CRPD Resolutions No. 1-501 RESOLUTION NO. 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, EX OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK DISTRICT, A SUBSIDIARY DISTRICT OF THE CITY OF CYPRESS, RE PERSONNEL AND SALARIES THE CITY COUNCIL OF THE CITY OF CYPRESS, EX OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK DISTRICT HEREBY DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS WHEREAS, the City Council of the City of Cypress has made application to the Local Agency Formation Commission of Orange County for the establishment of the Cypress Recreation and Park District as a subsidiary district of the City of Cypress pursuant to the District Reorganization Act of 1965 by Resolution No 1067 and WHEREAS, the Local Agency Formation Commission of the County of Orange approved said change of organization and the Board of Supervisors of Orange County conducted proceedings for such change or organization and on November 4, 1970, adopted Resolution No 70-1178 which established the Cypress Recreation and Park District as a subsidiary district of the City of Cypress effective July 1, 1971, and WHEREAS, the Cypress Recreation and Park District is now a subsidiary district of the City of Cypress and the City Council of the City of Cypress acts ex officio as the Board of Directors of the Cypress Recreation and Park District is the governing board of said district. NOW, THEREFORE, the City Council of the City of Cypress Ex Officio Board of Directors of the Cypress Recreation and Park District hereby does resolve as follows SECTION 1. All employment contracts of the Cypress Recreation and Park District in existence at this time shall be continued SECTION 2. The personnel and salary resolution for the fiscal year 1970-71 of the County of Orange on file in the office of the City Clerk and by this reference incorporated herein is hereby adopted as modified by Section 3 SECTION 3: The personnel and salary resolution of the County of Orange for the fiscal year 1970-71 on file in the office of the City Clerk shall be deemed modified by those documents collectively on file in the office of the City Clerk and by this reference incorporated herein and known as Personnel and Salary documents, which documents describe the present terms and conditions of employment of said employees immediately prior to the Cypress Recreation and Park District becoming a subsidiary district these documents shall be deemed effective until further action is taken by the City Council of the City of Cypress Ex Officio Board of Directors of the Cypress Recreation and Park District. That. SECTION 1. That the City Council of the City of Cypress requests the Orange County Park Regional Advisory Committee, Orange County Planning Commission, and the Orange County Board of Supervisors to support Amendment 1/3 to the Master Plan of Regional Parks designating Los Coyotes Site, now placed in priority Group No 1, and urging early negotiation with the State Highway Department for the release of this site, or at least portions of it, as soon as possible, for park development and use of any available funds, including those from the State and Federal Governments, to acquire and develop this park site as soon as possible. (a) The first step is the minimum rate and is normally the hiring rate for the class. An employee may be assigned upon appointment to other than the normal entering salary step upon the recommendation of the General Manager when it is decided that such action is in the best interests of the District. (b) The second step is an adjustment which may be given upon completion of six months of service The adjustment shall be made only if recommended by the Department Head and if approved by the General Manager (c) The third, fourth and fifth steps are incentive adjustments to encourage an employee to improve his work and to recognize seniority and increased skill on the job Employees are normally eligible for these adjustments any time after the completion of one year of service at the preceding step Each adjustment shall be made only if recommended by the Depart- ment Head and, if approved by the General Manager (d) All rates shown are in full payment for services rendered and cover full payment for the number of hours now being regularly worked in each class. NOW, THEREFORE, the City Council of the City of Cypress ex officio Board of Directors of the Cypress Recreation and Park District, does hereby resolve as follows SECTION 1. General Tax Rate There is hereby levied a tax in the amount of Forty-eight and seven -tenths Cents ($.487) for each One Hundred Dollars ($100 00) of all of the taxable property within the Cypress Recreation and Park District at the equalized value thereof for the 1973/74 Fiscal Year SECTION 2 Special Tax Rate. In addition to the general tax rate established by Section 1 of this Resolution, there hereby is levied a special tax rate in the amount of Eight Cents ($.08) for each One Hundred Dollars ($100.00) of all of the taxable property within the Cypress Recreation and Park District at the equalized value thereof for the 1973/74 Fiscal Year SECTION 3 The City Clerk shall cause certified copies of this Resolution to be filed with the Auditor Assessor and Tax Collector of the County of Orange immediately upon its adoption. Shall the Cypress Recreation and Park District incur a bonded indebtedness in the principal sum of $2 750,000 for the purpose of the acquisition of real property for park sites and the construction of park improvements and public recreational facilities, including a community recreation center building, equipment furnishings, and other property necessary or convenient for any of the foregoing, and all expenses incidental to or connected with the authorization, issuance and sale of the bonds? and WHEREAS, said proposition received the affirmative vote and assent of more than two-thirds of all of the qualified voters of said District voting on said proposition, and said District is now authorized to issue bonds in the amount and for the purpose set forth in said proposition, and WHEREAS, it is desirable that $2 750,000 of said authorized bonds be issued and sold NOW THEREFORE, the City Council of the City of Cypress, ex officio Board of Directors of the Cypress Recreation and Park District DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows SECTION 1 Authorization of Bonds That bonds of the Cypress Recreation and Park District in the principal sum of $2,750,000 be issued and sold for the purpose set forth in the bond proposition in the recitals hereof Said bonds shall be designated 'Cypress Recreation and Park District, 1973 Bonds Said bonds shall be payable in consecutive numerical order on November 1, in the amounts for each of the several years as hereinafter set forth. Payment of interest on the coupon bonds due on or before maturity of such bonds shall be made only upon presentation and surrender of the coupons representing such interest as the same respectively fall due. The fully registered bonds shall be dated as of November 1, 1973 and shall bear interest from the interest payment date next preceding the date of authentication thereof unless such date of authentication is an interest payment date, in which event they shall bear interest from such date of authentication, or unless such date of authentication is prior to the first interest payment date, in which event they shall bear interest from November 1, 1973; provided, however that if at the time of authentication of any fully registered bond,interest is in default on outstanding bonds, such fully regis- tered bond shall bear interest from the interest payment date to which interest has previously been paid or made available for payment on the outstanding bonds Payment of the interest on any fully registered bond shall be made to the person appearing on the bond registration books of the principal paying agent as the registered owner thereof, such interest to be paid by check or draft mailed to the registered owner at his address as it appears on such registration books or at such address as he may have filed with the principal paying agent for that purpose. SECTION 2 Execution of Bonds The bonds shall be executed on behalf of the District with the facsimile signature of the presiding officer of the District Board and by the manual signature of the Treasurer of the District The coupons to be annexed to the bonds shall bear the facsimile signature of the Treasurer of the District The seal shall be placed on each bond provided that such seal may be in the form of a facsimile of the District's seal and may be imprinted or impressed upon the bonds. In case any of the officers who shall have signed or attested any of the bonds shall cease to be such officer or officers of the District before the bonds so signed or attested shall have been authenticated or delivered by the principal paying agent or issued by the District, such bonds may never- theless be authenticated, delivered and issued and, upon such authentication, delivery and issue, shall be as binding upon the District as though those who signed and attested the same had continued to be such officers of the District, and also any bond may be signed and attested on behalf of the District by such persons as at the actual date of the execution of such bond shall be the proper officers of the District although at the nominal date of such bond any such person shall not have been such officer of the District Only such of the fully registered bonds as shall bear thereon a certificate of authentication in the form hereinbefore recited, dated and executed by the principal paying agent, shall be valid or obligatory for any purpose or entitled to the benefits of this Resolution, and such certificate of the principal paying agent shall be conclusive evidence that the bonds so authenticated have been duly authenticated and delivered hereunder and are entitled to the benefits of this Resolution. The principal paying agent shall, prior to the delivery by it of each coupon bond, detach and cancel all coupons thereto appertaining then mam:red and shall deliver the same to or upon the order of the District SECTION 3 Transfer of Coupon Bonds and Coupons All coupon bonds and coupons shall be negotiable and transferable by delivery The District and any paying agent may treat the bearer of any coupon bond, whether or not such bond shall be overdue, and the bearer of any coupon, whether or not such coupon shall be overdue, as the absolute owner of such bond or coupon for the purpose of receiving payment thereof and for all other purposes whatsoever and the District and any paying agent shall not be affected by any notice to the contrary SECTION 4 Transfer of Fully Registered Bonds 61 Any fully registered bond without coupons may in accordance with its terms, be transferred, upon the bonds required to be kept pursuant to the provisions of Section 6, by the person in whose name it is registered, in person or by his duly authorized attorney upon surrender of such fully registered bond for cancellation, accompanied by delivery of a written instrument of transfer in a form approved by the principal paying agent, duly executed Whenever any bond shall be issued under this Resolution as a fully regis- tered bond without coupons there shall be reserved by the principal paying agent unissued an aggregate principal amount of coupon bonds of the same series and maturity and of the denomination of $5,000, equal to the principal amount of such registered bond, and in such case the serial number or numbers of the coupon bond or bonds so reserved, together with an appropriate statement as to such reservation, shall be endorsed on such registered bond Whenever any fully registered bond or bonds without coupons shall be surrendered for transfer the District shall execute and the principal paying agent shall authenticate and deliver a new fully registered bond ox bonds of the same series and maturity for like aggregate principal amount, which shall have endorsed thereon the same coupon bond serial number or numbers so reserved No transfers of fully registered bonds shall be required to be made during the fifteen (15) days next preceding each interest payment date SECTION 5 Exchange of Bonds Fully registered bonds without coupons may be exchanged at the office of the principal paying agent for a like aggregate principal amount of coupon bonds (or for a like aggregate principal amount of fully registered bonds of other authorized denominations) of the same series and maturity and coupon bonds may be exchanged at said office of the principal paying agent for a like aggregate principal amount of fully registered bonds of authorized denominations of the same series and maturity All coupon bonds surrendered for exchange and delivered in exchange shall have attached thereto all immatured coupons appertaining thereto (together with any matured coupons in default appertaining thereto) The principal paying agent shall preserve coupon bonds surrendered to it for exchange, and may subsequently reissue said coupon bonds in exchange for a like aggregate principal amount at fully registered bonds, as hereinabove provided, after detaching all matured interest coupons appertaining thereto The District may charge a sum not exceeding the maximum amount permitted by law for each new bond issued upon exchange except as hereinafter provided No charge shall be made to any holder of bonds initially delivered in coupon form for exchanging such bonds in coupon form for bonds in fully registered form, and no charge shall be made to any registered owner of bonds initially delivered in fully registered form for exchanging such bonds in fully registered form for bonds in coupon form. The foregoing sentence shall not apply to later exchanges when the bonds pre- sented for exchange are not those initially delivered, but have been delivered in a previous exchange or transfer For any exchange the principal paying agent shall also require the payment by the bondholder requesting such exchange of any tax or other governmental charge required to be paid with respect to such exchange. Competitive Coach 236/month 2nd Asst Competitive Coach 158/month 3rd Asst Competitive Coach 105/month SECTION 5 Compensation of Overtime Subject to approval of the Gen 1.Managerand to the following provisions, a department head may prescribe reasonable periods of overtime work to meet the operational needs of his department Except as otherwise provided herein, overtime shall either be paid at one and one-half times the hourly equivalent of the employee s monthly salary rate or granted as one and one-half times thei equivalent compensatory time off The method of compensation shall be at the discretion of the department head, aUbject to the approval of the General Manager (a) Incidental Overtime. Incidental overtime is not compensable. It is defined as overtime of less than one-half hour that is non -recurrent and which is not standby duty or call-back duty (b) Management Personnel Department heads or Division heads, designated by the City Manager shall not be eligible for paid overtime. Compensatory time off for work beyond the normal work week may be granted at the dis- cretion of the General Manager (c) Other Employees. Other employees shall be paid at one and one-half times the hourly rate established for their class based on the number of hours actually worked or granted compensatory time off Temporary or seasonal q2 SECTION 5: Compensation of Overtime (Continued) employees are not eligible to receive compensation for overtime. (d) Jury Duty Permanent and probationary employees required to report for jury duty shall be granted leave for such purpose, upon presentation of jury notice to the department head. Said employees shall receive full pay for the time served on a jury provided he submits any fees received for such duty to the Finance Department. Compensation for mileage, subsistence or similar auxiliary allowances shall not be considered as a fee and shall be returned to the employee by the Finance Department. SECTION 6. Educational Incentive Pay Under the provisions of the Educational Incentive Pay plan, all non -management permanent District employees shall be compensated, upon successful completion of each approved course, in the amount of $1.00 per mouth per college unit or equivalent, to a maximum of $30 per month. All non -management permanent District employees obtaining Associate, Bachelor's Master s or other advanced degrees from accredited colleges or universities shall be compensated by the following schedule. Associate degree - 5% Bachelor's degree - 71/2%, Master s degree - 10% CONDITIONS The above payment compensation shall be based on achievements over and above the job requirements established in the Position Classification Plan for each class. Payment to employees will be based on the highest achievement level only i.e. employees with an Associate degree and Bachelor's'degree will receive compensation for the Bachelor's degree only All payments under this provision are subject to verification and approval by the Geni.Manager or his designate SECTION 7 Sick Leave Payment Payment of accumulated sick leave shall be granted by the Gen'l Manageron an annual basis at the rate of fifty percent (50%) per annual sick leave accumulation to all permanent full-time employees with over sixty (60) days or four hundred eighty (480) hours of sick leave credit The payment of said ;eave shall be made on a date as specified by the Gen'l Manager The 50% annual sidk leave accumulation remaining after payment shall continue as a credit to the employee s sick leave account To qualify for annual payment of accumulated sick leave, employees must have a minimum of four hundred eighty (480) hours of unused sick leave on record on December 1st which is determined to ne the beginning of each annual payment period Upon death, retirement separation or termination of a permanent full-time employee, with a minimum of sixty (60) days or four hundred eighty (480) hours of sick leave accumulation, said employee is entitled to receive fifty percent (50%) compensation for that accumulated sick leave. SECTION 8. Pay Periods and Pay Days. All officers and employees of the Cypress Recreation and Park District shall be paid on a bi-weekly basis. The bi-weekly salary of each employee shall be the monthly salary multiplied by twelve, and divided by twenty-six. Warrants or checks in payment of compensation shall be made available by the District to employees and officers of the District on the Friday following the completion of each bi-weekly pay period. In the event that a pay day falls on a holiday all warrants or checks in payment of compensation shall be made available to the District employees on the first day preceding the holiday SECTION 9 Computation of Advancement Dates Employees in permanent positions shall have a merit increase eligibility date which shall be the first day of the pay period following the completion of six months of service within that class. Subsequent mt git increase eligibility dates shall be the first day of the pay period following the completion of one year's additional service, subject to the recommendation of the Department Head and approval of the General Manager SECTION 10 This Resolution shall become effective on January 4 1974 and all resolutions and parts of resolutions in conflict herewith are hereby rescinded. Cook, 18 years old, was employed in June 1974 as an Aquatic Locker Room Attendant; and WHEREAS Mr Cook received his Water Safety Instructor Certificate, and WHEREAS Mr Cook voluntarily attended 32 hours of non -required pre -service training for Locker Room Attendants which included artificial resuscitation, cardio -pulmonary resuscitation and use of a resuscitator' and WHEREAS, Mr Cook was promoted to Aquatic Instructor requiring such training; and WHEREAS, Mr Cook, while off duty was playing handball on Tuesday August 20 1974 at Cypress College when Mr Devon Showley Cypress College instructor suffered a heart attack while playing handball, and WHEREAS, Mr Cook immediately went to Mr Showley s aid, administering cardio -pulmonary resuscitation for more than 15 minutes, and WHEREAS upon arrival at the scene the para -medic personnel stated that Mr Showley would not have survived without Mr Cook s immediate and constant resuscitation. CLASS TITLES Music Instructor Sports Official SECTION 5 Compensation of Overtime $ 5.63/hour $ 7.50/game Subject to approval of the General Manager and to the f flowing provisions, a department head may prescribe reasonable periods of overtime work to meet the operational needs of his department. Except as otherwise provided herein, overtime shall either be paid at one and one-half times the hourly equivalent of the employee s monthly salary rate or granted as one and one-half times the equivalent compensatory time off in compliance with Fair Labor Standards Act provisions, The method of compensation shall be at the discretion of the department head, subject to the approval of the General Manager (a) Management Personnel. Department heads cr Division heads, designated by the General Manager shall not be eligible for paid overtime, Compensatory time off for work beyond the normal work week may be granted at the discretion of the General Manager (b) Other Employees. Other employees shall be paid at one and one-half times the hourly rate established for their class based on the number of hours actually worked or granted compensatory time off in compliance with the Fair Labor Standards Act provisions. (c) Jury Duty Permanent and probationary employees required to report for jury duty shall be granted leave for such purpose, upon presentation of Jury notice to the department head. Said employees shall receive full pay for the time served on a Jury provided he submits any fees received for such duty to the Finance Cepartment Compensation for mileage, subsistence or similar auxiliary allowances shall not be considered as a fee and shall be returned to the employee by the Finance Department. SECTION 6. Educational Incentive Pay Under the provisions of the Educational Incenti,e Pay plan, all non -management permanent District employees shall be compensated, upon successful completion of each approved course, in the amount of $1.00 per m_v.h per cillege unit or equivalent, to a maximum of $30 per month. All non -management permanent District employees obtaining Associate, Bachelor s Master s or other advanced degrees from accredited colleges or universities shall be compensated by the following schedule Associate degree - 5%, Bachelor's degree - 71/2%, Master a degree - 109 CONDITIONS The above payment compensation shall be based on achievements aver and above the job requirements established in the Position Classification Plan for each class. Payment to employees will be based on the highest achievement level only i.e. employees with an Associate degree and Bachelor's degree will receive compensation for the Bachelor's degree only All payments under this provision are subject to verification and approval by the Geni.Manager or his designate SECTION 7 Sick Leave Payment Payment of accumulated sick leave shall be granted by the Gen 1 Manager m an annual basis at the rate of fifty percent (50%) per annual sick leave accumulation to all permanent full-time employees with over sixty (60) days or four hundred eighty (480) hours of sick leave credit The payment of said leave shall be made on a date as specified by the Gen'l Manager The 50% annual silk leave accumulation remaining after payment shall continue as a credit to the employee s sick leave account To qualif, Lot annual payment of accumulated sick leave, employees must have a minimum of four hundred eighty (480) hours of unused sick leave on record on December 1st which is determined to ne the beginning of each annual payment period Upon death, retirement separation or termination of a permanent full-time employee, with a minimum of sixty (60) days nr four hundred eighty (480) hours of sick leave accumulatlr said employee is entitled to receive fife percent (502) compensation for that accumulated sick leave. SECTION 8 Pay Periods and Pay Days. All officers and employees of the Cypress Recreation and Park District shall be paid on a bi-weekly basis. The bi-weekly salary of each employee shall be the monthly salary multiplied t twelve, and divided by twenty-six. Warrants or checks in payment of compensation shall be made available by the District to employees and officers of the District on the Friday following the completion of each bi-weekly pay period. In the event that a pay day falls on a holiday all warrant or checks In payment of compensation shall be made available to the District employees on the first day preceding the holiday - 5 411 SECTION 9 Computation of Advancement Dates Employees in permanent positions shall have a merit increase eligibility date which shall be the first day of the pay period following the completion of six months of service within that class.
