Ordinance No. 315ORDINANCE NO 315 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING THE CODE OF THE CITY OF CYPRESS CALIFORNIA, CHAPTER 18, ENTITLED "PERSONNEL" THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS. Sections 18-5, 18-22, and 18-23 are hereby repealed, and sections 18-2, 18-4, 18-6, 18-7, 18-12 and 18-14 are hereby amended to read as follows "Sec 18-2 Applicability of chapter (a) The provisions of this chapter shall apply to all offices, positions and employments in the service of the City, except the following (1) Elective officers (2) Members of appointive boards, commissions and committees (3) Persons engaged under contract to supply expert, professional or technical services for a definite period of time. (4) Volunteer personnel, such as volunteer firemen who receive no regular compensation from the City. (5) The City Attorney (6) The City Manager (b) Rules regarding employment, disciplinary action, or dismissal, shall not apply to department heads and zssistants to the City Manager designated by the City Manager " "Sec. 18-4 Same -- Powers and duties. The Personnel Officer shall have the following powers and duties. (a) To attend all meetings of the City Council of which notice is given to the personnel officer that personnel matters are to be considered (b) To administer all the provisions of this chapter and of the personnel rules not specifically reserved to the City Council (c) To prepare and recommend to the City Coundl revisions and amendments to the personnel rules The City Attorney shall approve the legality of such revisions and amendments prior to their submission to the City Council (d) To prepare a position classification plan including class specifications, and revisions of the plan. The plan, and any revisions thereof, shall become effective upon approval by the City Council (e) To prepare a plan of compensation, and revisions thereof, covering all classifications in the competitive service The plan, and any revisions thereof, shall become effective upon approval by the City Council (f) To provide for the publishing or posting of notices of tests for positions in the competitive service, the receiving of applications therefore the conducting and grading of tests the certification to the appointing power of a list of all persons eligible for appointment to the appropriate position in the competitive service ' "Sec 18-6 Meetings of the City Council for personnel matters The established time for meetings shall be on the same date as any duly called City Council meetings " Ordinance No 315 139 "Sec 18-7 Functions of the City Council in personnel matters The functions of the City Council regarding personnel matters shall be as follows* (a) As provided by this chapter and by the personnel rules to hear appeals submitted by any person in the competitive service relative to any disciplinary action, dismissal, demotion, interpretation or alleged violation of this chapter or the personnel rules and to certify its findings and recommendations as provided in the personnel rules (b) To investigate, hold hearings and take action on any matter of personnel policy ' 'Sec 18-12 Discrimination prohibited No person in the competitive service, or seeking admission there- to shall be employed, promoted, demoted, discharged, or in any way favored or discriminated against because of political opinions or affiliations, or because of race, color, ancestry, national origin or religious belief "Sec. 18-14 Same -- Provisional Appointments. In the absence of an appropriate appointment list, a provisional appointment may be made by a department head upon approval of the appointing power of a person meeting the minimum training and exper- ience qualifications for the position An employment list shall be established within six months for any permanent position filled by provisional appointment The initial period of appointment for provisional employees shall not exceed ninety days Upon a recommen- dation of the department head and approval of the appointing power, the employee may be appointed for an additional ninety (90) days Thereafter, the City Council may, by a four-fifths vote, extend the period for any provisional appointment for not more than thirty days by any one action."
