1958-12-08MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF CYPRESS December 8, 1958 A regular meeting of the City Council of the City of Cypress was called to order in the City Hall, 9352 Wacker Street, at 7 30 o'clock P M , with Mayor Van Dyke presiding. The Pledge of Allegiance to the Flag was led by Councilman Baroldi Councilmen present. A. E Arnold, W J Arrowood, T. A. Baroldi, M G McCarney, and J. Van Dyke Councilmen absent. None City officials present* City Clerk Olsthoorn, City Manager - Deputy City Clerk Wesenberg, City Attorney Howell, City Engineer Neff, and Chief of Police Hansen MINUTES On motion of Councilman Baroldi, sconded by Councilman Arrowood and unanimously carried, the minutes of the regular meeting of November 10, 1958, were approved as submitted. On motion of Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the minutes of the special meeting of November 28, 1958, were approved as submitted. ELLSWORTH VARIANCE The Deputy City Clerk presented Use Variance Application No. UV -123 of Mrs Ralph Ellsworth to permit the location of a dwelling trailer in the C-2 zone The Deputy Clerk read the Planning Commission's recommendation. It was moved by Councilman Arnold, seconded by Councilman Arrowood and unanimously carried, that the variance be granted for a five-year (5) term, expiring December 8, 1963, on the condition that said variance is limited to one trailer R-3 ZONE CHANGE REQUEST The Deputy City Clerk explained that this matter could not be taken up at this meeting because of the legal requirement as to time elapsed between the Planning Commission hearing and the Council meeting WAR SURPLUS PROPERTY RESOLUTION The Deputy City Clerk presented and explained a resolution making -1- December 8, 1958 98 certain technical changes in the handling of war surplus property. Following discussion, upon motion of Councilman Baroldi, seconded by Councilman Arrowood and unanimously carried, the Council adopted said resolution, No. 77. COUNTY ROAD CONTRACT The Deputy City Clerk presented a contract which is a renewal of the contract for road maintenance services with the County Road Department The new contract expires June 30, 1959. Upon motion of Councilman Arnold, seconded by Councilman Baroldi and unanimously carried, the Council authorized the Mayor and the City Clerk to execute said contract. REGISTER OF DEMANDS Upon motion of Councilman Arnold, seconded by Councilman Arrowood, and unanimously carried, the Council approved the Register of Demands for the month of December,1958. REGISTRATION OF EX -CONVICTS ORDINANCE The City Attorney presented for second reading and final adoption an ordinance requiring the registration with the Cypress Police Department of persons convicted of certain crimes Following the reading of said ordinance, it was moved by Councilman Arrowood and seconded by Councilman Baroldi that said ordinance, No 46, be and is hereby passed and adopted, which motion was unanimously carried by the following roll call vote. AYES• Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES. None ABSENT• None FIREARMS ORDINANCE The City Attorney presented for second reading and final adoption an ordinance prohibiting the discharge of firearms and the use of certain other weapons within the City The City Attorney then read said ordinance. It was moved by Councilman Baroldi and seconded by Councilman Arrowood that said ordinance, No. 47, be and is _?_ December 8, 1958 299 hereby passed and adopted, which motion was unanimously carried by the following roll call vote: AYES* Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES. None ABSENT None CURFEW ORDINANCE The City Attorney presented an ordinance making it unlawful for persons under 18 years of age to be on the public streets between the hours of 11.00 o'clock P M and 5 00 o'clock A.M. unless accompanied by an adult. The City Attorney then read said ordinance It was moved by Councilman Arnold, seconded by Councilman Arrowood, that said ordinance, No 48, be and is hereby passed and adopted, which motion was unanimously carried by the following roll call vote. AYFS: Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES. None ABSENjT • None FALSE INFORMATION ORDINANCE The City Attorney read a draft of a proposed ordinance prohibiting the making of false reports or giving of false information to any officer of the City The City Attorney was instructed to prepare copies of said proposed ordinance to be provided for the Council- men in order that they might study said copies. The matter was tabled until the next Council meeting APPOINTMENT OF PLANNING COMMISSIONtRS Mayor Van. Dyke announced that Mr. C. L. Wicker had been re -appointed for a four-year term on the Cypress Planning Commission, his term to expire on August 5, 1962 Upon motion of Councilman Arnold, seconded by Councilman McCarney and unanimously carried, the Council approved and affirmed the re -appointment of Mr. C. L. Wicker to the Planning Commission December 8, 1958 -3- AUDIT REPORT The City Finance Director presented to each Councilman a copy of the audit report for the first quarter of the fiscal year He stated that said report had been studied and approved by the Audit Committee. The matter was then tabled until the next meeting. ROAD SURVEYS AUTHORIZATION Upon motion of Councilman Arrowood, seconded by Councilman McCarney and unanimously carried, the City Engineer was authorized to make the necessary surveys for the improvement of those streets requiring flood damage repair in the City's agreement with the State of California. TRUCKS ON MILLER STREET The City Clerk brought up the matter of heavy cement trucks using Miller Street to reach the residential subdivision being constructed in Buena Park just east of Miller between Ball Road and Cerritos Avenue. The City Manager pointed out that the trucks were ordered off of Miller Street which is posted against such use. Thereupon, the trucks started using Juanita Street instead, which street is not posted against such use. The City Manager pointed out that Miller Street is better able to stand such heavy traffic The City Manager was instructed to contact City Manager Storm of Buena Park to see if this problem could be solved The matter was then tabled until the City Attorney could prepare an urgency ordinance amending the existing ordinance by adding the streets not already protected HOLDER STREET CHANNEL REPORT The City Engineer and City Attorney discussed progress made on certain phases of the drainage channel Upon motion of Council- man Earolai, seconded by Councilman Arnold and unanimously carried, the Council accepted the City Engineer's report. CURBS AND GUTTERS In discussing the matter• of improving the streets in the residential December 8, 1958 area, the Mayor• asked if it would be possible to have the curbs put in before the streets are improved Following discussion, it was moved by Councilman Arnold, seconded by Councilman i'icCarney and unanimously carried, that the City Engineer draw up the boundaries of tra improvement district so that petitions may be circulated to obtain 51 per cent of the property owners' signatures as required under the 1911 Improvement Act. The streets involved are: Karen, Nelson, Newman, and Camp DED -END STREET SIGNS Councilman Arnold suggested that signs be placed on the streets in the residential area notifying motorists that said streets are not through streets The City Manager was instructed to attend to this matter. TRUCK ORDINANCE AMENDMENT The City Attorney presented and read an ordinance amending Ordinance No. 30, prohibiting the use of certain streets by trucks. Upon motion of Councilman Baroldi, seconded by Councilman Arrowood, said Ordinance, No 49, was passed and adopted as an urgency measure, which motion was unanimously carried by the following roll call vote AYES Councilmen Arnold, Arrowood, Baroldi, McCarney, and Van Dyke NOES None ABSENT. None BUDGET ORDINANCE AMENDIVENT The Deputy City Clerk presented and read ordinance amending Ordinance No. 42 which adopts the fiscal year 1958-59. During the discussion, requested that copies of said proposed ordinance in full a proposed the budget for the Councilmen be furnished them for study It was explained by the Deputy City Clerk that said amendment to the budget ordinance was necessary to take care of expansion. made and to be made in the near future It was moved by Councilman Arnold, seconded by Councilman Arrowood and December 8, 1958 -5- unanimously carried, that said ordinance, No 50, be introduced for first reading and passed on to second reading and final adoption.. HIRING OF POLICE OFFICERS There followed discussion on the question of whether new police officers should be hired subject to approval of the Council It was moved by Councilman McCarney, seconded by Councilman Arnold and unanimously carried, that the Chief of Police has full authority to hire officers without consent of the Council on each individual. Following a request by the City Manager, Councilman Arnold moved that one of the new police officers be hired immediately for the third shift and that one of the other three new officers not be hired until the third week in January if the necessary arrangements could be made with the men, which motion was seconded by Councilman Arrowood and unanimously carried. INDUSTRIAL SUBDIVISION ORDINANCE The City Attorney stated that, in order to avoid a long series of public hearings, it was decided to hold informal meetings to discuss any slight changes made in the proposed ordinance The Planning Commission has held its meeting and has recommended passage. Following study of said ordinance by the Councilmen, it will then go back to the Planning Commission., with Council recommendations, for their public hearing. PROPOSED NORTH -SOUTH FREEWAY The City Manager reported the receipt of a letter from the State Division of Highways, informing the City of public hearings to be held in the area on the route of a proposed new north -south freeway AUTHORIZATION FOR FUNDS CANVASS It was moved by Councilman Arrowood, seconded by Councilman Baroldi and unanimously carried, that the following ort=anizations are authorized to canvass the City during their annual fund-raising campaigns Heart Association, Polio organization, and the Boy Scouts -6- December 8, 1958 rtin REPORT ON CEMETERY LAWSUITS The City Attorney reported on the status of the Gandola and Van Leeuwen suits against the City.
