July 21, 1958
An adjourned regular meeting of the City Council of the City
of Cypress was called to order in the City Hall, 9352 Walker
Street, at 7.30 o'clock P M , with Mayor Van Dyke presiding.
Councilmen present. J. Van Dyke, T A Baroldi, W J Arrowood,
M G McCarney and A. E. Arnold
Councilmen absent None
City officials present City Clerk Olsthoorn, City Manager -
Deputy City Clerk Wesenberg, City
Attorney Howell, and City Engineer
Neff.
BUDGET ORDINANCE
The Deputy City Clerk presented an ordinance adopting the
annual budget for the fiscal year commencing July 1, 1958,
and fixing the limitations of expenditures for the several
funds and the functions, departments and activities carried
on under such funds Whereupon, it was moved by Councilman
Arnold, seconded by Councilman McCarney, that said ordinance,
No. 42, be and is hereby adopted as an urgency measure, which
motion was unanimously carried by the following roll call vote.
AYES. Councilmen Arnold, Arrowood, Baroldi,
McCarney, and Van Dyke

WARNING SIGNS, BALL ROAD
The City Manager explained the need for large warning signs
on the dangerous curve on Ball Road, near the Texaco tank
farm Following discussion, it was moved by Councilman Arnold,
seconded by Councilman Baroldi and unanimously carried, that
the warning signs are approved as requested by the Chief of
Police.
TAXATION ORDINANCE
The City Manager presented an ordinance establishing the amount
of revenue to be raised by property taxed for the fiscal year
1953-59 It was moved by Councilman Arnold, seconded by

Councilman Arrowood, that said ordinance, No. 43, be and is
hereby adopted as an urgency measure, which motion was carried
by the following roll call vote
AYES Councilmen Arnold, Arrowood, Baroldi,
NcCarney, and Van Dyke

TAX RATE RESOLUTION
The Deputy City Clerk presented a resolution establishing the
municipal tax rate for the fiscal year 1958-59. It was moved
by Councilman Arrowood, seconded by Councilman Baroldi that
said resolution, No 66, be and is hereby adopted, which
motion was carried by the following roll call vote•
AYES. Councilmen Arnold, Arrowood, Baroldi,
NcCarney, and Van Dyke

INITIATIVE PETITION NOTICE
The Deputy City Clerk presented a notice of intention to cir-
culate initiative petition to request the City Council, City of
Cypress, to call a special election to submit to the voters a
proposed ordinance prohibiting the burial of human dead within
the City of Cypress. It was moved by Councilman Arnold,
seconded by Councilman Arrowood and unanimously carried, that
the notice of intention to circulate initiative petition be
received and filed
At this point, the meeting was recessed in order to adjourn to
the Cypress Grammar School Auditorium. The time was 7.40

Mayor Van Dyke stated that this was an adjourned regular
meeting of the City Council and not a public hearing. The
Mayor then requested the Deputy City Clerk to read the minutes
of the last meeting. Whereupon, the minutes of the last
meeting of the City Council were read by the Deputy City Clerk.
It was moved by Councilman McCarney, seconded by Councilman
Arrowood and unanimously carried, that the minutes of the
meeting of July 14, 1958, be approved as read.
LAWRENCE ANNEXATION
In response to a request from the Mayor, regarding the petitions
presented for and against the Lawrence Annexation, the City
Clerk gave his report. It was moved by Councilman Baroldi,
seconded by Councilman Arrowood and unanimously carried, that
said report be received and filed.
LAWRENCE ANNEXATION SPECIAL ELECTION
The City Attorney presented a resolution fixing September 16,
1958, as the date on which a special election is to be held in
the City of Cypress at which the voters of the City may decide
for themselves whether the territory in the proposed Lawrence
Annexation will be annexed to the City and used for cemetery
purposes. It was moved by Councilman Baroldi, seconded by
Councilman NcCarney, that said resolution, No. 67, fixing
September 16, 1958, as the date for a special election on the
Lawrence Annexation, be and is hereby adopted, which motion
was unanimously carried by the following roll call vote.

LAND USE ZONING O3DINANCE ADOPTION
The City Attorney presented Ordinance No 41 for second reading
and adoption, which ordinance is entitled. "AN ORDINANCE
ESTABLISHING LAND CLASSIFICATIONS AND DISTRICTS WITHIN THE CITY
Tuly 21, 1958
OF CYPRESS AND REGULATING THE USES OF PROPERTY THEREIN,
ADOPTING SECTIONAL NAPS OF SAID DISTRICTS, DEFINING THE TEHMS
USED IN SAID ORDINANCE, PROVIDING FOR THE ADJUSTMENT, AND
ENFORCEMENT THEREOF AND PRESCRIBING PENALTIES FOR ITS VIOLA-
TION." It was moved by Councilman McCarney, seconded by
Councilman Arnold and unanimously carried, that said ordinance
be read by title only.
At this point, the proceedings were interrupted by Samuel
Dreizen, an attorney, who stated that he was speaking for the
Citizens Committee who are against the section on cemeteries
in the land use ordinance. Councilman Arnold stated that he
believed that the cemetery clause had been added in the last
two (2) months and that the people had not had a chance to
protest. During the ensuing discussion, it was stated by the
City Attorney that there have been at least three (3) public
hearings on the proposed ordinance since the cemetery clause
had been added..
Councilman Arrowood moved that, since sufficient opportunities
to protest had been afforded the people, the request to be
heard at this time be denied, which motion was seconded by
Councilman Baroldi and carried by the following roll_ call vote•
AYES Councilman Arrowood, Baroldi, and Van Dyke
NOES. Councilmen Arnold and McCarney
ABSENT None
The City Attorney then read proposed ordinance No. 41 by title
only. Whereupon, it was moved by Councilman Arnold and second-
ed by Councilman Arrowood that Ordinance No 41 be and is
hereby passed and adopted, which motion was unanimously carried
by the following roll call vote
AYES Councilmen Arnold, Arrowood, Baroldi,
McCarney, and Van Dyke

ADJOURNMENT
There being no further business to come before the Council,
it was moved by Councilman Arnold, seconded by Councilman
Baroldi and unanimously carried, that the meeting be adjourned
until Tuesday, August 5, 1958, at 7 30 o'clock P.M. in the
Cypress City Hall. Time of adjournment was 8.20 o'clock P. M.
