Ordinance No. 44ORDINANCE NO 44 AN ORDINANCE OF THE CITY OF CYPRESS APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "LAWRENCE ANNEXATION," TO THE CITY OF CYPRESS, AND ESTABLISHING A CEM CEMETERY ZONING DIST`RICT THEREIN THE PEOPLE OF THE CITY OF CYPRESS DO ORDAIN AS FOLLOWS. WHEREAS, the County Boundary Commission of Orange County did in session duly assembled at 11.00 o'clock A M, on May 19, 1958, approve the boundaries of a proposed annexation to the City of Cypress known as the "Lawrence Annexation," and WHEREAS, on the 20th day of May, 1958, there was filed with the City of Cypress a written petition asking that certain new territory described therein be annexed to the City of Cypress for cemetery purposes; and WHEREAS, on the 2nd day of June, 1958, the Council of the City of Cypress did pass and adopt Resolution No 61 giving notice of the proposal to annex certain uninhabited territory to the City of Cypress, said territory being therein designated as the "Lawrence Annexation," said Resolution describing the boun- daries of the territory proposed to be annexed, and WHEREAS, on the 2nd day of June, 1958, at an adjourned regu- lar meeting of said City Council of the City of Cypress, Resolu- tion No 61 was duly passed and adopted specifically describing the boundaries of the territory so proposed to be annexed to the City of Cypress and designating such territory as "Lawrence Annexation," and giving notice of such annexation and fixing the 14th day of July, 1958, at the hour of 7 30 o'clock F. 1i., at the City Council Chamber in the City Hall in the City of Cypress as the day, hour and place for hearing of written protests to said annexation and when and where any person owning real property within such territory so proposed to be annexed and having objec- tions to the proposed annexation might appear before the City -1- Ordinance No 44 Council of the City of Cypress and present written objections to the annexation of said territory to the City of Cypress, and directing the City Clerk to post or cause to be posted a copy of said resolution as required by law, and directing that said posting be completed at least twenty (20) days prior to the date of hearing hereinabove mentioned, and further directing the City Clerk of the City of Cypress to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Cypress is owned by a County, that the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation That on the hour, day and at the place specified in said Resolution No. 61, to wit' on the 14th day of July, 1958, at the hour of 7'30 o'clock P M., in the City Council Chamber in the City Hall in the City of Cypress, California, the City Council of the City of Cypress did meet and assemble to hear and pass on all protests filed or received up to the hour of 7 30 o°clock P M. on said date, and the City Council did find that the Resolution fixing the time and place of said hearing was posted by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed to each person to whom land within the territory proposed to be annexed is assessed, or -2-- Ordinance No 44 in which such person has any interest, by the City Clerk as directed in said Resolution That written protests were not made by the owner or owners of one-half of the value of the territory proposed to be annexed according to the last equalized assessment roll of the County of Orange, State of California, nor were protests made by public or private owners equal to one- half of the value of the territory proposed to be annexed as determined by the City Council, and WHEREAS, said public hearing was closed and the matter taken under submission by said City Council of the City of Cypress and continued for decision to 7.30 o'clock P. 'vi. at the Council Chamber City Hall. City of Cypress, on the 21st day of July, 1958, and WHEREAS, all notices and acts required by law to be done or given in respect to the annexation of said "Lawrence Annexation" to the City of Cypress have been done or given, and WHEREAS, on the 21st day of July, 1958, at the hour of 7.30 o'clock P. M., said City Council of the City of Cypress did adopt Resolution No 67 pursuant to the provisions of Election Code Section 1719, calling for the submission to the voters of the City of Cypress the proposition PROPOSITION' Shall the ordinance, the nature of which is stated in the title thereof, to wit "An ordinance of the City of Cypress approving the annexation of certain uninhabited territory, designated 'Lawrence Annexation', to the City of Cypress, and establishing a CEM Cemetery Zoning District therein.," be adopted? AND WHEREAS, said territory is contiguous to the City of Cypress and is uninhabited territory within the County of Orange, NOW, THEREFORE, the people of the City of Cypress do hereby approve the annexation of the territory hereinafter described to the City of Cypress, and do hereby further ordain that the said -3- Ordinance No 44 territory be and is hereby annexed to the City of Cypress as a CEM Cemetery District as set forth in Section 17 of Ordinance No. 41, and all uses of the land within said territory are regulated thereby That said territory, the annexation of which to the City of Cypress is herein approved, is all that territory situate in the County of Orange, State of California, more particularly described as follows' Beginning at an angle point in the existing boundary of the City of Cypress, said angle point being the intersection of a line parallel to and distant 30,00 feet southerly, measured at right angles, from the north line of Section 17, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, Page 11 of Miscellaneous Maps in the office of the County Recorder of the County of Orange, State of California, with the west line of said Section 17, said west line being the common bound- ary between the County of Los Angeles and said County of Orange, thence northerly, along said west line and said common boundary, to the northwest corner of said Section 17; thence northeasterly, along said common boundary, to the southerly right-of-way line of the Orange County Flood Control District right-of-way as described in Deed recorded in Book 3632, Page 36 of Official Records in the office of said County Recorder of said County of Orange, thence easterly and north- easterly, along said southerly right-of-way line and the southerly right-of-way line of the Orange County Flood Control District right-of-way as described in Deed recorded in Book 4254, Page 249, of Official Records in the office of said County Recorder of said County of Orange, to the south line of the northeast quarter (I\E4) of the southwest quarter (SW*) of Section 8, in said Township and Mange, thence easterly, along said south line, to the west line of the east half (E*) of the east hall' (E.-) of the northeast quarter (NE4) of the southwest quarter (SW4) of said Section 8; thence northerly, along said west line, to a line parallel to and distant 15,00 feet southerly, measured at right angles, from the north line of the south half (S ;-) of said Section 8, thence easterly, along said parallel line, to the east line of the northwest quarter (NW*) of the southeast quarter (SE4) of said Section 8, thence southerly, along said east line, to the south line of the northwest quarter (NW4) of the southeast quarter (SE4) of said Section 8, thence westerly, along said south line, to the east line of the west half (W) of the southwest quarter (SWt) f the southeast quarter (SE4) of said Section 8, thence southerly, along said east line, to a line parallel to and distant 30,00 feet northerly, measured at right angles, from the south line of said Section 8, thence westerly, along said -4- Ordinance No 44 parallel line, to a line parallel to and distant 15.00 feet westerly, measured at right angles, from the west line of the southeast quarter (SE) of said Section 8, thence southerly, along said parallel line and a line parallel to and distant 1500 feet westerly, measured at right angles, from the east line of the northwest quarter (NW4) of said Section 17, to a line parallel to and distant 30.00 feet southerly, measured at right angles, from the north line of the northwest quarter (NW) of said Section 17, said last mentioned parallel line being the existing boundary of said City of Cypress; thence westerly, along said parallel line and said existing boundary, to the point of beginning ADOPTED BY POPULAR VOTE ON September 23, 1958.
