1957-10-14MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS October 14, 1957 A regular meeting of the City Council of the City of Cypress was called to order in the Citi, Hall, 9352 Walker Street, at 7.30 P M , with Mayor Van Dyke presiding. The meeting was opened with the Pledge of Allegiance to the Flag which was led by Councilman Arnold Councilmen present A. E. Arnold, W. J. Arrowood, J. Van Leeuwen, T A Baroldi, and J Van Dyke Councilmen absent None City officials present• City Manager -Deputy City Clerk Wesen- berg, City Attorney Howell, City Engineer Neff, City Clerk Olsthoorn, City Treasurer Leal The reading of the minutes of the previous meeting was dispensed with until later in the meeting. STATEWIDE PATROL SERVICE There appeared before the Council a group of men who represented the Statewide Patrol Service The spokesman explained that he was a full-time member of the Buena Park police force who had been given a year's leave of absence in order to build up this patrol service He explained their operation in the City of Buena Park and stated that they would like to have permission to establish such a service in the City of Cypress, utilizing the services of a man who would reside in this 0ity and who would work in the City of Cypress only He estimated that, for a small business, the charge would probably be from five to seven and one-half dollars per month He explained their method of operation and the equipment they proposed to obtain in the near future, including a truck equipped to fight fires The Council took the natter under advisement. MINUTES Minutes of the meeting of September 10, 1957, were read by the Deputy Clerk It was moved by Councilman Van Leeuwen, duly seconded and unanimously carried, that the minutes be approved -1- October 14, 1957 a as read BUILDING DEPARTMENT PROCEDURES The City Manager announced that Mr. Donohue of the County Build- ing Department would like to meet with members of the Cypress and Dairyland City Councils at 2 00 P M., October 15, 1957, in the Cypress City Hall in order to discuss procedures to be fol- lowed in relation to the inspection services being furnished by the County Building Department CORDEIRO VARIANCE, NO UV -104 There was presented for the council's consideration Use Variance Application No UV -104 to permit Mr. Tony Cordeiro to establish a commercial dairy in the R-4 zone on Orange Avenue. The City Engineer presented and explained the plot plan The Deputy Clerk read from the Planning Commission minutes their recommen- dations with regard to said variance application. There followed considerable discussion of the plot plan and the Commission's recommendations During the discussion, Councilman Arnold stated that he felt that the condition of the land in that area was such that 250 cows would be too many and would cause a water disposal problem, and for this reason he was not in favor of granting the variance During the discussion of the water disposal problem, it was decided that the waste disposal line from the barn, as shown on the plot plan, should be moved in order to provide better distribution of the waste water Upon motion of Council- man Baroldi, duly seconded and carried by a four to one vote (Councilman Arnold dissenting), Use Variance Permit No UV -104 for a commercial dairy in the R-4 zone on Orange Avenue, Cypress, was granted to Tony Cordeiro in accordance with his application and accompanying plot plan and the following conditions• 1. That there be a maximum of 20 cows per acre, 2. That all structures, water wells, drainage and water lines and their location must comply with the Ordi-- -2- October 14, 1957 nances of the City and County, 3 That the applicant offer in writing to irrevocably dedicate, in the event of street widening, a strip 30 feet in depth from the centerline of Orange Avenue and extending from the easterly extremity to the westerly extremity of the corral construction, 4. That the waste disposal line from the barn be located on the east side of the corrals, 5. That there be constructed asphalt dips in place of closed culverts at those places where the driveways traverse the roadside drainage ditch RACE TRACK - THOROUGHBRED RACING The Deputy Clerk explained that Mr Vessels is applying to the State for permission to have a meet for two-year-old thorough- breds at his race track and that he would appreciate having the City write a letter to the State Racing Commission, stating that the Council approved of such racing in this City It was moved by Councilman Baroldi, duly seconded and unanimously carried, that the City Manager be authorized to write a letter to the State Racing Commission setting forth the Council's approval of a meet for two-year-old thoroughbred horses in this City RABIES VACCINATION ORDINANCE The Deputy Clerk presented Ordinance No 32, an ordinance con- trolling dogs and certain of their diseases, and read the title of said ordinance. It was moved by Councilman Baroldi, duly seconded and unanimously carried, that said ordinance be read by title only and that it be introduced and passed on to the next Council meeting for second reading and final adoption. PLANNING COMMISSION AUTHORITY There followed a long discussion on the question of whether the Planning Commission should remain an advisory body or be given -3- October 14, 1957 authority to pass on certain matters without their coming before the Council for consideration The Deputy Clerk read an excerpt from the minutes of the Planning Commission, stating that the members of the Planning Commission should be given authority to pass on minor matters. Councilman Arnold moved that the Council agree with the Planning Commission, which motion was duly seconded Following the discussion, Councilman Arnold withdrew his original motion, with the permission of the second, and further moved that the matter be tabled until the next regular meeting of the Plan- ning L'ommission, when the Council would meet jointly with that body to discuss the question. This motion was duly seconded and unanimously carried VESSELS VARIANCE, NO UV -3759 The Deputy Clerk read an excerpt of the minutes of the Planning Commission with regard to a requested amendment to the above - numbered variance, followed by an explanation of the request by Mr John 3eekman, representing Mr. Frank Vessels. Thereupon, upon motion of Councilman Arrowood, duly seconded and unanimously carried, Use Variance Permit No. UV -3759, previously granted to Frank Vessels for a golf course and club house in an R-4 and M-1 district in Cypress, was further amended to have condition No 3 of the original permit read as follows. uThat the driveway to the golf course parking lot be forty (40) feet in width with asphalt paving, conforming to County standards, extending from the property line to the existing paving Said driveway is to be suffi- ciently depressed so as not to obstruct the existing roadside culvert, that the applicant agree in writing that, at such time as the City may widen Katelia. Avenue, he shall install a closed culvert under said driveway and construct curved concrete curbs extending ten (10) -4- October 14, 1957 feet east and west of the entrance to said golf course ZONING ORDINANCE DISCUSSION Upon motion of Councilman Baroldi, duly seconded and unanimously carried, the City Manager was authorized to contract for election supplies for the next election from Duane W Wheeler and Company TRUCK WEIGHT LIMIT ORDINANCE The Deputy Clerk presented for its second reading and read the title of Ordinance No. 30, establishing truck routes within the City and setting weight limits for vehicles for certain streets It was moved by Councilman Arrowood, duly seconded and unani- mously carried, that said ordinance be read by title only. Thereupon, it was moved by Councilman Arrowood, duly seconded, that Ordinance No 30 be adopted, which motion was unanimously carried by the following roll call vote AYES Councilmen Arnold, Arrowood, Baroldi, Van Leeuwen, and Van Dyke NOES None ABSENT. None CHECK PAYMENT RESOLUTION This matter was tabled until the next meeting TIP SHEET ORDINANCE The City Attorney presented a proposed ordinance making it a misdemeanor for anyone to sell tip sheets on the public streets within the City of Cypress and requiring that the sellers obtain a business license with certain conditions the Deputy Clerk read the title of said proposed ordinance It was moved by Councilman Baroldi, duly seconded and unanimously carried, that said ordinance be read by title only and that said ordinance be introduced and passed on to the next meeting for second reading and final adoption. MOVING PERMIT WESTION The City Manager reported on the matter of screening of moving -5- October 14, 1957 permits for the moving of buildings into the City He stated that the head of the County Building Department had suggested that such screening by the City be eliminated, since the only thing not covered in the Building Department inspections was the paint and the outside color. It was moved by Councilman Arnold, duly seconded and unanimously carried, that the Council rescind the previous motion authorizing the City Manager to screen all moving permits to move buildings into the City REGISTER OF DEMANDS Following discussion of the road maintenance and certain other expenditures, it was moved by Councilman Van leeuwen, duly seconded and unanimously carried, that the Register of Demands be approved as submitted ROAD PATCHING AUTHORIZATION It was .roved by Councilman Arnold, duly seconded and unanimously carried, that the Council re -affirm that the City Manager is authorized to try out various persons or companies for road patching within the City CIVIL DatehNSE ORDINANCE The Deputy Clerk presented a proposed ordinance, No. 31, and read the title of said ordinance, relating to civil defense and disasters Following discussion, it was ;i,oved by Councilman Arrowood, duly seconded and unanimously carried, that said ordinance be read by title only and that it be introduced and passed on to the next meeting for final adoption ANNEXATION REQUESTS The City Manager explained that certain property owners to the northwest of the City had requested that they be included in the City Where followed discussion and study of the map It was decided that the territory should be broken up into two annexations It was moved by Councilman Beroldi, duly seconded -6- -153 and unanimously carried, that proceedings be initiated and that the City Engineer be instructed to draw up the necessary maps and legal descriptions for transmission to the Boundary Commission by the City Attorney. Councilman Arnold suggested that the City Manager contact the members of the Tioga Country Club to ascertain their feeling toward possible annexation to the City E. W. FELLOWS USE VARIANCE The Deputy Clerk explained that this request is for an enlarge- ment of the existing salvage yard business and the addition of a used car and auto parts sales He then read an excerpt from the Planning Commission meeting setting forth their recommenda- tions Upon motion of Councilman Arrowood, duly seconded and unanimously carried, Use Variance Permit No. UV -3721, applicant, E W Fellows, allowing enlargement of present auto wrecking yard and the establishment of a used car and auto parts business in an A-2 zone, was granted upon the following conditions. 1. That an eight -foot (8') sheet metal fence be erected according to the Orange County Building Code and at all times properly maintained, said fence to completely encompass the proposed yard, 2 That said variance be given for a period of one (1) year from the date of approval, 3 lbat the area outside of the fenced yard portion on applicant's property be kept completely clear and clean of all junk, foreign matter, debris, etc TIDitiELL VARIANCE The Deputy Clerk read the Planning commission recommendations on the amendment to the previously granted variance to Mr Tid- well, and explained that the amendment was necessary because the County Building Department refused to accept the original set- -7 - October 14, 1957 back figure Upon motion of Councilman Van Leeuwen, duly seconded and unanimously carried, Use Variance Permit No. UV - 101, previously granted by the L'ouncil to IIobert Tidwell for a real estate office in an R-4 zone on Lincoln Avenue, was amended to read as follows. "Condition 3 That said real estate office be set back 97 feet south of the centerline of Lincoln Avenue ROAD PAVING, WALKER AND MILLER Following discussion of different types of surfaces and some costs, this matter was tabled until a later date ADJOURNMENT Upon motion of Councilman Baroldi, duly seconded and unanimously carried, the meeting was adjourned until October 21, 1957, at 7:30 P.
