1957-04-16MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF DAIRY CITY April 16, 1957 An adjourned regular meeting of the City Council of the City of Dairy City was called to order in the Council Chambers of the City Council at 9352 Wacker Street, in the City of Dairy City, at the hour of 10 00 o'clock A M , on the 16th day of April, 1957, with Mayor Van Dyke presiding. Councilmen present* Arrowood, Arnold, Baroldi, and Van Dyke Councilman absent Van Leeuwen City officials present* Deputy City Attorney Harmon and City Manager -Deputy City Clerk Wesenberg It was duly agreed to dispense with the reading of the minutes of the last previous meeting FIREWORKS STANDS REGULATIONS The Deputy City Attorney presented and read an amendment to the Fireworks Ordinance, which required that all stands would have at least 90 feet distance between them, and limited the number of stands to three to be erected in an area of 1,500 feet along any street or streets Councilman Arnold moved that this amend- ment to the Fireworks Ordinance be approved Motion was seconded by Councilman Arrowood. There were present six visitors, five of whom had requested permits to operate fireworks stands in the City These five were. Mr John Holloway, Mrs Beth Lancaster, i•irs. Lottie McFann, Mr Vernon Snell, and Mr Keith Matthews The sixth visitor was Mr Peter Van kuiten, owner of the land involved in these requests The Mayor called on each of the visitors in turn for an expression of his opinion in this matter. Mr. Snell and i°ir Matthews were in agreement that four stands could operate safely and profitably on Mr Van Ruiten's property along Lincoln Avenue just east of Bloomfield Avenue. Mrs Lancaster and Mr Holloway disagreed They felt that there should be no more than three stands in this area because there would not be enough business for four and that so many stands would create a traffic -1- April 16, 1957 problem Mrs McFann did not speak. Mr Snell stated that traffic could be handled in such a way as to cause no difficulty, and presented a diagram showing how four stands could be placed in such a way as to preserve the 90 -foot distance between them and comply with all other requirements of the City Fir Van 'luiten stated that he felt that this was a better location and would cause less traffic congestion than was caused by the locations occupied last year. He stated that he felt that, since there is water and ample space to handle the parking problem, and since it seemed feasible to put in four stands, he could see no reason why four stands could not go in He further stated that he felt that Mrs Lancaster was trying to keep out competition and that he was not in favor of that, because it was unfair After much discussion, the motion and second were withdrawn. Councilman Arnold then moved, seconded by Councilman Arrowood, and unanimously carried, that the ordinance would be amended with the following provisions' 1 All fireworks stands will be at least 90 feet apart; 2. There will be no more than four stands within any 750 -foot area, 3 There will be no smoking within 50 feet of any stand, 4. No fireworks will be discharged within a distance of 100 feet of any stand, 5 No smoking signs with red letters six inches high will be placed six feet above the ground every ten feet along the stand, 6 Applicant's written application will state just exactly where the stand will be placed, plus or minus one foot, and/or give the address, 7 Applicant's written application will bear the sig- nature of the recorded owner of the land where the stand is to be located, 8 Each applicant will deposit, along with his applica- tion, with the City Manager a certificate showing that he has public liability insurance of '100,000/ 300,000 and property damage insurance of 45,000/ 25,000; 9 Applications for licenses may not be made before April 1 nor later than June 15, -2- April 16, 1957 10 Stands will not be over 50 feet in length, 11 Fireworks may be sold from June 28 through July 4th, or July 5th in years when the Fourth falls on Sunday The City Manager stated that these requirements would be enforced by means of revoking the license of any offender GAS TAX MONEY The City Manager explained a plan, proposed by the Orange County League of Cities to the County Board of Supervisors, whereby the County would share with the cities within the County a portion of the gas tax monies received by the County from the State After discussion, it was moved by Councilman Arnold, seconded by Coun- cilman Arrowood, and unanimously carried, that the City Manager be authorized to send a letter to the County Board of Supervisors, endorsing the plan proposed by the League of Cities ADJ0URNMENT There being no further business, the meeting was duly adjourned until the next regular meeting.
