Ordinance No. 39ORDINANCE NO 39 AN ORDINANCE OF THE CITY OF CYPRESS PROHIB- ITING THE RUNNING OF WASTE, IRRIGATION OR OTHER WATERS UPON THE HIGHWAYS AND RIGHTS OF WAY THEREOF IN THE CITY OF CYPRESS THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS Section 1 It shall be and is hereby declared unlawful for any person, firm or corporation to run, or to allow water of any type, whether irrigation, waste or otherwise, to run or flow upon any public highway or right of way thereof within the City of Cypress Section 2 Any person violating the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof punished by a fine not exceeding five hundred dollars or by imprisonment in the county jail not exceeding six months, or by both such fine and imprisonment. Each day that a violation occurs shall be a separate offense Section 3. This Ordinance is urgently required for the immediate preservation of the public peace, health and safety for the reason that the streets and public highways of the City of Cypress have become so seriously destroyed and damaged by water running and flowing upon the highway right of ways as to seriously threaten the very existence of the public street and highway system of the City The City Council there- fore declares that this Ordinance shall take effect as and is adopted as an emergency measure and is to be in full force and effect iuunediately Section 4. This Ordinance shall take effect immediately, and with- in fifteen (15) days shall be posted in three (3) public places Ordinance No 39 -1- in the City of Cypress, together with the names of the mem- bers of the City Council voting for and against the same.
