1958-08-05MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS An adjourned regular called to order at 7 Councilmen present Councilmen absent August 5, 1958 Council meeting of the City of Cypress was 30 P. M. by Mayor Jacob Van Dyke. J Van Dyke, T A Baroldi, W J Arrowood, M. G. McCarney, and A. E. Arnold None City officials present Deputy City Clerk -City Manager Wesenberg and City Attorney Howell PEESENTATI ON OF PETITIONS Upon motion of Councilman McCarney, seconded by Councilman Arrowood and unanimously carried, the Council ordered the initia- tive petition, requesting that the City Council of the City of Cypress submit to the people of Cypress at a special election the following proposed ordinance for their adoption or rejection "An ordinance of the City of Cypress, California, prohibiting the burial of human dead within said City." be received and ordered checked by the City Clerk's office and the office of the City Attorney and that a report on said petition be made to the City Council at the next regular Council meeting. The Deputy City Clerk presented two (2) petitions which had been filed in the City Clerk's office within the past few days and said petitions were read by the City Attorney The first petition was a petition for referendum to the City Council, City of Cypress, protesting the enactment of Section. 17 of the City's zoning ordinance, No 41, and ordering that said Section 17 be referred to a vote of the qualified voters of the City of Cypress at a special election to be called for that purpose for their approval or rejection of said Section 17 Upon motion of Councilman Arrowood, seconded by Councilman Baroldi and unan- imously carried, the aforementioned petition for referendum was ordered received and to be checked by the City Clerk's office and the office of the City Attorney and reported back to the City Council at the next regular Council meeting August 5, 1958 -1- COUNCILMAN ARAOWOOD' S PROPOSAL Councilman Walt Arrowood submitted to the City Council a series of proposals for operational regulations, etc , to be adherred to by the City of Cypress After discussion, upon motion of Councilman McCarney, seconded by Councilman Arnold and unani- mously carried, the Council ordered said proposed set of regula- tions to be tabled until a later date, and, after the City Attorney has had the opportunity to rewrite the proposals into the form of a formal motion RESOLUTION NO 68 Resolution No. 68, establishing the election board, time of special election for September 16, 1958, etc., was presented by the Deputy City Clerk, and, upon motion of Councilman Arnold, seconded by Councilman McCarney and unanimously carried, said resolution was adopted CLARIFICATION OF PUBLIC STATEMENT Upon motion of Councilman Arnold, seconded by Councilman McCarney and unanimously carried, the City Manager was ordered to make an official statement to the local paper clarifying the statement made at the recent City Council meeting in relation to the stated number of public hearings which had been conducted on the City's new zoning ordinance at which time the cemetery clause was in- cluded within the :proposed ordinance. The statement that had been made at the public Council meeting of July 14, 1958, in- dicating that there had been three public hearings held on said zoning ordinance at which time the cemetery clause was included in said ordinance, was definitely established at this time to have been an incorrect statement and that, in reality there had been but two (2) public hearings held upon said ordinance at which time the cemetery section was included by the City Council and Planning Commission, respectively. The error was due to a spur-of-the-moment guess and was completely unintentional. August 5, 1958 -2- ELECTION, SEPTEMBER 16, 1958 Upon motion of Councilman NcCarney, seconded by Councilman Arrowood and unanimously carried, the Council authorized the Duane Wheeler Company to supply the City Clerk's office with the necessary ballots, sample ballots, and other supplies for the coming September 16th special election UNEMPLOYMENT DISABILITY INSURANCE Upon motion of Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, the City Council authorizes all employees and officers of the City to be placed under the California State Unemployment and Disability Insurance and that the necessary arrangements be made by the City Manager in cooperation with the State, in accordance with the wishes of the majority of the employees and officers of this City as indicated in an employees' and officers' election CULVI HT UNDEli WALKER A Mr. George Koumis made the statement from the floor that he considered it necessary for an additional culvert to be imme- diately placed under Walker Street immediately north of Karen Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the Council authorized the City Engineer to make a check of said request and to report back to the City Council. SHAMROCK STABLES Several persons discussed the air pollution and other problems which they felt had arisen at the recently established Shamrock Stables in the City of Cypress and the City Council requested the City Manager to ask the Building Department, Health Department, and Air Pollution Control District to investigate the reported illegal or improper activities of said stable Upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unani- mously carried, the meeting was duly adjourned until the next regular meeting.
