Minutes 79-11-054OO MINUTES OF AN ADJOURNED REGULAR MEETING OF THE CYPRESS CITY COLrNCIL HELD November 5, 1979 The adjourned regular meeting of the Cypress City Council was called to order at 7:08 p.m. on Monday, November 5, 1979 in the Administrative Conference Room of the Cypress City Hall, 5275 Orange Avenue, Cypress, California, Mayor Howard Rowan presiding. PRESENT: ABSENT: Councilmembers Evans, Hudson & Rowan Councilmembers Lacayo & MacLain The City Manager indicated that the Orange County Fair Board had requested a waiver of the business license fee for circuses and carnivals which, pursuant to the new Business License Ordinance, is $150 per day. The carnival is willing to pay the $150 permit fee, which has been the fee for the past two years; however, they had requested that any additional fees be paid by the Fair Board under the provisions of their three-year contract. The City Manager stated that staff bad no objection to waiving the fee as requested. It was moved by Councilwoman Evans, seconded by Councilman Hudson and unanimously carried to require the payment of a $150 business license fee for the 1979 Orange County Fall Fair carnival in lieu of the required fee of $150 per day. COUNCILWOMAN MACLA1N ARRIVED AT 7:14 P.M. The City Council conducted a joint meeting witb the Cypress School District Board of Trustee members Swain, Bluemke and Kamm. Also present was Superintendent William Calton. Members of the School Board reviewed the history of the purchase and development of the Cypress School site and indicated that further legal clarification would be required to determine the proper procedure to be used in either selling or leasing the facility to the City or to the Cypress Recreation and Park District. Specific legal concerns involved the requirement to notify the prior property owner before completing the sale of the property to a new owner, the ability of the District to lease the facility at less than the fair market value to another public agency, and the ability of the District to enter into a cooperative joint powers agreement to provide for the operation of a senior citizens facility for either recreational and/or training purposes. The City Council explained the position of the City in reference to the need to provide for a senior citizens facility and the interest that the Council had in seeking funding for possible senior citizens housing as well as a senior citizens center on the Cypress Schoo]. site. COUNCILMAN LACAYO ARRIVED AT 7:58 P.M. Further discussion was held regarding the advantages and disadvantages of leasing the facility as compared to selling the facility and the need for the City to obtain additional information from the staff regarding the availability of grant funds for senior citizen facilities and programs. Superintendent Calton suggested that further discussions should be deferred until such time as the School Board determines whether or not the Cypress School site should be sold, which would be the subject of a staff report at the November Board meeting, with a decision to be made by the Board at either the November or December regular meeting. The City Council suggested that the City Manager might obtain the services of a student who could spend full time in researching and assisting in the obtaining of a grant for a senior citizens project. It was further suggested that the staff should contact several of the area universities to determine whether there were geriatric programs that might be conducted as a part of the university program at the Cypress School facility which could be incorporated as part of tho overall grant proposal. City Council Minutes November 5, 1979 it was generally agreed that these approaches would be the subject of further d~scussions by the City Council and that the School Board would receive a staff report regarding the Cypress School site at its November meeting. Councilman Hudson requested an Executive Session to discuss matters of litigation. EXECUTIVE SESSION: Mayor Rowan called an Executive Session at 9:00 p.m. for matters of litigation. The meeting was called back to order at 9:19 p.m. with all Councilmembers present.
