1958-09-23 (Special Meeting).-w w 276 CONSENT TO HOLD AND WAIVER OF NOTICE OF SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS KNOW ALL MEN BY THESE PRESENTS That we, the undersigned, being all the Councilmen, by mutual consent and understanding beforehand, hereby consent to hold a special meeting of the Council of said City at the Cypress City Hall on the 23rd day of September, 1958, at the hour of 7.30 P M of said day, and we agree that all of the acts and proceedings of said meeting shall be as valid as if had or taken at a meeting duly and regularly called and noticed We further waive all notice of the time, place, and purpose of said meeting, whether required by the laws or otherwise IN WITNESS WHEREOF, we have hereunto subscribed our signatures this 23rd day of September, 1958 acob Van Dyke Walter! Arro*o-od September 23, 1958 Thomas A Baroldi /`/ / 2R 'Martin Gi1McCar % Alfr E Arnold MINUiES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS September 23, 1958 A special meeting of the City Council of the City of Cypress was called to order in the City Hall, 9352 Walker Street, at 7.30 o'clock P i4i , with Mayor Van Dyke presiding. The Pledge of Allegiance to the Flag was led by Councilman McCarney Councilmen present J Van Dyke, N. G. McCarney, A E Arnold, T. A. Baroldi, and W J Arrowood Councilmen absent. None City officials present City Clerk Olsthoorn, City Manager - Deputy City Clerk Wesenberg, and City Attorney Howell BALLOT CANVASS The Mayor explained that the purpose of this meeting was to canvass the ballots of the special election of September 16, 1958, as required by law The Deputy City Clerk stated that nine (9) applications for absentee ballots had been received and that nine (9) absentee ballots had been mailed out He further stated that seven (7) absentee ballots had been returned to the City Clerk's office. Thereupon, after comparison of signatures on the ballot envelopes by the City Clerk and the City Council, the seven (7) absentee ballots were opened and placed in the ballot box. With Council- men Arrowood and 14cCarney keeping tally, it was found that the following votes had been cast by absentee ballot. In favor of the Lawrence Annexation proposition 3 votes Opposed to the Lawrence Annexation proposition* 4 votes Whereupon the absentee ballots were then placed in the envelope which was to be sealed immediately, and the unused ballots were cancelled. by Councilman Arnold The City Clerk then opened a sealed envelope containing election material which had been received from the Election Board. The tally sheets were removed from the envelope and the Councilmen checked the tally of the -1- September 23, 1958 Election Board., finding it in order. ELECTION RESOLUTION The City Attorney presented and read a resolution declaring the results of the special City election of September 16 1958, and that the ordinance thereby adopted becomes effective in ten (10) days It was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that said resolution, No. 72, be adopted, which motion was carried by the following roll call vote AYES' Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES• None ABSENT None Thereupon, the records of the Election envelope and sealed by the City Clerk, At this point the City Attorney stated upon making careful investigation into Board were returned to the as required by law. to Nr Samuel Dreizen that, the question, he had learned that neither the roster of voters, nor any of the records of the Election Board, could be made available to anyone, but that all of such material must be returned to the envelope which must then be re -sealed and kept by the City Clerk for a period of six months At the expiration of the six-month period, said material in the sealed envelope must be destroyed by the City Clerk, and that, unless the election is contested, no one is to have access to the records in said sealed envelope. If the election is contested within the six-month period, the City Clerk, upon receipt of a Court order, must produce said records in Court POLICE PATROL CAR Following a lengthy discussion of the maintenance problems on the present patrol car and the costs thereof, it was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously -2- September 23, 1958 My S carried, that three (3) or more bids be obtained and that another car be purchased when the new models are available; also, that the present car be retained as a second car, if it is found to be in a serviceable condition The Mayor, the City Manager, and the Police Chief were designated as the purchasing committee. It was moved by Councilman Arrowood, seconded by Councilman Arnold and unanimously carried, that the Council hereby authorizes the Police Chief to order the radio unit for the second police car, to be paid for by the City after the first of the year. CEERITOS AVENUE DRAINAGE PAOBLEti It was moved by Councilman Arnold, seconded by Councilman Baroldi and unanimously carried, that the City Engineer make a study of the costs of installing culverts and constructing a drainage ditch on the north side of Cerritos Avenue, west of Knott Avenue ADJOURNMENT There being no further business to come before the Council, it was moved by Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, that the meeting be adjourned until the next regular meeting.
