Ordinance No. 273ORDINANCE NO. 273 fil AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS A/ENDING ORDINANCE NO. 90 THE ZONING ORDINANCE, PART 13 IN TOTAL, TO PROVIDE FOR A NEW 'C-3' COMMERCIAL [IRNFACPURING ZONE THE CITY COUNCIL OF TIIE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS Section 1 Part 13 of Ordinance No. 90 the Zoning Ordinance of the City of Cypress is hereby amended to read as follows 'PART 13 COMMERCIAL -MANUFACTURING ZONE (C-3 ZONE) Section 113.1 DESCRIPTION AND PURPOSE The C-3 Commercial Manufacturing Zones are intended as locations for the establishment of combined commercial and limited light manufacturing enterprises wherein presale fabrication and retail or wholesale operations may occur within or upon the same structure or lot or combination thereof Section 113.2 PERMITTED BUILDINGS AND USES Only the following buildings structures and uses, either singly or in combination, are permitted in the C-3 Commercial -Manufacturing Zone. No building or structures shall be erected, structurally altered or enlarged except for the following purposes No uses shall be permitted hereunder which include the service of alcoholic beverages unless a Conditional Use Permit approved by the City Council is obtained therefor A. Animal Hospitals. B. Automobile parts and accessories sales retail and wholesale C. Automobile service stations super service stations. D. Automobile trailer truck sales rental storage and servicing Automobile storage subject to obtaining conditional use permit. F. Bakery sales and baking. P Banks G. Battery shops sales and servicing. H. Bicycle shops sales and repair I. Bluepringint and repoduction shops 7 Boat building, under 28 -foot hull lenght. K. Bottling. L. Building materials retail, wholesale and storage M. Business Colleges. Cabinet shons O Candy manufacture and sales P Carpet cleaning plants Q. Ceramics manufacturing (subject to Conditional Use Permit) B. Ceramics sales S. Cleaners and dyers with supporting facilities T. Cocktail lounges h bars (subject to Conditional Use Permit) U. Cold Storage. ✓ Commercial recreation. P. Contractor yards. S. Cosmetic goods, toiletries and drugs manufacturing, storage and sales. Y Dairy products sales storage and bottling. Z. Electrical applicances sales assembly and repair AA. Equipment rental services BB. Exhibit balls for commercial and industrial exhibits CC. Fabrication from the following. Shell, cellophane cork fiber fur, glass leather (finished) metals or gems paint (mixing only), rubber (finished) textiles tobacco, wood. Ordinance No. 273 DD. Greenhouses commercial II. Gymnasiums JJ Locksmiths RK Lodges & clubs (subject to a Conditional Use Permit) LL. Mechanical auto wash. PCI. Nursery sales. NN Picture framing and glazing. 00. Plumbing shops. PP Poultry dresdbng and sales (subject to Conditional Use permit) QQ. Precision instrument manufacturing. RR Printing establishments SS Radio and television studies. TT Restaurants UU T.re recapping (subject to Conditional Use Permit) VV Warehouses WW Welding shops XX. Wholesale and factory outlets Section 113.3 OTHER PERMITTED BUILDINGS AND USES Any such other buildings and uses as the Commission, after a public hearing, may determine and find, as a fact to be similar to those listed in the section immediately preceding, shall be permitted in a C-3 Zone provided, thatsuch other uses shall not have any different or more detrimental effect upon the adjoining neighborhood areas or zones than such specifically permitted uses, and shall not unduly increase the traffic and noises in the neighborhood area and otherwise be more objectionable or obnoxious than those uses specifically permitted. Section 113.4 ACCESSORY USES Accessory uses shall be permitted only to the extent necessary and normal to the limited types of use permitted in this Zone Off-street parking and private garages are permitted in the rear and side yards. Signs shall be allowed as provided in the Sign Ordinance of the City of Cypress Section 113.5 LUT ARCA AND DIMENSIONS A. Lot Area. The minimum lot area shall be eight thousant (8000) square feet. B. Lot Dimensions The minimum dimensions shall be Minimum Width - Fifty (50) feet, Minimum Depth - One hundred sixty (160) feet. Section 113.6 BUILDING OR STRUCTURAL HEIGHT LIMITATION. There is no building or structural heightlimitation, except when the Zone abuts a residential zone then the maximum building or structure height shall not be greater than twenty (20) feet for a distance of fity (50) feet from the Zone boundary abutting the residential zone. Section 113.7 YARD REQULATIONS. A. Front Yard. 1. Each lot in the C-3 Zone shall have a front yard extending except for access drives and walks across the full width of the subject property of a depth of not less than ten (10) feet pro- vided that where the C-1 Zone occupies an entire block frontage, the required front yard may be reduced to six (6) feet. Such yards shall be landscaped and permanently maintained as a condition to the use of the propert, 2. There shall be no parking or other use except for signs access drives or walks made of the required front yard or a required side yard abutting a side s-reet. Ordinance Io. 273 B. Side Yard fl4 A side yard shall be required for lots other than corner lots only when the side of the property abuts a residential zone in which case the required side yard shall be twenty- five (25) feet ten (10) feet of which abutting the residential zone shall be planted with evergreen trees In the case of a corner lot a yard meeting the same requirements shall be required aloni the abutting side street C. Rear Yard. A rear yard shall be required only when the rear of the property abuts a residential zone in which case the required rear yard shall be twenty-five (25) feet ten (10) feet of which abutting the residential zone shall be planted with evergreen trees Section 113.8 FENCES AND WALLS When abutting a residential zone or alley which abuts a residential zone except for drives and walks there shall be a solid masonry wall six (6) feet in height erected along and immediately adjacent to the abutting property line that is the C-3 zone boundary said wall shall be three (3) feet in height in any front yard or street side yard area or waere it abuts the front yard area of any adjacent zone. Section 113.9 OUTDOOR STORAGE AREAS Outdoor areas for storage of materials and equipment shall be enclosed by a fence not less than 6 -feet in height to be approved by the City Staff and no storage shall exceed the heigot of the surrounding walls or adjacent buildings Section 113.10 CFF -STREET PARKING A. The provisions of ART 21 shall apply in determining the amount of parking spaces that must be provided for each use. d. Off-street parking space shall be improved as required in said PART C. The parking requirements of this Section may be satisfied either. 1. On the lot with the building served or a tract of land contiguous thereto. On a lot the nearest boundary of which is not more than three hundred (300) feet from the nearest boundary of the subject property 3. Property located within the limits of an off-street parking district formed in pursuance of the provisions of any law of the State of California or of any other duly authorized authority or governmental body, shall have its off-street parking requirements reduced to the following extent The proportionate part that the amount assessed against such property bears to the total cost of such off-street parking improvement shall first be determined. After this proportion has been ascertained, such property shall be given credit for or the number of parking spaces otherwise required by such property shall be reduced by the number of parking spaces that proportion bears to the total number of off-street parking spaces provided by the off-street parking district Should the application of this formula result in a fractional parking space such fractional space shall be disregarded in determining the off-street parking requirements for such lot Ordinance No. 273 64 Section 113.11 OPTIONAL DESIGN AND IMPROVEMENT STANDARDS When a development has been approved by the Planning Commission under the Optional Design and Improvement Standards of the Subdivision Ordinance then such approved building sites coverage and yards under such plan shall be considered as the requirements of this Ordinance. Section 113.12 LOADING The provisions of PART 21 for loading requirements shall apply to all uses in the C-3 Zone. Section 2 All other Ordinances or provisions of Ordinances inconsistent or in conflict with the provisions hereof are hereby amended or repealed in order that they shall in all respects conform to the amendments of this Ordinance.
