Ordinance No. 40ORDINANCE NO 40 AN ORDINANCE OF THE CITY OF CYPRESS AMENDING THE ORDINANCE RELATING TO LAND USE AND LAND CLASSIFICATION KNOWN AS ORDINANCE NO 2, ENACTED ON THE 24TH DAY OF JULY, 1956, BY AMENDING SECTION 6.2 AND SECTION 19 OF THE LAND USE ORDINANCE THEREIN ADOPTED BY REFERENCE, AND AMENDING ORDINANCE NO 17 OF THE CITY OF CYPRESS REGULATING THE NUMBER OF COWS PERMITTED IN THE CITY THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS Section 1 Section 6 2, A,1,a of the Orange County Land Use Ord- inance No 351, adopted and enacted by reference as Ordinance No 2 of the City of Cypress, and Ordinance No 17 of the City of Cypress, which heretofore read "a. That the premises contain at least one (1) acre for each ten (10) head in the herd " are now amended to read "a. That if the property occupied by the dairy con- tains less than fifteen (15) acres of land, there shall be no more than ten (10) cows to each acre, unless the dairy is sewered, and then there may be twenty (20) cows to each acre, if the property occupied by the dairy contains fifteen (15) or more acres of land, then there may be twenty (20) cows to each acre " Section 2. _Section 19, a,12, a of the Orange County Land Use Ord- inance No 351, adopted and enacted by reference as Ordinance No 2 of the City of Cypress, and as amended by Ordinance No 17 of the City of Cypress, which heretofore read "a The premises shall contain at least one (1) acre for each ten (10) head in the herd " is now amended to read "a That if the property occupied by the dairy con- tains less than fifteen (15) acres of land, Ordinance No 40 -1- there shall be no more than ten (10) cows to each acre, unless the dairy is sewered, and then there may be twenty (20) cows to each acre, if the property occupied by the dairy contains fifteen (15) or more acres of land, then there may be twenty (20) cows to each acre." Section 3 This Ordinance is urgently required for the immediate preservation of the public peace, health and safety for the reasons that the facilities available for the removal of surface water, barn water or waste water from dairies with- in the City are inadequate to handle the quantities of water that are being discharged from small acreage dairies where a large concentration of cows occurs It is therefore essen- tial that there be more acreage available for dairy operation and disposal of waste water. The City Council, therefore, declares that this Ordinance shall take effect as and is adopted as an emergency measure and shall be in force and effect immediately.
