AN ORDINANCE OF THE CITY OF CYPRESS LICENSING THE TRANSACTION AND
CARRYING ON OF THE BUSINESS OF SELLING TIP SHEETS AND PROVIDING A
PENALTY FOR THE VIOLATION THEREOF
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS'
Section 1
Every person who by any means in the City of Cypress engages in
the business or practice of disseminating, distributing, passing out,
giving away, handing out, selling, offering for sale, or soliciting
for the sale of any sheet, dodger, handbill, circular, letter, booklet,
or any other printed, typewritten, mimeographed or written matter of
any kind, pertaining to any horse race, choice of a horse or horses,
recommending any horse or horses, or giving or conveying any informa-
tion
nforma-tion about any horse, horse race or contest of endurance or speed
between horses or beasts, and whather at a fixed place of business
within said City or otherwise, shall pay a license fee of $10.00 per
thirty day period; provided, however, that the provisions of this
section shall not prohibit, or require a license, or the payment of a
fee, for the sale, distribution or delivery of newspapers of general
circulation, as defined by Section 6000 of the Government Code of the
State of California, nor shall said provisions apply within any racing
enclosure duly licensed by the State of California to conduct horse
racing under and in accordance with the laws of said State relating to
such matters, nor to sales of such materials or items made by a mer-
chant duly licensed by the City of Cypress, provided such sales are
made only inside a building in which his licensed business is conducted
Section 2
No person shall be entitled to act pursuant to such license until
there has been filed with the Chief of Police of the City of Cypress,
the name, address and photograph of the licensee
Section 3.
No person shall disseminate, distribute, pass ou-, give away,
hand out, sell, offer for sale or solicit for the sale of any of said
materials described in the foregoing section (1) upon the city streets

of Cypress The violationof any provision of this section shall in
addition to any other penalty be grounds for the cancellation by the
City Council of any license issued pursuant to this Section.
Section 4.
No person shall sell, solicit for sale or offer for sale any of
said material or materials upon any day unless a true copy of such
material or materials has been filed in the office of the Chief of
Police of said City, at or before 11.00 o'clock A.h of said day.
Upon written application filed with the City Clerk requesting
a license extension (accompanied by the required extension fee) the
City Council of said City niay in its discretion grant an extension of
the thirty day periods referred to herein for an additional thirty
day period immediately following said thirty day j riod; provided
that if said Council grants such thirty day extension an additional
license fee of $10.00 must be paid by licensee for such thirty day
extension No extension shall be valid unless and until such addi-
tional fee is paid.
Section 5
The violation of any of the provisions hereof is hereby declared
to be a misdemeanor Any person, firm or corporation upon conviction
of a violation thereof shall be punished by a fine of not more than
$500.00, nor more than three months in the County Jail, or by both
such fine and imprisonment
Section 6
The City Clerk shall certify to the passage and adoption of this
ordinance and shall cause the same to be posted in the manner provided
by law This ordinance shall take effect thirty days from and after
the date of its final adoption.
