An adjourned regular meeting of the City council of the City of
Dairy City was called to order in the Council Chambers of the
City Council at 9352 Walker ;Street, in the City of Dairy City,
at the hour of 7 30 o'clock P M , on the 21st day ofkiarch,
1957, with Mayor Van Dyke presiding.

Councilman Van Leeuwen moved to dispense with the reading of
the minutes of the previous meeting. Councilman Arrowood
seconded the motion, and it was unanimously carried
LAND USE ORDINACE
AMENDMENT
A proposed ordinance, numbered and entitled

Madison The application was approved by the Orange County
Planning Commission and the Plannin,. Department, with conditions

The Citizens' Advisory Committee recommended that the variance
be granted with the following conditions that the owner of the
property dedicate an easement of 40 feet from the centerline on
Orange Avenue; that there be no burning, that there be no piling
of material above the fence, that the area be enclosed by a solid
8 -foot fence of new sheet metal material, that the fence be located
not less than 30 feet from the new right-of-way line on Orange
Avenue and the same distance on Moody Street, that there be no
wrecked vehicles outside the fence, that there be one entrance
on Orange Avenue; that applicants be allowed to place two 4 -foot
by 10 -foot signs at the fence line on the corner of Orange and
Moody Councilman Arrowood moved that the council approve the
variance for a three-year term under the conditions recommended
by the Citizens' Advisory Committee The motion was seconded
by Councilman Van Leeuwen and unanimously carried
FIREWORKS OaDINANCE
Discussion on the matter of an ordinance to control the sale of
`'fireworks in the City was postponed until the next meeting
LINCOLN AVENUE
DIVIDER STRIP QUESTION
After much discussion regarding lines of authority in the City,
which were brou-ht out in relation to communications with the
State on the divider strip on Lincoln Avenue, Councilman Arrowood
moved, seconded by Councilman Van Leeuwen, and unanimously car-
ried, that all actions of the City must go through the City
Manager, and that a Council can act only as a body
SECRETARY'S SALARY
After considerable discussion upon motion of Councilman Van
Leeuwen, seconded by Councilman Arrowood, and unanimously carried,
the Council authorized a 450 00 a month increase in salary for
the secretary to the City Manager, with an additional one hour
and one-quarter per day added to the secretary's work schedule

Also authorized were seven holidays for the secretary per year,
which include the major holidays customarily taken by city em-
ployees, and two weeks paid vacation per year, provided that the
vacation is taken at times when it will not interfere with the
City's work load
NAME CHANGE PETITIONS
Councilman Arnold moved, seconded by Councilman iaroldi, and
unanimously carried, that the petitions be sent to the County
Clerk for checking of names
TRAFFIC ENFORCEMENT
LEGISSLATION
After explanation by the City Manager, Councilman Arnold moved,
seconded by Councilman Arrowood, and unanimously carried, that
the City Council endorse passage, by the California State Legis-
lature, of Bill AB4036 allowing for cities to contract with the
Highway Patrol or the Sheriff's Department for traffic law
enforcement.
PAT3OLMAN QUESTION
The City Manager stated that it had come to his attention that
Mr Hoy E Seymour had been made a deputy police officer in
Dairy City in October, 1956, by the City's Police Chief, dialph
E Ellsworth During. the ensuing discussion of the matter it
was brought out that all department heads, including; the police
chief were under the City Manager and that they would receive
orders from him If the police chief receives no orders from
the City Manager, he does nothing It was the City Attorney's
opinion that the City Council would be wise to instruct the po-
lice chief to revoke the deputization of Mr Seymour, since the
County Board of Supervisors have a particularly strong feeling
on this subject Councilman Arrowood moved, seconded by council-
man Baroldi, and unanimously carried, that the City Manager and
the City Attorney see 14r Ellsworth and get the deputization re-
voked according to legal channels

and unanimously carried, that the meeting be adjourned until
