISON COMPANY ELECTRIC FRANCHISE A proposed ordinance numbered and entitled. "ORDINANCE NO 12 AN ORDINANCE GRANTING TO SOUTHERN CALIFORNIA EDISON COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO USE AND TO CONSTRUCT AND USE, FOd TRANSMITTING AND DISTRIBUTING ELECTRI- CITY FOR ANY AND ALL PURPOSES, POLES, WIRES, CONDUITS AND APPUR- TENANCES, INCLUDING COMMUNICATION CIRCUITS NECESSARY OR PROPER THEREFOR, IN, ALONG, ACROSS, UPON, OVER AND UNDER THE PUBLIC STREETS, WAYS ALLEYS AND PLACES WITHIN THE CITY OF DAIRY CITY " was presented for its second reading After the reading of the title of said ordinance, it was ,r;oved by Councilman Van Leeuwen, seconded by Councilman Baroldi, and unanimously carried, that the further reading of said ordinance be waived Thereupon it was moved by Councilman Arnold seconded by Councilman Arrowood, that said ordinance be passed and adopted, which motion was carried by the following roll call vote AYES Councilmen Arnold, Arrowood, Baroldi, Van Leeuwen, and Van Dyke NOES None ABSENT None The City Clerk announced that Southern California Edison Company, -1- ebruary 11, 1957 -57 in compliance with Section 6 of Ordinance No 12, had filed an original executed Franchise Bond running in favor of the City of Dairy City, in which bond Southern California Edison Company is named as principal and Pacific Indemnity Company is named as surety The City Attorney announced that said bond had been approved by him as to form. A resolution, numbered and entitled. "RESOLUTION NO 14 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DAIRY CITY, CALIFOriNIA, APPROVING A FRANCHISE BOND FILED BY SOUTHERN CALIFORNIA EDISON COMPANY, A CORPORATION," was presented and read It was moved by Councilman Arrowood, seconded by Councilman Arnold, that said resolution be adopted, which motion was carried by the following roll call vote AYES Councilmen Arnold, Arrowood, Baroldi, Van Leeuwen, and Van Dyke NOES None ABSENT None ARNOLD ANNEXATION Upon motion of Councilman Baroldi, seconded by Councilman Arrowood, and unanimously carried the Council resolved that, the Boundary Commission having approved the boundaries of the annexation, known as "Annexation No. 1,' the Council initiate proceedings to annex the territory in the said annexation This is riesolution No 15 RF,GISTER OF DEMANDS City Manager Wesenberg read the list of checks, to whom paid and their purpose, to be paid from the (Jeneral Fund except No 170, which is to be paid from the In Lieu r'und Councilman Van Leeuwen moved, seconded by Councilman Baroldi, and unanimously carried that the Council accept the Register of Demands. GAS TAX AGRE; M?ENT Councilman Baroldi moved, seconded by Councilman Arrowood, and unanimously carried, that the Council resolved, by Resolution No 13, to adopt the budget and approve the Memorandum of Agreement -2- February 11, 1957 for expenditure of Gas Tax Allocation for major city streets, as presented by the State Division of Highways FINANCIAL REPORT The City Manager reported that, for the month of January, 1957 the revenues were 41,011 25, the expenditures were 4485 05, and the bank balance was 41,588.29 He reported that, since the end of January the City had received funds amounting to approxi- mately 0300.00 DELINQUENT LICENSE REPORT The City Manager reported that, with the exception of one dairy- man, one poultryman, and three small businesses, all the business license fees had been collected He also reported that the City had realized approximately 46 400 00 from these business licenses BILL BOARDS After much discussion of the problem of subdividers' directional signs, City Attorney Howell suggested that the City write a let- ter to Mr Nelson of the County Building Department, asking that the County of Orange not authorize any directional signs within the city without first contacting the city LINCOLN AVENUE CENTER STRIP There followed much discussion of the various facets of the prob- lem of what type of divider should be used along Lincoln Avenue Mayor Van Dyke introduced Senator Murdy of the California State Legislature, who gave his opinion of the problem He advised that the city contact Cox Brothers, the construction firm to whom the contract for improving Lincoln Avenue has been let, and the State Highway Commission in Sacramento with regard to the city's wishes and recommendations in this natter Council- man Arrowood moved, seconded by Councilman Van Leeuwen, and unanimously carried, that the mayor appoint a committee of three Councilmen to investigate the proposed improvements to Lincoln -3- February 11, 1957 -58 Avenue, that said committee may represent the Council with res- pect to such matters whenever said committee is in unanimous agreement, if said committee is not unanimously agreed then it is to report back to the Council at the next meeting thereof The Mayor then appointed Councilmen Arnold, Arrowood and Van Leeuwen as the committee of three MEDICAL DIRECTOR, CIVIL DEFENSE Councilman Baroldi moved, seconded by Councilman Arrowood and unanimously carried, that the City Manager be authorized to ap- point a Medical Director for the City's Civil Defense organiza- tion. OOSTEN ANNEXATION Or1DINANCE ADOPTION A proposed ordinance, No 16, entitled, "AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED 'OOSTEN ANNEXATION' TO THE CITY OF DAIRY CITY," was presented for second reading After the reading of the title of said ordinance it was moved by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, that further reading of said ordinance be waived Thereupon it was moved by Councilman Arnold, seconded by Councilman Baroldi that said ordinance be adopted, which motion was carried by the following. roll call vote AYES. Councilmen Arnold, Arrowood, Baroldi, Van Leeuwen, and Van Dyke NOES None ABSENT. None UNEMPLOYMENT DISABILITY INSURANCE The City Attorney having indicated that it would be wise for the city to insure its employees with the State Compensation Fund Councilman Arnold moved, and Councilman Arrowood seconded, that an agreement with the State of California so to do be adopted Eotion was unanimously carried February 11, 1957 HEART ASSOCIATION The City Manager presented a request by the Heart Association for permission to canvass the city in a campaign to raise funds. The Council expressed no objections to such a canvass by the Heart Association AMENDMENT TO LAND USE ORDINANCE There followed discussion on the number of cows per acre that should be allowed in the city It was brought out that the pre- sent land use ordinance limits the number of cows Der acre to ten (10) but that dairymen holding non -conforming use permits dating prior to 1953 were not bound by the present ordinance Councilman Ven Leeuwen moved, seconded by Councilman Baroldi, and unanimously carried, that the Council instruct the City Officers to pex'pare an ordinance, amending the Land Use Ordi- nance, No 2, to increase the number of cows per acre to twenty- five (25) VARIANCES There was presented for the Council's action a request by A U Garcia for a permit to enlarge his storage building at his Los Alamitos Fertilizer Company plant. This request for a variance permit was approved by the Planning Department and by the Plan- ning Commission for Orange County It was referred to the Council by the Citizens' Advisory Committee without recommendation Councilman Arnold moved, seconded by Councilman Arrowood, and unanimously carried, that this variance be approved There was presented a second request by A 0 arcia for a permit to erect a directional advertising sign on the corner of Bloom- field and Ball Road to point the direction of his fertilizer plant This variance request was approved by the Orange County Planning commission and the Planning Department in Santa Ana -5- February 11, 1957 The Citizens' Advisory Committee recommended that this variance be granted, and that it run concurrently with the variance for the fertilizer plant Councilman Baroldi moved, seconded by Councilman Van Leeuwen, and unanimously carried, that this variance permit be approved. F Ii E WOI KS STAND There was presented a request by the VFW to have an exclusive fire works permit for a fire works stand at the corner of Sloom- field and Lincoln Avenues It was the recommendation of the Citizens' Advisory Committee that no exclusive permits be granted in the City The Council, agreeing with this recommendation, declined to grant the VFW's request CENSUS Councilman Baroldi moved, seconded by Councilman Van Leewuen, and unanimously carried, that the Council authorize the City Manager to send a check for 065 00 to the Bureau of the Census to cover costs of the special census to be taken in Dairy City VAUGHN AND ASSOCIATES BOND AND INSURANCE The City Attorney havinc; determined that the bond and insurance presented, cov3ring the oil well drilling operation on the Harada property, were not acceptable, Councilman r3aroldi moved, seconded by Councilman Arnold, and unanimously carried, that no action be taken until the City Attorney and City Manager have contacted Vaughn and Associates CITY ENGINEER'S REPORT ON SEWER SITUATION The City Engineer gave a comprehemsive report of the present overall sewer situation in western Orange County, and the future plans for improving dispos&.l in this area MISCELLANEOUS There came before the Council a rir.
