AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AMENDING SECTION 25-35 OF ARTICLE IV OF CHAPTER 25 OF
THE CYPRESS CITY CODE
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS
Section 1: Section 25-35 of Article IV of Chapter 25 of the Cypress
City Code is amended hereby to read in its entirety*
"Section 25-35 Required
The subdivider shall improve, or agree to improve, all land
dedicated for streets, highways, public ways and easements in a subdivision
as a condition precedent to acceptance and approval of the final map thereof when the
areas of abutting lots are an acre or less and such improvements may be
required if the areas of abutting lots exceed one acre each Such improvements
shall include such grading, surfacing, sidewalks, curbs, gutters, ornamental
street lights, culverts, bridges, storm drains water mains and individual
service connections to the property line with cutoff valves, sanitary sewers
and such other structures or improvements as may be required by ordinance or
deemed by the city council to be necessary for the general use of the lot owners
in the subdivision and local neighborhood traffic and drainage needs Costs
of flood control works, street improvements of major, primary and secondary
streets, trunk sewers, and off-site water lines may be prorated, as determined
by the city engineer and the city council
This section shall not require improvements to freeways
The minimum improvements which the subdivider will be required to
make or enter into an agreement to make in a subdivision prior to the accep-
tance and approval of the final map thereof by the city council shall be as
follows
(a) Separate and adequate distribution lines for domestic water
supply to each lot
(b) Sewage collecting system where main lines of an adequate disposal
system are available

(c) Adequate drainage of the subdivision streets highways, ways
(d) Adequate grading and surfacing of streets highways ways and
(e) Concrete curbs gutters and cross gutters
(f) Concrete sidewalks
(g) Survey monuments
(h) Fire hydrants at locations designated by the city engineer
(i) Street name signs two to each intersection
(j) Necessary barricades and safety devices
(k) Street trees subject to approval of the city engineer, or in lieu
thereof a sufficient deposit with the city for future tree planting

(m) Utility lines including but not limited to electric, communica-
tions, street lighting and cable television shall be required to be
placed underground The subdivider is responsible for complying with the
requirements of this sub -section and he shall make the necessary arrange-
ments with the utility companies for the installation of such facilities
For the purpose of this sub -section appurtenances and associated equipment
such as, but not limited to, surface mounted transformers, pedestal mounted
terminal boxes and meter cabinets and concealed ducts in an underground
system may be placed above ground The planning commission may waive the
requirements of this sub -section if topographical soil or any other
conditions make such underground installations unreasonable or impractical
This sub -section shall not apply to utility lines which do not provide
service to the area being subdivided
The subdivider may appeal the decision of the planning commission
under the preceding sub -section (m) to the city council, by filing with
the city clerk a written request for such appeal setting forth the grounds
therefore within fifteen (15) days of the mailing of notice of such
decision of the planning commission to the subdivider
The city council shall consider and act upon such appeal within
thirty (30) days of receipt of such written request by the city clerk
Notification by mail of the time and place of such consideration by the
city council shall be given by the city clerk to the subdivider not less
than five (5) days prior thereto
The city council may extend such time for consideration of the
appeal with the consent of the subdivider However, a failure of the city
council to act upon the appeal within such time limits shall be deemed
to be a denial of the appealald confirmation of the action of the planning
commission
All such improvements shall conform to the standards and specifica-
tions of the city (Ord No 77 art 5 sub -sections 5-18, 5-19, Ord No
244 section 1)'

regular meeting held on the 12th day of June, 1967
