ORDINANCE NO 349
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING ARTICLE VI OF CHAPTER 25 OF THE CYPRESS CITY
CODE, 'RECORD OF SURVEY'
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS:
SECTION I Article VI of Chapter 25 "Stibdivisions", of the Cypress
City Code, is hereby amended to read as follows.
'ARTICLE VI DIVISION OF LAND
Section 25-57 Applicability of article
When an owner or developer desires to divide one (1) or more
lots for sale or lease so as to create not more than four
(4) new lots and does not wish to record a final subdivision
map as provided by this Chapter, it shall be done in the
following manner and under the following conditions:
Section 25-58 Filing of map
An original or duplicate tracing and three (3) prints of
a map showing the proposed lot division prepared by a licensed
surveyor or registered civil engineer shall be filed with the
Secretary of the Planning Commission together with a Twenty-
five (25 00) Dollar filing fee, said maps shall be legibly
drawn to scale and shall be on sheets measuring 81 x 14 inches
Section 25-59 Contents and accompanying information
(A) Said map shall contain or be accompanied by a written
statement setting forth not less than the following data'
(1) A sufficient legal description and dimensions of
the land to define the boundary thereof
(2) Name, address, telephone number, and certification
of engineering correctness and compliance with this Ordinance
by the person who prepared the map
(3) Location of property in relation to existing
streets
(4) The layout of both the parcels existing and proposed
and the dimensions of each with the numbers within each pro-
posed parcel
(5) The location of each existing building or structure
above ground in relation to the parcel lines being created
(6) The location of existing wells, cesspools, and
underground structures
(7) Method of supply and source of domestic water
(8) Any existing or proposed easements
(9) Signature of the owner of the property involved
(10) North arrow and scale
(B) A duplicate tracing of the recorded map shall be kept in the
file of the City Engineer one print thereof to be kept in the files
of the Planning Commission and one copy forwarded to the Building
Department, and one print shall be mailed to the person filing the maps,
with an indication of the action taken thereon

Section 25-60. Improvements required.
The same improvements, dedications, and drainage fees required
by this Chapter for subdivisions shall be required in the case of
a "Division of Land', except in those instances where certain
improvements are found to be unnecessary by the City Council for
the public welfare, safety and health
Section 25-61. Approval of Division of Land
Each Division of Land filed shall be approved, conditionally
approved or disapproved by the City Engineer, as to its engineering
correctness, and the Secretary of the Planning Commission as to
its compliance with existing City ordinances and policies
Section 25-62. Appeal or non-compliance
If the owner of the property wishes to appeal the decision of
the staff or does not wish to comply with the requirements for
improvement as herein set forth, the map shall be forwarded to the
City of Cypress Planning Commission with a report setting forth
the reasons for such action
Section 25-63 Action of Planning Commission
Upon receipt of any such map, the Planning Commission shall
review the matter at its first regular meeting held not less than
ten (10) days following the receipt of an appeal Notification by
mail of the time and place of consideration of such matters shall
be made to the property owner not less than five (5) days prior to
the meeting at which the matter is to be reviewed
The decision of the Planning Commission approving, disapproving,
or conditionally approving shall be final unless appealed to the
City Council within twelve (12) days of notification by mail of the
action by the Planning Commission, provided however that any
action that would create lots substandard in area, lot width, or
lots having access over private easements shallbe prohibited unless
such matters are filed and processed as a variance
Upon compliance with the decision of the Planning Commission by
the property owner, the City Engineer and the Secretary of the Planning
Commission shall certify the maps in accordance threwith and
distribution of said maps made as set forth in Section 25-59 (B) of
this Article
Section 25-64. Appeal
An appeal by the property owner from the action of the Planning
Commission may be made by filing in writing with the City Clerk
a statement setting forth the grounds for such appeal within twelve
(12) days of the mailing of notice of the decision of the Planning
Commission to the property owner
The City Council shall consider such appeal within thirty (30)
days of its being filed with the City Clerk Notification by mail
of the time and place of consideration of the appeal shall be made
to the property owner not less than five (5) days prior to the
meeting at which the appeal is to be reviewed
The decision of the City Council shall be final and upon compliance
with the decision of the City Council by the property owner the City
Engineer and Secretary of the Planning Commission shall certify the
maps in accordance therewith and distribution of said maps made as set
forth in Section 25-59 (B) of this Article
Section 25-65 Recording.
If the Division of Land is approved, the subdivider shall pay the
City a fee estimated to cover the cost of recording the map in the
County Recorder's Office plus $1 00 to cover the City's cost of having
the map recorded The City shall obtain the recordation of the map
and shall return the recorded map to the subdivider

Section 25-66 Standards.
Each Division of Land filed pursuant to this Article shall be
certified by the City Engineer and the Secretary of the Planning
Commission as to its engineering correctness and its compliance with
the following conditions
(a) All lot sizes shall conform with the provisions of the
Zoning Ordinance of the City, or by other official plans adopted
pursuant to law, and all lots shall comply with the standards set
forth in this chapter and the Zoning Ordinance or by other official
plans adopted pursuant to law governing lot design
(b) Curbs gutters sidewalks and paving shall be installed
along all street frontage of the property being divided
(c) Separate and adequate distribution lines for domestic
water supply shall beconstructed to each lot, without crossing
another lot
(d) Separate and individual sanitary sewer facilities and
connection shall be made to each lot created, without crossing
another lot
(e) No lot contained in such proposed Division of Land shall
conflict with any street, highway, park, playground public building
or other type of public project indicated on a master plan or
precise plan
(f) No lot in such proposed Division of Land may be subject to
flood or inundation
(g) No division shall be permitted that will block the
development of adjacent property
SECTION II. All other Ordinances or provisions of Ordinances
inconsistent or in conflict with the provisions hereof are hereby amended
or repealed in order that they shall in all respects conform to the
amendments of this Ordinance
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 22nd day of May, 1967
