Ordinance No. 332ORDINANCE NO 332 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTION 5-2 OF CHAPTER 5 OF THE CYPRESS CITY CODE BY ADDING SUBSECTION (d) THERETO, WHICH ADDS SECTIONS 1410 AND 1410-a TO CHAPTER 14 OF THE UNIFORM BUILDING CODE THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS* Section 5-2 of the Cypress City Code is hereby amended to read as follows Section 5-2 Amendments, Additions and Deletions The following amendments, additions and eletions are made to the Uniform Building Code adopted by this chapter (a) Section 205 is amended to read as follows: "Section 205 It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish equip, use, occupy, or maintain any building or structure in the City, or cause the same to be done, contrary to or in violation of any of the provisions of this code. 'Any person, firm, or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment (b) Section 303 (a) is amended to read as follows* "(a) Building Permit Fees "A fee for each building permit shall be paid to the Building Official as set forth in Table No 3-A. "The determination of value or valuation under any of the provisions of this code shall be made by the Building Official. "Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees above specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein "In the event that any person has obtained a building permit and no portion of the work or construction covered by such permit has been commenced, and such permit has not expired, or been suspended or revoked, as provided in Section 3 (d) or Section 3 (e) of this Code, the permittee shall be entitled to a refund of 80% of the fee paid for such permit, upon presentation to the Building Superintendent of a written request therefor " (c) Section 303 of Chapter 3 is amended by adding thereto the following subsection (c) "(c) Reinspection Fees When any reinspection is required because of the negligence of the permit holder, his agent or other representative, or because of the failure of such parties to comply with previous correction instructions, a fee of $5.00 shall be charged by the Building Official for each such reinspection " Ordinance No 332 1 r (d) Chapter 14 is amended by adding thereto the following Sections 1410 and 1410-a "1410 Where rooms are adjacent, they may be considered as one room for the purpose of determining the required light and ventilation under the following conditions. "1 When the common wall or a vertical plane of an assumed common wall between the room furnished light and ventilation and the adjacent room providing light and ventilation has a minimum open area of 50%, the horizontal dimension used in determining the open area required shall be measured along the common wall and from wall to wall of the room considered as borrowing light and ventilation the vertical dimension used in determining the open area required shall be assumed as 7'6' "2 The required light and ventilation shall be furnished for the total area of both rooms. "1410-a EXCEPTION Where rooms are adjacent, they may be considered as one room for the purpose of determining the required ceiling heights under the following conditions. 1 When the common wall or a vertical plane of an assumed common wall between the rooms has a minimum open area of 50%; the horizontal dimension used in determining the open area required is to be measured along the common wall from wall to wall of the smaller room The vertical dimension from floor to ceiling used in determining the open area required shall be assumed as 7'6" "2 The required minimum ceiling height of 7'6' shall be maintained in 50% of the total area of both rooms "3 Dropped plastic diffusers or similar devices shall be considered as the ceiling."
