Ordinance No. 54ORDINANCE NO 54 AN ORDINANCE OF THE CITY OF CYPRESS AMENDING ORDINANCE NO 18 (ADOPTED March 25 1957) AS AMENDED BY ORDINANCE NO 20 (ADOPTED APRIL 16, 1957), RELATING TO THE SALE OF FIREWORKS. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS Section 1. Section 7 of Ordinance No 18 of the City of Cypress is hereby amended to read "Application for Permit Applications for such permits shall be filed with tae City Clerk or his authorized agents between April 1st and June 15th of the year for which the per- mit is sought Each application shall contain a detailed state- ment of each and every kind of fireworks proposed to be sold under said permit and shall contain the street address or loca- cion where said fireworks will be sold in sufficient detail so that the property may be easily located and inspected. Each application shall also contain a description of the exact size and location of the stand or other structure at or from which the sale of fireworks will be conducted with an accuracy of plus or minus one foot Any permit issued shall be valid only for the exact location described in the application and no stand or other structure shall be constructed or located except as described in the application and no stand shall have any side longer than 50 feet provided further, that the following set- back requirements, measured from the center of the paved portion of the highway, for fireworks stands and signs in relation there- to, shall be met (a) Major divided highway shall have a 110 -foot setback, (b) Major undivided highway shall have a 105 -foot setback, (c) Primary highway shall have an 85 -foot setback, (d) Secondary highway shall have a 75 -foot setback, Ordinance No 54 1 Each application shall be accompanied with a certificate from an insurer authorized to insure risks within the State of Cali- fornia to the effect that the applicant has in effect for the period beginning on or before the date the application is filed and ending July 31st of the year for which the application is filed public liability insurance in an amount of at least $100 000 00 per person and $300,000 00 per accident and property damage insurance in an amount of at least $5,000 00 per person and $25,000 00 per accident Such insurance is required of any applicant for a permit under this Ordinance Should any of the insurance required by this Ordinance expire, terminate or be can- celled on or before July 31st of the year for which the applica- tion is filed and the permit issued, the applicant or permittee shall be under duty to notify the City Clerk of that fact and, whether or not said notice is given, no permit shall be valid after any of said insurance has expired terminated or been can- celled The City Clerk shall examine such application and shall issue such permit to such applicant if all of the provisions of this Ordinance have been complied with Should said detailed statement contain any type of fireworks prohibited herein, then such type shall be stricken from such statement prior to the issuance of said permit. No person obtaining such permit shall display or sell any kind of fireworks not described in such detailed statement or any type stricken therefrom No permit shall be issued unless the applicant posts with the City Manager, prior to the 9th day of June of the year for which the permit is issued, a bond or other satisfactory security in the amount o_ $50 00, conditioned upon the clean-up of the site of the pro- posed location upon which the fireworks will be sold No permit shall be issued by the Clerk or his delegate where the permit to be issued will result in there being more than four locations at or from which fireworks will be sold under permits previously issued within a distance of 750 feet measured along any street Ordinance No 5 or streets For the purpose of the administration of this sec- tion by the City Clerk or his delegate, applications which are otherwise regular and proper shall be issued in the order filed " PASSED AND ADOPTED this lath day of April', 1959.
