Ordinance No. 29ORDINANCE NO. 29 AN ORDINANCE OF THE CITY OF CYPRESS PROHIBITING THE DISPLAY OF MERCHANDISE OR PROPERTY FOR SALE, EXCHANGE OR TRANSFER WITHOUT ENCLOSURE OF SAID PROPERTY OR MERCHANDISE WITHIN A BUILDING AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS. Section 1. It shall be unlawful for any person to place, display or maintain any property or merchandise or other article for sale, transfer or exchange without enclosing such property or mer- chandise or other article within a building. Section 2. For the purpose of this ordinance a building is defined as any structure having at least four walls and a ceiling so that it is entirely enclosed except for windows and doors. Section 3 The display for sale of automobiles, farm equipment, live animals, newspapers, roadside farm produce, or similar articles not normally kept within a building are excepted. Section 4. Any person, firm or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $500.00 or by imprisonment in the County Jail for a period of not more than six months or by both such fine and im- prisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued or permitted by such per- son, firm or corporation and shall be punishable therefor as herein provided Section 5. This ordinance is urgently required for the immediate pre- servation of public peace, health and safety for the reason that -1- Ordinance No 29 the City has recently bean incorporated and there are presently being considered by the City Planning Commission and the City Council a master land use ordinance and other matters affecting zoning and land use within the City, that there is a present threat of devaluation of properties within the City by the un- restricted and uncontrolled operation of businesses for the sale of used merchandise; therefore, the City Council declares that this ordinance shall take effect and is adopted as an emergency ordinance and shall be in force and effect immediately.
