Minutes 77-08-13MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COUNCIL HELD August 13, 1977 The adjourned regular meeting of the Cypress City Council was called to order at 10:10 a.m. on Saturday, August 13, 1977 at the Cypress Community Center, 5700 Orange Avenue, Cypress, California, Mayor Donald Hudson presiding. PRESENT: ABSENT: Councilmen Lacayo, MacLain and Hudson Councilwoman Sonju Mayor Hudson called an Executive Session at 10:11 a.m. for matters of litigation. Chairman Robert Simmons called the adjourned regular the Recreation and Park Commission to order at 10:20 the following Commissioners present: meeting of a.m. with PRESENT: ABSENT: Commissioners Boykin, Hamilton, Swain and Simmons Commissioners Christensen, McHugh and Yates COUNCILWOMAN SONJU ARRIVED AT 10:35 a.m. Vice Chairman Don Galloway announced the Arts and Cultural Commission meeting could not be called to order because of the lack of a quorum. The following Commissioners were present: PRESENT: ABSENT: Commissioners Livingston, Nelson and Galloway Commissioners Hawkins, Levy, Lindamood and Schlaich Mayor Hudson called the City Council meeting back to order at 10:45 a.m. with all Council members present. The Recreation and Park Director transmitted a memorandum out- lining five agenda items suggested by the Recreation and Park Commission and stated the Arts and Cultural Commission would like to discuss the use of Landell School for arts and cultural purposes. Vice Chairman Galloway reported the Commission was interested in acquiring a facility in the City for arts and cultural acti- vities and specifically was interested in using Landell School if it becomes available. He indicated the Commission did not want to spend considerable time investigating this possibility if there was no support from the Council or if a use had already been determined for Landell School. Commissioner Swain recommended that the Commission write and advise the School Board of their interest and proposed use of the building and stated the Board is receptive to alternative The Council expressed general support for an arts and cultural facility and asked that the Commission provide information on the scope of their programs and activities, costs and funding sources. Commissioner Galloway indicated the Commission will undertake the report with recommendations for the use of Landell School or other facilities which may be available. 273 City Council Minutes August 13, 1977 CONSIDERATION OF NON-PROFIT ORGANIZATIONS--CHARITABLE: The Council held discussion regarding a resolution adopted by the Recreation and Park Commission relating to fees charged organi- zations for use of the Community Center. The Commission recom- mended changes to the set-up and take-down fee which is based on actual District costs for all users and recommended that the special fee for fund-raising events be eliminated for all groups having a majority of members as residents of the Recreation and Park District. It was moved by Councilman Lacayo, seconded by Councilwoman Sonju and unanimously carried to support the resolution, to be effective September 1, 1977, with the deletion of the words "Whereas, sitting in judgment over which group should have fees waived and which group should not have fees waived is not the proper province of an advisory commission such as the Cypress Recreation and Park Commission". RECESS: Mayor Hudson recessed the meeting at 12:40 p.m. The meeting was called back to order at 1:20 p.m. with Councilman Lacayo absent. CONSIDERATION OF TENNIS COURT COMPLEX AT ARNOLD/CYPRESS PARK: The Recreation and Park Director reported that he transmitted a report on potential tennis court locations and funding sources. He reported he and Councilwomen MacLain and Sonju reviewed the agreement with the Anaheim Union High School District. The agreement states that if the District lights the courts at Oxford and Lexington Jr. High Schools the School District will upgrade their surface to the satisfaction of both parties. He recommended a concrete and acrylic surface. He reported that he will meet next week with the School District to discuss the resurfacing and will also meet with Cypress College to discuss the possibility of lighting several courts there. He also indi- cated that the development of four or five courts and a pro shop at Arnold/Cypress Park has been reviewed as an alternative. Councilwoman MacLain supported lighting the courts at the junior high schools if the surface is concrete. Councilwoman Sonju stated she favored completing the park bond project commitments. She suggested adding Commissioner Swain to the committee meeting with the School Board. Councilwoman MacLain felt the contract should stipulate that the School District will maintain the courts and state what flexibility the City will have to use them. Councilwoman Sonju suggested courts at Oak Knoll Park because they would be centrally located. Mayor Hudson suggested that the Elementary School District be contacted regarding the possi- bility of courts on their property and he suggested the Civic Center site and properties elsewhere in the City as alternate sites. Councilwoman Sonju objected to courts at the Civic Center site or on City-owned property. COUNCILMAN LACAYO RETURNED AT 1:45 P.M. Commissioner Simmons suggested the development of private courts which, after a 20 year lease, could be owned by the City. Councilman Lacayo stated he opposed courts at Cypress Park since it is outside of the City. Councilwoman Sonju recommended that a survey be made to determine whether residents want courts at the two junior high schools. It was moved by Councilwoman Sonju, seconded by Councilwoman MacLain and unanimously carried to support lighting the courts at Cypress College with provisions in the agreement regarding maintenance and hours of use. -2- City Council Minutes August 13, 1977 Councilwoman MacLain requested that the Recreation and Park Director contact the Cypress School District to discuss the possibility of tennis courts at Morris School. The Recreation and for State Bond Act 15, 1977. Park Director reported that the funding must be submitted prior application to September Councilwoman Sonju moved to submit the application for tennis courts at Oak Knoll Park. The motion was not seconded. Councilwoman MacLain suggested that the application could be for Cypress Park and the location could be changed later. It was moved by Mayor Hudson, seconded by Councilman Lacayo and carried, with Councilwoman Sonju voting no, to submit the applica- tion for tennis courts to be located on the Civic Center site across from the Police Department. CONSIDERATION OF SPONSORSHIP OF ORGANIZATIONS: Commissioner Simmons reported there have been recent problems and complaints from organizations sponsored by the District which have outgrown guidance from the District. He suggested that such sizable groups be placed in a different classification. The Council was in agreement that sponsorship should be defined as to what it entails: what privileges are granted under it and what is the City's legal position. Councilman Lacayo suggested that the District continue sponsorship but that the District set guidelines and make recommendations as to under what criteria sponsorship ends. It was moved by Councilwoman MacLain, seconded by Councilman Lacayo and unanimously carried to request the Recreation and Park Director to prepare a report for the September 26 meeting evaluating the pros and cons of sponsorship and listing the organizations sponsored by the District and what privileges and priorities they receive, and that the Recreation and Park Com- mission review the report in a public hearing and evaluate which organizations the District should continue to sponsor and recom- mend the District's sponsorship responsibilities. CONSIDERATION OF PARKING FACILITIES AT OAK KNOLL PARK: The City Council discussed the parking situation at Oak Knoll Park and the Recreation and Park Director indicated the parking problem no longer exists. He recommended no action. CONSIDERATION OF ATTENDANCE AT CITY COUNCIL MEETINGS: The Council asked to be reminded when Commission items are on the Council's agenda so that they may be moved ahead. Mayor Hudson suggested that the Council reconsider this policy and whether Commissioners should be responsible to attend Council meetings.
