Ordinance No. 32ORDINANCE NO 32 AN ORDINANCE OF THE CITY OF CYPRESS PROVIDING FOR THE LICENSING AND IMPOUNDING OF DOGS, REGULATING THE KEEPING AND CONTROL OF DOGS, THE CONTROL AND SUPPRESSION OF RABIES AND OTHER INFECTIOUS AND CONTAGIOUS DISEASES; PROVIDING PENALTIES FOR THE VIOLATION THEREOF THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS Section 1 Vaccination shall mean the inoculation of a dog with a vaccine approved by the County Meat and. Livestock Inspector of the County of Orange. County Meat and Livestock Inspector shall mean the County Meat and Livestock Inspector of the County of Orange who by contract acts for and on behalf of the City in such capacity Section 2 Every person who owns or harbors any dog or dogs shall have such dog or dogs vaccinated by a duly licensed veterinarian. Such vaccination shall be at intervals of not greater than two years. Section 3. Every duly licensed veterinarian after vaccinating any dog, shall sign a certificate in triplicate containing the following information a. The name and address of the owner or harborer of the vaccinated dog. b The kind of vaccine used and the date of the vaccination c The year and serial number of the dog license tag, or in the event that the dog has not previously been licensed, a notation to that effect. d. The breed, age, color and sex of the vaccinated dog He shall immediately present the original certificate to the owner or harborer of the dog, —1— Ordinance No 32 the duplicate copy of the certificate to the livestock inspector, and the triplicate shall be maintained by the veterinarian. Section 4 A dog may be licensed prior to vaccination, provided, however, that such dog shall be vaccinated within not more than thirty (30) days from and after the date of the issuance of the license. If the dog be not vaccinated within said thirty (30) day period of time, the license shall immediately become null and void, unless such dog shall have been vaccinated by a duly licensed veterinar- ian within one year prior to the date of the issuance of the license and the owner or harborer of such dog displays upon de- mand a certificate showing the fact of such vaccination by an approved veterinarian and containing the information set forth in Section 3 hereof signed by a duly licensed veterinarian. Section 5. The Livestock Inspector shall file and register the copy of the certificate He shall retain and file the same as the of- ficial registry of all dogs licensed Section 6. No person who owns or harbors any dog shall fail or refuse to exhibit the certificate required by this Ordinance upon demand of any person charged with the enforcement of this Ordinance. Section 7. Every owner and every harborer of a dog shall attach the official dog license tag to the collar or harness of a vac- cinated dog and such collar or harness shall be worn by the dog at all times The original certificate of vaccination shall be retained by the owner or harborer of the vaccinated dog for in- spection by any person charged with the enforcement of this Ordinance -2- Ordinance No 32 Section 8 No unauthorized person shall remove from any dog any collar or harness or other device to which is attached a license for the current year or remove such tag from any dog Section 9. Any dog brought into the City of Cypress which has not been vaccinated within twelve (12) months prior to the importation, shall be vaccinated within five (5) days from and after its arrival in the City If the imported dog remains in the City for more than five (5) days, the dog shall be licensed in accordance with the pro- visions of this Ordinance. A certificate of vaccination issued by a duly licensed veterinarian from any other jurisdiction for the specific dog establishing vaccination with an approved vac- cine, may be accepted by the Livestock Inspector as evidence of vaccination, providing it be within the interval prescribed by this Section Section 10 No person shall make use of or have in his possession or under his control a stolen, counterfeit, or forged vaccination certificate or license tag. Section 11. In furtherance of the program of the City of Cypress and the County of Orange for vaccination of dogs against rabies, the Livestock Inspector is hereby authorized and directed to a Approve of such vaccine or vaccines as he may find suitable for such use, promulgate his findings and approval, and file a statement of his findings and approval in the office of the County Health Officer as a public record b Change such findings and approval when as a result of experience, research, practice or tests he finds that a new or different vaccine or vaccines are suitable for such use, and -3- Ordinance No 32 file a statement of his findings and approval in the Office of the County Health Officer as a public record c Negotiate with duly licensed veterinarians in order to establish a reasonable fee for the professional veterinary services and rabies vaccination for the dogs of residents of this City, and present a draft of such proposed Agreement to the City Council for their consideration and execution d Prescribe the form of certificate to be used by duly licensed veterinarians under the provisions hereof and to dis- tribute such form of certificate to duly licensed veterinarians practicing in this City and County upon request. e. Distribute to every owner or harborer of any dog within this City the names, addresses, and telephone numbers of all duly licensed veterinarians who have agreed to vaccinate the dogs of such residents for not more than the sum of Two Dollars (2 00) which is to be paid to them as hereinafter provided. Section 12 There shall be added to and collected with the license fee provided by other sections of this Ordinance the sum of Two Dollars (2 00) for each dog owned or harbored by such applicant for a license unless applicant exhibits to the Orange County Poundmaster a certificate complying with the requirements of Section 3 hereof signed by a duly licensed veterinarian certi- fying that the dog has been vaccinated with an approved vaccine within the preceding twelve (12) months Said sum of Two Dollars (2.00) so collected shall be deposited with the County Treasurer at such times and manner as license fees are so deposited pur- suant to contracts, between this City and Orange County. The Livestock Inspector shall report monthly to the County Auditor the names and addresses of the duly licensed veterinar- ians who have within the preceding month vaccinated dogs for which the additional fee of Two Dollars ($2 00) has been col- -4 - Ordinance No. 32 lected at the time of the issuance of the license and who have returned to the Livestock Inspector a completed certificate of vaccination as required by Section 3 hereof, and the number of such vaccinations by each such duly licensed veterinarian Section 13. Promptly upon receipt of such report, the Auditor shall draw his draft on the County Treasurer in favor of each such veterinarian in payment of the amount of Two Dollars ($2 00) for each such vaccination as he shall have made as shown by such report. Section 14. The violation of any of the provisions hereof is hereby declared to be a misdemeanor Any person, firm or corporation upon conviction of a violation thereof shall be punished by a fine of not more than $500.00, nor mare than three months in the County Jail, or by both such fine and imprisonment. Section 15. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be posted in the manner provided by law This ordinance shall take effect thirty days frog► and after the date of its final adoption PASSED AND ADOPTED by the City Council of the City of Cypress at its regular meeting held on the 12th day of November, 1957.
