Ordinance No. 2ORDINANCE NO 2 AN ORDINANCE OF THE CITY OF DAIRY CITY ESTABLISHING AND ADOPTING THE ORANGE COUNTY LAND USE ORDINANCE NO 351 AS AhENDED TO JUNE 1, 1955 AS AN ORDINANCE ESTABLISHING LAND CLASSIFICATIONS AND DISTRICTS WITHIN THE CITY OF DAIRY CITY AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING SECTIONAL MAPS OF SAID DISTRICT, DEFINING THE TERMS USED IN SAID ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AXENDMENT THEREOF AND PRESCRIBING PENALTIES FOR ITS VIOLATION, AND CONTINUING AND PRESERVING PRESENT USES OF PROPERTY. The City Council of the City of Dairy City does ordain as follows• Section 1. A certain document on file in the office of the City Clerk, consisting of three copies in booklet form, being marked and designated: "Orange County Land Use Ordinance No 351, as amended to June 1, 1955," is hereby adopted as the ordinance of the City of Dairy City establishing land classifications and districts in the City of Dairy City and regulating the uses of property therein, adopting sectional maps of said districts, defining the terms used in said ordinance, providing for the adjustment, enforcement and amendment thereof and prescribing penalties for its violation, and continuing and preserving present uses of property, as though fully set forth herein Section 2• The established zones and land classifications and districts heretofore existing pursuant to said Orange County Ordinance and the regulation of the uses of property therein are hereby continued and no different land classi- fication or use of property is permitted without a grant of a use variance, a conditional use permit or a change of zoning to a different land classification Section 3: The City of Dairy City, a municipal corporation, just having become incorporated, intends in good faith to conduct studies within a reasonable time for the purpose of recommending the adoption of amendments or additions to the zoning ordinance affecting the land uses within the newly incorporated city, that the City Council in order to protect the public safety, health and welfare hereby finds and declares that it is necessary to adopt this ordinance as a temporary interim zoning ordinance prohibiting any uses -1- Ordinance No 2 eihich may be in conflict with this temporary interim zoning ordinance Section 4. This ordinance is an ordinance for the immediate preservation of the public peace, health and safety, and the following is a declaration of the facts constituting the urgency: The City of Dairy City, a municipal corporation, became duly incorporated on the 24th day of July, 1956 On said date, the rules and regulations of the County of Orange that were in effect and operative in the area within the boundaries of the present City of Dairy City are in question by reason of the incorporation of said City In order that the public will be protected immediately, it is necessary that this ordinance be adopted as an urgency measure Section 5: This ordinance shall take effect immediately, and within fifteen (15) days shall be posted in three public places in the City of Dairy City together with the names of the members of the City Council voting for and against the same.
