AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CYPRESS EX OFFICIO BOARD OF DIRECTORS OF THE CYPRESS
RECREATION AND PARK DISTRICT PROVIDING FOR MEETINGS
OF SAID BOARD OF DIRECTORS AND OTHER PROVISIONS RELATIVE
THERETO.
THE CITY COUNCIL OF THE CITY OF CYPRESS, EX OFFICIO BOARD OF DIRECTORS
OF THE CYPRESS RECREATION AND PARK DISTRICT HEREBY DOES ORDAIN AS FOLLOWS.
SECTION 1. MEETINGS
The Board of Directors of the Cypress Recreation and Park District
shall meet at each and every occasion the City Council of the City of Cypress
shall meet Each and every meeting, of any kind whatsoever of said City Council
is and shall be considered, in every respect a meeting of the Board of Directors
of the Cypress Recreation and Park District
SECTION 2. NOTICE OF MEETINGS
Notice of a meeting of the Board of Directors of the Cypress Recreation
and Park District may be provided by giving notice of a meeting of the City Council
of the City of Cypress
SECTION 3: PROCEDURES
The procedures governing the meetings of the Board of Directors of
the Cypress Recreation and Park District shall be the same as those governing
the meetings of the City Council of the City of Cypress
SECTION 4. OFFICERS
A. Chairman.
The Mayor of the City of Cypress is designated and empowered to act
as the chairman of the Board of Directors of the Cypress Recreation and
Park District
B Vice -Chairman.
The Mayor Pro -tem of the City of Cypress is designated and empowered to
act as the Vice -Chairman of the Board of Directors of the Cypress Recreation
and Park District
C Clerk.
The City Clerk of the City of Cypress is designated and empowered to
act as the Clerk of the Board of Directors of the Cypress Recreation and
Park District.
SECTION 5. FACTS CONSTITUTING URGENCY
The City Council of the City of Cypress Ex Officio Board of Directors
of the Cypress Recreation and Park District, hereby declares that the following
facts constitute the urgency requiring this ordinance to take effect immediately
as an urgency ordinance:
Pursuant to Resolution No 70-1178 of the Board of Supervisors
of the County of Orange, the Cypress Recreation and Park District have
become a subsidiary district of the City of Cypress as of July 1, 1971
In order for said district to exercise the powers and perform the duties
set forth in Chapter 4(commencing with Section 5780) of the Division
5 of the Public Resources Code of the State of California, it is neces-
sary and desirable that this ordinance take effect at once.
PASSED AND ADOPTED by the City Council of the City of Cypress Ex Officio
Board of Directors of the Cypress Recreation and Park District,at a regular
meeting held on the 1st day of July 1971

PARK DISTRICT, ADOPTING A PURCHASING SYSTEM AND PROVISIONS
RELATIVE THERETO
THE CITY COUNCIL OF THE CITY OF CYPRESS EX OFFICIO BOARD OF DIRECTORS
OF THE CYPRESS RECREATION AND PARK DISTRICT HEREBY DOES ORDAIN AS FOLLOWS
SECTION 1. ADOPTION OF PURCHASING SYSTEM,
In order to establish efficient procedures for the purchase of supplies
and equipment, to secure for the District supplies and equipment at the lowest
possible cost commensurate with quality needed, to exercise positive financial
control over purchases to clearly define authority for the purchasing function
and to assure the quality of purchases a purchasing system is hereby adopted.
SECTION 2. CENTRALIZED PURCHASING DIVISION
There is hereby created a centralized purchasing division in which
is vested authority for the purchase of supplies and equipment
SECTION 3: PURCHASING OFFICER - POSITION CREATED; APPOINTMENT
There is hereby created the position of purchasing officer He shall
be the same person who holds the position of purchasing officer for the City
of Cypress The purchasing officer shall be the head and have general super-
vision of the purchasing division. The duties of purchasing officer may be
combined with those of any other office or position
SECTION 4. SAME - POWERS AND DUTIES.
The purchasing officer shall have the authority to:
A, Purchase or contract for suppl.es and equipment required by any
using agency in accordance with purchasing prescribed herein, such
administrative regulations as the purchasing officer shall adopt for
the internal management and operation of the purchasing division and
such other rules and regulations as shall be prescribed by the Board
of Directors
B. Negotiate and recommend execution of contracts for the purchase
of supplies and equipment
C Act to procure for the District the needed quality in supplies
and equipment at least expense to the District
D. Discourage uniform bidding and endeavor to obtain as full and
open competition as possible on all purchases
E. Prepare and recommend to the Board of Directors rules governing
the purchase of supplies and equipment for the District.
F Prepare and recommend to the Board of Directors revisions and
amendments to the purchasing rules
G Keep informed of current developments in the field of purchasing,
prices market conditions and new products
H. Prescribe and maintain such forms as are reasonably necessary
to the operation hereof and other rules and regulations
I. Supervise the inspection of all supplies and equipment purchased
to insure conformance with specifications

J Recommend the transfer of surplus or unused supplies and equip-
ment between departments as needed and the sale of all supplies and
equipment which cannot be used by any agency or which become unsuitable
for District use
K Maintain a bidder's list, vendor's catalog file and records
needed for the efficient operation of the purchasing division.
SECTION 5. EXEMPTIONS FROM CENTRALIZED PURCHASING.
The purchasing officer with approval of the Board of Directors may
authorize in writing, any agency to purchase specified supplies and equipment
independently of the purchasing division but he shall require that such purchases
shall be made in conformity with the procedures established hereby and shall
further require periodic records from the agency on the purchases made under
such written authorization.
SECTION 6. ESTIMATES OF REQUIREMENTS
All using agencies shall file detailed estimates of their requirements
in supplies and equipment in such manner at such time and for such future periods
as the purchasing officer shall prescribe.
SECTION 7: REQUISITIONS.
Using agencies shall submit requests for supplies and equipment to
the purchasing officer by standard requisition forms or by other means as
may be established by the purchasing rules and regulations
SECTION 8. BIDDING GENERALLY
Purchases of supplies and equipment shall be by bid procedures pursuant
to Sections 11 and 12 hereof Bidding may be dispensed with.
A. When an emergency requires that an order be placed with the
nearest available source of supply
B. When the amount involved is less than one hundred dollars
C. When the commodity can be obtained from only one vendor
D When there is to be a contract for professional services such
as, but not limited CO the services of attorneys architects or engineers
or where the service contracted for deals with public relations or promo-
tions elections services and related activities negotiations or acquisi-
tion of land, trash, garbage or refuse disposal or the like insurance,
bonds or any other service of a similar nature to those listed
E. When, through cooperative purchasing with the state, the county
and other public agencies the advantages of largescale buying may be ob-
tained at a lower price upon the same terms conditions and specifications
SECTION 9. PURCHASE ORDERS.
Purchases of supplies and equipment shall be made only by purchase
orders Except as otherwise provided herein no purchase order shall be issued
unless the prior approval of the purchasing officer or his designated representa-
tive has been obtained.
SECTION 10: ENCUMBRANCE OF FUNDS
Except in cases of emergency or in .ases where specific authority has
been first obtained from the District manager the purchasing officer shall not
issue any purchase order for supplies or equipment unless there exists an
unencumbered appropriation in the fund account against which said purchase is
to be charged.

SECTION 11. FORMAL CONTRACT PROCEDURE.
Except as otherwise provided herein, purchases of supplies and
equipment of an estimated value greater than two thousand five hundred dollars
shall be by written contract with the lowest responsible bidder pursuant to
the procedure hereinafter prescribed.
A. Notice inviting bids Notices inviting bids shall include a
general description of the articles to be purchased or sold, shall state
where bid blanks and specifications may be secured and the time and place
for opening bids
(1) Published Notice Notices inviting bids shall be published
at least ten days before the date of opening of the bids Notices shall
be published at least once in a newspaper of general circulation, printed
and published in the district, or if there is none, it shall be posted in
at least three public places in the district that have been designated
by ordinance as the places for posting public notices
(2) Bidder s List. The purchasing officer shall also solicit
sealed bids from all responsible prospective suppliers whose names
are on the bidder s list or who have made written request that their
names be added thereto
(3) Bulletin Board The purchasing officer shall also advertise
pending purchases by a notice posted on a public bulletin board in
the district s offices.
B Bidder s security When deemed necessary by the purchasing officer
bidder s security may be prescribed in the public notices inviting bids
Bidders shall be entitled to return of bid security' provided, however
that a successful bidder shall forfeit his bid security upon his refusal
or failure to execute the contract within ten days after the notice of
award of contract has been mailed unless in the latter event the district
is solely responsible for the delay in executing the contract The Board
of Directors, may on refusal or failure of the successful bidder to execute
the contract, award it to the next lowest responsible bidder If the
Board of Directors awards the contract to the next lowest bidder the amount
of the lowest bidder's security shall be applied by the district to the
contract price differential between the lowest bid and the second lowest
bid, and the surplus if any shall be returned to the lowest bidder If
the Board of Directors rejects all bids presented and readvertises the amount
of the lowest bidder s security may be used to offset the cost of receiving
new bids (and the surplus if any shall be returned to the lowest bidder)
C Bid opening procedures Sealed bids shall be submitted to the
purchasing officer and shall be identified as 'bids on the envelope.
Bids shall be opened in public at the time and place stated in the public
notices A tabulation of all bids received shall be open for public inspection
during regular business hours for a period of not less than thirty calendar
days after the bid opening
D Rejection of bids In its discretion, the Board of Directors may
reject any and all bids presented and readvertise for bids pursuant to the
procedure hereinabove prescribed.
E. Award of contract. Except as otherwise provided herein, contracts
shall be awarded by the Board of Directors to the lowest responsible bidder
F Tie bids If two or more bids received are for the same total
amount or unit price, quality and service being equal and if the public
interest will not permit the delay of readvertising for bids, the Board
of Directors may in its discretion accept the one it chooses or accept the
lowest bid made by and after negotiation with the tie bidders at the time
of the bid opening
G Performance bonds The Board of Directors shall have authority to
require a performance bond before entering a contract in such amount as it
shall find reasonably necessary to protect the best interests of the

district If the Board of Directors requires a performance bond, the form
and amount of the bond shall be described in the notice inviting bids
SECTION 12. OPEN MARKET PROCEDURE.
Purchases of supplies and equipment of an estimated value in the amount
of two thousand five hundred dollars or less may be made by the purchasing
officer in the open market pursuant to the procedure hereinafter prescribed and
without observing the procedure prescribed in Section 11, provided, however all
bidding may be dispensed with for purchases of supplies and equipment having
a total estimated value of less than one hundred dollars
A. Minimum number of bids. Open market purchases shall, wherever
possible, be based on at least three bids and shall be awarded to the
lowest responsible bidder
B. Notice inviting bids The purchasing officer shall solicit bids
by written requests to prospective vendors, by telephone and by public
notice posted on a public bulletin board in the district s offices
C. Written bids Sealed written bids shall be submitted to the
purchasing officer who shall keep a record of all open market orders
and bids for a period of one year after the submission of bids or the placing
of orders. This record, while so kept, shall be open to public inspection.
SECTION 13. INSPECTION AND TESTING
The purchasing officer shall inspect supplies and equipment delivered
to determine their conformance with the specifications set forth in the order

tests of samples submitted with bids and samples of deliveries which are neces-
sary to determine their quality and conformance with bids and samples of deliveries

SECTION 14. DISPOSITION OF SURPLUS SUPPLIES AND EQUIPMENT
All using agencies shall submit to the purchasing officer at such times
and in such forms as he shall prescribe, reports showing all supplies and equip-
ment which are no longer used or which have become obsolete or worn out The
purchasing officer shall have authority to exchange for or trade in on new sup-
plies and equipment all supplies and equipment which cannot be used by any
agency or which have become unsuitable for district use. Such sales shall be
made pursuant to Section 11 or 12 whichever is applicable.

OF CYPRESS ACTING AS THE EX OFFICIO GOVERNING
BOARD OF DIRECTORS OF THE CYPRESS RECREATION
AND PARK DISTRICT ESTABLISHING RULES AND
REGULATIONS FOR ALL PARK AND RECREATIONAL
AREAS OWNED MANAGED OR CONTROLLED BY THE
CYPRESS RECREATION AND PARK DISTRICT
The City Council of the City of Cypress acting as the Ex
fficio Governing Board of Directors of the Cypress Recreation
.and Park District does hereby ordain as follows
Section 1 The following Rules and Regulations shall
Tavern the operation of all park and recreational areas owned
managed or controlled by the Cypress Recreation and Park District
and are adopted pursuant to Section 5782 21 of the Public Resources
Code of the State of California
RULES AND REGULATIONS GOVERNING THE USE
OF PUBLIC PARKS RECREATION AREAS AND
FACILITIES
1 DEFINITIONS - For the purposes of these Rules and Regulations
the following terms shall have the respective meanings set forth
herein
DIRECTOR 'Director' means the Director of the Cypress
Recreation and Park District
DISTRICT District means the Cypress Recreation and Park
District
PERSON 'Person includes every person firm, corporation
partnership joint venture association social
club fraternal organization or any other group
or combination acting as a unit
2 HOURS OF USE - No person shall enter loiter or remain in or around
an' park building or recreation area at any time between the hours
of 10 00 o clock p m. and 6 00 o clock a m. unless permission is
granted b' responsible District personnel
3 CARE OF FOLIAGE, LANDSCAPE AND STRUCTURES - No person shall pick
transplant remove or damage any tree or plant or seeds of any
tree or plant or cut carve hack break dig up remove deface
or in an} way mutilate or injure any wood leaf mold rock gravel
sand tree shrub plant fern grass or turf or attach any
rope wire or other object to any tree or plant No person shall
mark disfigure tamper with displace or remove any building
tabl bench fireplace railing fencing paving or paving materia

water line or other public utility or part or appurtenance
thereof sign notice placard whether temporary or permanent
monument stake post or other boundary marker or other structure
or equipment facility or park property or appurtenance whatso-
ever real or personal
4 CLIMBING TREES OR OTHER OBJECTS - No person shall climb any tree
or walk stand or sit upon any monument vase fountain railing
fence or upon other property not customarily used for such purposes
5 RESTROOMS AND WASHROOMS - Public toilets in recreational areas are
provided for the protection of the health of the general public
and all persons shall cooperate in maintaining said restrooms
and washrooms in a neat and sanitary condition Male persons
shall not resort to any restroom and washroom facilities set apart
for women and female persons shall not resort to restroom and
washroom facilities set apart for men provided that this shall
not apply to children under the age of five (5) accompanied by an
adult person
6 REFUSE, TRASH AND LITTER - No person shall dump deposit drop
scatter or leave any bottles broken glass ashes paper boxes
cans garbage litter rubbish refuse or offal matter in any
nark or recreational area except in a designated trash receptable
provided therefore
7 POSSESSION OF FIREARMS - No person other than peace officers in
the discharge of their official duties shall possess carry or
use any fireworks firearms air guns BB guns spring guns
bows and arrows sling shots or any other form of weapon
potentially inimical to wild life and dangerous to human safety
No person shall discharge any fireworks or weapon upon or into
any park or recreation area
VENDING AND COMMERCIAL SOLICITATION - No person shall solicit
primarily for commercial purposes in any manner or sell or offer
for sale any goods wares merchandise food products tickets for
dances or any other event whatsoever or distribute circulate
give away throw or deposit in or on any park or recreation area
any primarily commercial handbills circulars pamphlets
papers or advertisements or post or affix the same to any tree
fence or structure in any park or recreation area without prior
written approval of the Director
9 BICYCLES AND OTHER CONVEYANCES - No person shall operate or drive
an automobile bicycle motor -driven cycle motorcycle truck
trailer wagon motor scooter or other conveyance on other than
roads or paths designated for that purpose except for law enforce-
ment lifesaving or emergency purposes and a bicyclist who ma'
wheel or push a bicycle by hand over any grassy area or trail or
path reserved for pedestrian use
No person shall operate or drive an automobile bicycle motor -
driven cycle motorcycle truck trailer wagon motor scooter

or other conveyance in any park or recreational area at a speed
that is greater than is reasonable or prudent with regard to the
safety of others and in no event in excess of ten (10) miles per
hour except for law enforcement lifesaving or emergency purposes
unless a greater speed is posted
No person shall park any conveyance described herein except in
designated parking areas and no such conveyances shall be left
unattended in any place or position where other persons may trip
over or be injured by them.
No person shall operate or drive any unlicensed automobile bicycle
motordriven cycle motorcycle truck trailer wagon motor
scooter or other conveyance in any park or recreation area
No person shall repair any conveyance described herein within any
park or recreation area except for law enforcement or emergency
purposes
No person shall wash any conveyance described herein within any
park or recreation area
10 LOITERING AND BOISTEROUSNESS - No person within the limits of
any park or recreational area shall maliciously or willfully
disturb the peace or quiet of said park or area or of any person
therein by loud or unusual noise or by tumultuous or offensive
conduct or by threatening traducing quarreling challenging to
fight or fighting with other persons No person in any park or
recreation area shall use any vulgar profane or indecent language
11 DOMESTIC ANIMAL REGULATION - No person having custody of a cat
dog or other domestic animal shall bring carry transport or
allow such animal onto the land owned managed or controlled by
the District unless such animal is restrained at all times by a
secure leash A cat dog or other domestic animal is securely
leashed within the meaning of this section when said animal is
securely tied or otherwise fastened or attached to one end of a
chain cord rope or other restraining device the other end of
which is either securely attached to a stationary object or
retained in the possession of some person or securely attached to
any other object which prevents the animal from running at large
No cat dog or other domestic animal shall be permitted at
swimming pools within land owned managed or controlled by the
District Dogs may be permitted to run free in areas which from
time to time may be set aside by the Director for the specific
purpose of exercising dogs provided however that the owner or
keer r of the dog keeps it under control at all tilling and ti,m
not allow the dog to go beyond the boundaries of th. -v a set
aside No owner or other person having the charge custody or
control of any dog shall permit either willfully or through
failure to exercise due care any such dog to defecate and to
allow any such feces to remain on any park and recreational
areas owned managed or controlled by the Cypress Recreatio:
and Park District
12 LIVESTOCK AND HORSES - No person having custody or control of
a horse or other saddle or pack animal shall allow said animal
in any part of a park or recreation area except upon such roads
or bridle trails as the Director may from time to time specifically

designate for equestrian traffic No person shall ride a horse
or other saddle or pack animal which is not well broken within
any park or recreation area and no person shall ride any such
animal in any manner that endangers any other person or animal No
person shall allow any horse or other saddle or pack animal to stand
unattended or improperly tied.
No person shall permit cattle sheep goats horses or any other
animal to graze on land owned managed or controlled by the District
13 FIRE REGULATION - No person other than one acting under the
authorization direction or permission of the Director shall
build light kindle or maintain any open or outdoor fire at
any place within the boundaries of land owned managed or controlled
b, the District except in areas or facilities specifically built
and designated for such purposes
14 ALCOHOLIC BEVERAGES - No person within the boundaries of any land
owned managed or controlled by the District shall consume sell
purchase serve or cause to be served give away or have in his
or her possession any alcohol spirits liquor wine beer or
other liquid or solid containing one-half of one percent or more of
alcohol by volume and which is fit for beverage purposes either
alone or when diluted mixed or combined with other substances
Exceptions to the rule will be referred to the Director of Recreation
and Parks and shall be in accordance with the policies established
by the City Council
15 KEYS AND LOCKS - No person other than one acting under the
authorization direction or permission of the Director shall
duplicate any key used by the District for padlocks door locks
or locks of and type or description
16 GAMBLING - No gambling or betting of any kind or description shall
be permitted within the boundaries of any land owned managed or
controlled by the District
17 GOLF, HARDBALL, AND MODEL CRAFT - No person shall drive putt or
in an, other fashion play or practice golf or use golf balls on
land owned managed or controlled by the District except in areas
that ma, be set aside by the Director for these specific activities
No person shall bat throw catch or in any other fashion play
or practice hardball or use hardballs on land owned managed or
controlled by the District except in areas that may be set aside
b' the Director for these specific activities
No person shall fly model airplanes on or over or operate model
airplanes or model craft of any description on land owned managed
or controlled by the District except in areas that may be set aside
by the Director for these specific activities
18 ATHLETIC ACTIVITIES - No person shall conduct or participate in
an; sport or game or in any organized athletic activities within
any recreational area other than in such areas as may be designated

for such sports games or athletic activities No person shall
wear footgear that will damage Injure or create the need for
excessive maintenance on any field court deck floor turf or
specialized surface prepared for particular games or activities
In areas posted with a sign specifying footgear authorized or
approved no person shall enter any such area in other than the
prescribed footgear
19 SWIMMING POOL FACILITIES - No person shall enter upon any swimming
pool or dressing room connected therewith at any time when no
employee of the Recreation Division of the District or other
attendant authorized by said Division is on duty at said pool

provisions of the Rules and Regulations set forth

The Rules and Regulations set forth herein shall be enforced by the
Director of the District and such of their agents as they or either of
them may designate to perform said duty as well as by peace officers
having jurisdiction of any area in which a violation of any provision
of said Rules and Regulations may take place
Violation of any provision of the Rules and Regulations set forth
herein shall subject the violator to election from the premises of
the park or recreation area in which the violation occurs for a period
of two weeks or for a longer period as determined by the Director of
Recreation and Parks
A knowing and willful violation of any provision of the Rules and
Regulations set forth herein is a misdemeanor punishable b' fine not to
exceed One hundred Dollars ($100 00) or by imprisonment in the Count\
Jail for not to exceed one month or both (Public Resources Code of
the State of California Section 5782 24)
Section 3 If any section paragraph sentence clause
phrase or portion of the Rules and Regulations set forth herein is for
any reason held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction such decision shall not affect
the validit' of the remaining portions of said Rules and Regulations
The City Council of the City of Cypress acting as the Board of
Directors of the District hereby declares that it would have adopted
these Rules and Regulations and each section paragraph sentence
clause phrase or portion thereof irrespective of the fact that an}
one or more sections paragraphs sentences clauses phrases or
portions be declared invalid or unconstitutional
FIRST READ at a regular meeting of the City Council of
said City held on the 27th day of March 1978 and finally adopted
and ordered posted at a regular meeting of said Council held

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
ACTING AS THE EX -OFFICIO GOVERNING BOARD OF DIRECTORS
OF THE CYPRESS RECREATION AND PARK DISTRICT AMENDING
ORDINANCE NO 3 OF SAID DISTRICT PROHIBITING GLASS
CONTAINERS IN PARKS
The City Council of the City of Cypress acting as the ex -officio
governing Board of Directors of the Cypress Recreation and Park District
DOES HEREBY ORDAIN as follows
SECTION 1 Subsection 6 of Ordinance No 3 of the District hereby
is amended to read as follows
6. REFUSE, TRASH AND LITTER; GLASS CONTAINERS - No person
shall dump deposit drop scatter or leave any bottles
broken glass ashes paper boxes cans garbage litter
rubbish refuse or offal matter in any park or recreational
area except in a designated trash receptahle provided there-
fore No person shall possess use consume a beverage from,
abandon, or break any glass container in any park or recrea-
tional area.
SECTION 2 Severability. If any section paragraph, sentence clause
phrase or portion of this ordinance or the application thereof to any person
or place is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance or its application to
other persons or places The City Council, acting as the ex -officio governing
Board of Directors of the Cypress Recreation and Park District hereby declares
that it would have adopted this ordinance and each section subsection, sub-
division, sentence clause, phrase or portion thereof irrespective of the
fact that any one or more sections, subsections subdivisions sentences
clauses, phrases or portions, or the application thereof to any person or
place be declared invalid or unconstitutional.
SECTION 3 The City Clerk is authorized and directed to certify as to
the passage of this ordinance and to give notice thereof by causing copies
of this ordinance to be posted in three public places within the City
FIRST READ at a regular meeting of the City Council of said City held on
the 23rd day of November 1981 and finally adopted and ordered posted at a
regular meeting of said City Council held on the 14th day of December 1981.
