1957-04-08MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF DAIRY CITY April 8, 1957 A regular meeting of the City Council of the City of Dairy City was called to order in the Council Chambers of the City Council at 9352 Walker Street, in the City of Dairy City, at the hour of 7 30 o'clock P M , on the 8th day of April, 1957, with Mayor Van Dyke presiding. Van Leeuwen, Jr. Councilmen absent* None City officials present City Clerk Olsthoorn, City Manager - Deputy Clerk Wesenberg, City Engineer Neff, and Deputy City Attorney Harmon Minutes of the adjourned regular meeting of March 25, 1957, were read by the Deputy Clerk It was moved by Councilman Arnold, seconded by Councilman Van Leeuwen, and unanimously carried, that the minutes be approved as read Minutes of the adjourned regular meeting of March 21, 1957, were read by the Deputy Clerk It was loved by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, that the minutes be approved as read REGISTER OF DEMANDS The City Manager read the list of checks, to whom paid and their purpose, to be paid from the General Fund. It was moved by Councilman Arnold, seconded by Councilman nrrowood, and unani- mously carried, that the Register of Demands be approved. CITY MANAGER OtRDINANCE Mr Arrowood introduced the ordinance relating to the powers and duties of the City Manager and moved that the ordinance be adopted The Deputy Clerk read the proposed ordinance, entitled "AN ORDINANCE OF THE CITY OF DAIRY CITY CREATING AND ESTABLISHING A CITY MANAGER FORM OF GOVERNMENT FOR SAID CITY AND DEFINING THE AUTHORITY, POWER AND DUTIES OF THE CITY MANAGER " and further consideration was deferred until the next regular meeting, as required by law SPECIAL CENSUS FUNDS Following explanation by the City Manager, Councilman Baroldi moved that the Council authorize the City Manager to reimburse the Federal Supervisor of the Census for miscellaneous expenses -1- April 8, 1957 up to $175 00 Motion was seconded by Councilman Arrowood and unanimously carried REPLACEMENT OF STOLEN PROPERTY Councilman Arnold brought up the subject of the Stenorette, be- longing to the City Manager, which was stolen from the City Hall during the night of April 2 Since this piece of equipment had been used by the City Manager in the City's service, it was sug- gested that the City pay for another machine to be given to the City Manager to replace the one which was stolen Councilman Arnold moved that the City replace this Stenorette for the City Manager. Motion was seconded by Councilman Arrowood and unani- mously carried FIREWORKS ORDINANCE AMENDMENT There appeared before the Council a Mr and Mrs. Holloway, a Mrs Beth Lancaster, and a representative of the Clipper Fire- works Company. There followed considerable discussion on the matter of the placement of fireworks stands in order to insure sufficient space between them. The matter was finally referred to the City Attorney, who was to write an amendment to the Fireworks Ordinance, to be brought up at a special meeting. AUTHORITY RESOLUTION Thereafter, Councilman Arrowood introduced a resolution to re- affirm that the City's business is to be conducted by no one other than the Mayor or the City Manager, and Councilman Van Leeuwen moved its adoption Councilman Baroldi seconded the motion Thereafter, the resolution was discussed. Councilman Arrowood moved that the motion for the adoption of the resolution be amended to become a motion to amend the ordinance relating to the duties of the City Manager The motion to amend the motion was seconded by Councilman Baroldi. After discussion, the motion to amend the motion was unanimously carried. After further dis- cussion on the motion, as amended, a vote was taken, and the -2- April 8, 1957 motion was unanimously carried, amending the ordinance relating to the duties of the City Manager As amended, the proposed City Manager Ordinance provides that the City's business shall be conducted only by the Mayor or the City Manager ARNOLD ANNEXATION HEARING The Deputy Clerk stated that this was the time and date set for hearing protests to the proposed annexation. He further stated that the City Clerk had received no written protests to this annexation and asked for comments from the floor There being none, Councilman Baroldi introduced an ordinance approving the annexation, known as the Annexation No 1, entitled, "AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIG- NATED 'ANNEXATION NO. 1', TO THE CITY OF DAIRY CITY " After the reading of the title of said ordinance, it was moved by Councilman Baroldi, seconded by Councilman Van Leeuwen, and unanimously carried, that further reading of the ordinance be waived and that said ordinance be passed to its second reading. PURCHASE OF CIVIL DEFENSE RADI0 The City ManaaTer reported that the County Civil Defense organiza- tion has made available a radio unit of the Civil Defense network, to be bought and installed in the Dairy City City Hall, which is to be utilized as headquarters for Civil Defense activities in this area The proposal is for the cities of Dairyland and Dairy City to purchase this piece of equipment jointly The cost to each city would be about $300 00 It was inoved by Councilman Arrowood, seconded by Councilman Baroldi, and unanimously carried, that the City would allocate $300.00 toward the purchase of this Civil Defense radio equipment, to be owned jointly with the City of Dairyland ENDORSEMENT OF BILL The City Manager stated that the California State Legislature had pending Bill AB -2557, giving newly -incorporated cities the -3- April 8, 1957 riht to two years' free services from the County After dis- cussion, it was moved by Councilman Arrowood, seconded by Council- man Van Leeuwen, and unanimously carried, that the City Council endorse this bill and urge its passage. WEED ABATEMENT CONTRACT The City Manager presented a contract submitted by the County, providing that the County would handle the weed abatement problem as formerly, with the exception that the City Council would pass on the list of landowners submitted by the County who were to be taxed for weed abatement done on their property by the County It was moved by Councilman Baroldi, seconded by Councilman Arnold, and unanimously carried, that the Mayor and the City Clerk be authorized to sign the agreement for weed abatement as proposed by the County of Orange EQUESTRIAN CROSSING Following discussion, it was moved by Councilman Van Leeuwen, seconded by Councilman Arrowood, and unanimously carried, that the City send a letter to the County, approving an equestrian crossing at the intersection of. Bloomfield Avenue and Ball Road. MISCELLANEOUS Mayor Van Dyke brought up for discussion the question of whether property owners should be reimbursed for land dedicated for street easements in connection with the granting of variances Councilman Arnold explained that the County feels that the property owner, in asking for a variance, is asking for a favor and should be willing to do a favor in return. The City Engineer stated that the practice was, in effect, using a club to obtain land for street easement which might otherwise be difficult to obtain, but that it is more to the point to get the set -back lines, regardless of whether a dedication is obtained. Councilmen Van Leeuwen, Arrowood, and Van Dyke were of the opinion that the practice is unfair and that the land owner should be paid for the April 8, 1957 land so dedicated. ADJOURNMENT There being no further business, the meeting was duly adjourned until Tuesday, April 16, 1957, at 10.00 A. M., at the City Hall.
