1957-09-10MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS September 10, 1957 A regular meeting of the City Council of the City of Cypress was called to order in the City Hall, 9352 Walker Street, at 7 30 o'clock P M , with Mayor Van Dyke presiding The meeting was held on this date because Monday, September 9, was a legal holiday in this State. Councilmen present Councilman absent: A E Arnold, W J Arrowood, J Van Leeuwen, and J Van Dyke T A Baroldi City officials present City Clerk Olsthoorn, City Manager - Deputy City Clerk Wesenberg, City Engineer Neff, and City Attorney Howell Minutes of the regular meeting of Auust 12, 1957, were read by the Deputy Clerk It was ?roved by Councilman Arrowood, seconded by Councilman Van Leeuwen, and unanimously carried, that the minutes be approved as read Minutes of the adjourned regular meeting of August 5, 1957, were read by the Deputy Clerk. It was moved by Councilman Arrowood, seconded by Councilman Arnold, and unanimously carried, that the minutes be approved as read C;ARCIA VARIANCE Upon motion of Councilman Arnold, seconded by Councilman Van Leeuwen, and unanimously carried, a time extension of sixty (60) days from this date was granted to Mr A G Garcia on his use variance application, No UV -3447. This use variance application was for permission to install an advertising sign Upon motion of Councilman Arrowood, seconded by Councilman Van Leeuwen, and unanimously carried, a time extension of four months from this date was granted to Er Garcia on his use var- iance application, No UV -3142, for permission to enlarge his fertilizer storage building. VARIANCES The Council then took up use variance application No. UV -102, submitted by Maseru Suruki, for permission to build a retail sales building at the Lincoln Nursery, said building to be located 900 feet west of Holder Avenue on Lincoln Avenue The -1- September 10, 1957 Deputy Clerk read excerpts from the Planning Commission minutes, setting forth the Planning Commission recommendations. There followed considerable discussion of the problems of toilet fa- cilities, drainage of rain water, whether curbs and gutters should be required by the City, and blacktopping driveways and parking area. Thereupon, it was moved by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, that the curbs and gutters condition be deleted from the Planning Commission recom- mendations and that the use variance be granted according to the remaining recommendations of the Planning Commission, as follows 1 That said building be located seventy-five (75) feet back from the front property line and side yards be a minimum of twenty (20) feet; 2 That there be provisions for off-street parking for a minimum of ten (10) cars in front of said building with the area of seventy-five (?5) by ninety (90) feet in front of said building to be blacktopped, 3 That there need be no curb or gutter, but that applicant place and construct driveways on Lincoln Avenue according to the regulations of the State Division of Highways, 4 That toilet facilities already on the premises be made available to the public, 5. That the building be constructed according to the plan submitted and that all improvements be made in accordance with the ordi- nances and regulations of the City and County Next, the Council considered the application of Mr F G. Kimberlin for permission to locate a dwelling trailer in the A-1 and M-1 districts at 6430 Orange Avenue, 430 feet east of Juanita Street This was Use Variance Application No UV -3803, which had been sub- mitted by the County Planning Commission with no recommendations The Deputy Clerk read a letter from the applicant, stating his -2- September 10, 1957 reasons for asking for this use variance The Deputy Clerk then read the Cypress Planning Commission's recommendations. Thereupon, it was moved by Councilman Arrowood, seconded by Councilman Arnold, and unanimously carried, that the variance be granted according to the conditions of the application and attached plot plan and with the condition that this variance be granted for one (1) year from this date, and that the property owner submit to the City a letter consenting to this use NAME CHANGE RESOLUTION The Deputy Clerk read a resolution, No. 34, stating that the name of the City was changed from "Dairy City" to "Cypress" as of Au`ust 16, 1957. It was moved by Councilman Van Leeuwen and se- conded by Councilman Arrowood, that said resolution be adopted, which motion was carried by the followin` roll call vote AYES Councilmen=:rnold, Arrowood, Van Leeuwen, and Van Dyke NOES None ABSENT Councilman Baroldi RESURFACING OF WALKER STREET There followed a discussion of the condition of Walker Street be- tween Orange Avenue and Ball Road The City Manager reported upon the funds available from the State Gas Tax monies. He stated that these funds amounted to approximately 45,000 00 The City Engineer recommended resurfacing with one and one-half inches of asphalt and widening the narrow places to the twenty-two foot width re- quired by the State It was moved by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, that bids be asked for the resurfacing of said section of Walker Street, and that the City Engineer survey the area and make up specifications ADOPTION OF ORDINANCES The Deputy Clerk read the title of Ordinance No. 24, adoptin the Orange County Trailer Park Ordinance It was moved by Councilman -3- September 10, 1957 --142 Arnold, seconded by Councilman Arrowood, and unanimously carried, that further reading of said ordinance be waived Thereupon, it was moved by councilman Arrowood, seconded by Councilman Van Leeuwen, th6t said ordinance, No 24, be adopted, which motion was carried by the following roll call vote AYES Councilmen Arrowood, Arnold, Van Dyke, and Van Leeuwen NOES: None ABSENT Councilman Baroldi The Deputy Clerk then read the title of an ordinance, No. 23, adopting Orange County Building Codes It was moved by Councilman Arrowood, seconded by Councilman Van Leeuwen, and unanimously carried, that further reading of said ordinance be waived It was then moved by Councilman Van Leeuwen, seconded by Councilman Ar- rowood, that said ordinance, No 23, be adopted, which motion was carried by the following roll call vote. AYES Councilmen Arnold, Arrowood, Van Dyke, and Van Leeuwen NOES. None ABSENT Councilman Baroldi ROAD REPORT The City Manager reported that the Dorfman Construction Company would come back to finish their job on the City streets which were torn up in the process of laying the sewer lines There was discussion of the problems involved with the construction company which was doing the road patching in the City REGISTER OF DEMANDS It was moved by Councilman Van Leeuwen, seconded by Councilman Arrowood, and unanimously carried, that the Register of Demands be approved as submitted PUBLIC MEETING SEATING ARRANGEMENT The City Manager stated that, since there had been some comments upon the seating of the speakers and Councilmen in the audience, -4,- September 10, 1957 he felt that some explanation shoaid be made He stated that it was felt that the audience was so small that it would be better to seat them with the audience. COUNTY CONTRACT REPORT The City Manager reported that the County Board of ~'upervisors have reached a decision on the future handlint, of contracts with cities. He reported that it has been decided to continue contracts permanently, and that all contracts will be uniform Costs are now in the process of being analzed very closely and that it is anti- cipated that there will be a sliOit rise over the rates the City had expected to pay VACATIONS Following the City Manager's request, the Council agreed that the City Manager be allowed to take his two weeks' vacation this year, a few days at a time. PLANNING COMMISSION ORDINANCE AMENDMEiT The Deputy Clerk submitted a request by the Planning Commission that they be given additional powers He then read an excerpt from the Citizens' Advisory Committee minutes Thereupon, it was moved by Councilman Arrowood, seconded by Councilman Van Leeuwen, and unanimously carried, that the matter be tabled until the full Council is present SILVA, SOUSA VARIANCES The City Manager reported that Mr Silva had refused to sign the Offer to Dedicate in case of street widening and that he has asked for another amendment to his variance application, providing that he dedicate the ten feet only in front of his storage yard and not in front of his house It was moved by Councilman Arnold, seconded by Councilman Van Leeuwen, and unanimously carried, that the condi- tions of the variance be changed to delete from the street dedication agreement the ten feet in front of Mr Silva's house, on condition that Nr. Silva pay his business license fees for last year and this -5- September 10, 1957 year and comply with all other requirements, including; signing the Offer to Dedicate, within thirty days from this date Councilman ::.mold moved, seconded by Councilman Van Leeuwen, and unanimously carried, that Mr. Sousa be required to sign the Offer to Dedicate within thirty days from this date APPOINTMENT OF FIRE CHIEF It was moved by Councilman Arnold, seconded by Councilman Van Leeuwen, and unanimously carried, that J A Scherma.n, County Fire Warden, be appointed as Fire Chief for the City of Cypress. MAIL CARRIER DELIVERY SERVICE The City Manager reported that he had met with Mr. Bordner and that a tentative map had been worked out, which it was hoped would meet with the approval of the Post Office Department. The area included the City of Cypress and the unincorporated Cypress terri- tory, up to Crescent Avenue The City Manager reported that he understood that petitions were to be circulated in the unincor- porated area HOUSE MOVING ORDINANCE The City Attorney stated that, in adopting the County Building Department Codes, the Council had adopted a house -moving ordinance He suggested that the City Manager work out with the County Build- ing Department the area of agreement as to the clearing of permits with the City The City Manager was authorized to work with the County Building Department on the matter of the standard of build- ings to be moved into the City MERCUBO SIGN VARIANCE It was moved by Councilman Van Leeuwen, seconded by Councilman Arnold, and unanimously carried, that use variance No UV -3758, requesting permission to erect a sign advertising ice cream sales on property owned by Mrs John Mercuro, be approved The property is located in the H-4 District The sin is to have sixteen (16) -6- September 10, 1957 -----x45 square feet, to be located in the center of the property, and set back ten (10) feet from the front property line. This variance application had been approved by the Citizens' Advisory Committee REALTY OFFICE VARIANCE There was presented for Council action an application for a use variance for permission to move in a realty office on the property next to the Texaco service station on Lincoln Avenue The appli- cant was Robert 'Tidwell The Deputy Clerk read the Planning Com- mission's recommendations. It was :roved by Councilman Van Leeuwen, seconded by Councilman Arrowood, and unanimously carried, that the variance be granted with the following conditions* 1. Curb and gutter to be installed on Lincoln Avenue Drive- ways are to conform to the regulations of the State Division of Highways, 2. Off street parking for 10 cars to be provided, and surfaced with approved asphalt pavement, 3 Office to be set back 110 feet south of centerline of Lincoln Avenue; 4 Sign to be set back 20 feet south of property line. MASTER ZONING PLAN, REPORT The City Attorney reported on progress bein€; made on the master plan and stated that a copy would be available to each Councilman for study before the next regular meeting ORDINANCE, DISPLAY OF MERCHANDISE The City Attorney presented and read an ordinance, No. 29, pro- hibiting the display of merchandise outside of places of business and listing the exceptions Following discussion, it was moved by Councilman Arnold, seconded by Councilman Arrowood, that said ordinance be adopted as an urgency measure, which motion was unanimously carried by the following roll call vote AYES* Councilmen Arnold, Arrowood, Van Dyke, and Van Leeuwen -7- September 10, 1957 NOES None ABSENT. Councilman Baroldi ORDINANCE, TRUCK WEIGHT LIMITS The City Attorney presented and read an ordinance, No. 30, estab- lishing the weight limit on trucks on certain streets and desig- nating certain streets as truck routes. It was moved by Councilman Van Leeuwen, seconded by Councilman Arrowood, and unanimously carried, that said ordinance be introduced and passed to the next regular meeting for second reading and final adoption ADJOURNMENT There being no further business, it was moved by Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, that the meeting be adjourned until the next regular meeting -8- September 10, 1957 ob Vsn Dyke, Mayor
