Ordinance No. 377ORDINANCE NO 377 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTIONS 5-1 AND 5-2 OF CHAPTER 5 OF THE CYPRESS CITY CODE THEREBY ADOPTIONG BY REFERENCE THE UNIFORM BUILDING CODE 1967 EDITION VOLUME I THE "BUILDING CODE" THE UNIFORM BUILDING, CODE, 1967 EDITION, VOLUME II, THE "UNIFORM MECHANICAL CODE", THE UNIFORM BUILDING CODE, 1967 EDITION, VOLUME IV DANGEROUS BUILDINGS THE "UNIFORM CODE FOR REPAIR VACATION OR DEMOLITION OF DANGEROUS BUILDINGS', AND THE UNIFORM BUILDING CODE, 1967 EDITION, "STANDARDS" THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS SECTION 1 Section 5-1 of Chapter 5 of the Cypress City Code hereby is amended to read as follows* "Sec 5-1 Uniform Building Code - Adopted; where filed The following hereby are adopted by reference, as amended by Section 5-2 of this Chapter, as the Building Code of the City of Cypress three copies of which are on file in the office of the City Clerk: a The Uniform Building Code, 1967 Edition Volume I and Appendices the "Building Code" except Section 205 thereof, b The Uniform Building Code 1967 Edition Volume II, the "Uniform Mechanical Code', except Section 202 thereof, and The Uniform Building Code 1967 Edition Volume IV Dangerous Buildings, the "Uniform Code for Repair, Vacation or Demolition of Dangerous Buildings" except Sections 201 (c) 3 and 203 thereof d The Uniform Building Code, 1967 Edition, "Standards" SECTION 2 Section 5-2 of Chapter 5 of the Cypress City Code hereby is amended to read as follows* "Sec. 5-2. Same - Amendments. (a) The following amendments are made to the Uniform Building Code 1967 Edition, Volume I the "Building Code" adopted by this Chapter: (1) Section 205 is added to read as follows: 'Section 205 It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move improve remove convert or demolish equip, use, occupy, or maintain any building or structure in the City, or cause the same to be done contrary to or in violation of any of the provisions of this code 'Any person firm or corporation violating any of the provisions of this code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or by both such fine and imprisonment ' Ordinance No 377 25S (2) Section 303 (a) is amended to read as follows: '(a) Building Permit Fees. A fee for each building permit shall be paid to the Building Official as set forth in Table No 3-A 'The determination of value or valuation under any of the provisions of this Code shall be made by the Building Official 'Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit the fees above specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penalties prescribed herein In the event that any person has obtained a building permit and no portion of the work or construction covered by such permit has been commenced and such permit has not expired, or been suspended or revoked, as provided in Section 3(d) or Section 3(e) of this Code, the permittee shall be entitled to a refund of 80% of the fee paid for such permit, upon presen- tation to the Building Superintendent of a written request therefor ' (3) Section 303 of Chapter 3 is amended by adding thereto the following subsection (c) '(c) Reinspection Fees When any reinspection is required because of the negligence of the permit holder, his agent, or other representative, or because of the failure of such parties to comply with previous correction instructions a fee of $5 00 shall be charged by the Building Official for each such reinspection (4) Section 306(a) is hereby amended to read as follows '306 (a) Use or Occupancy No building or structure in Groups A to H shall be used or occupied nor shall such building or structure be connected with permanent utility services until the Building Official has determined compli- ance with this Code, all other applicable ordinances and laws, and the conditions of the building permit, and has authorized occupancy of such building or structure 'No existing commercial or industrial building whose electrical service has been removed, shall be reconnected with permanent electrical service until the Building Official has determined compliance with this Code and has authorized occupancy of such building or structure ' (5) Section 1108 is hereby amended by adding the following exception to the fourth paragraph thereof. 'EXCEPTION: When such room serves an individual occupancy within a building not more than one story in height of Group F Division 2 Occupancy with an occupant load of less than 30 ' (6) Section 1305 (a) is hereby amended by adding the following paragraph thereto before the exception thereof For the purpose of determining light and ventilation requirements any room may be considered as a portion of an adjoining room provided a single unobstructed opening not less than one-half of the area of a common wall between such rooms is provided Such opening need not exceed an area equal to 1/10 of the area of the interior room served but shall be not less than forty-nine (49) square feet ' Ordinance No. 377 (7) Section 1305 is hereby amended by adding the following subsection (c) thereto '(c) Kitchen Ventilation There shall be installed in the wall or ceiling, approximately over the cooking facilities a ventilating opening with a minimum area of forty-eight (48) square inches and a minimum 6 -inch dimension connected by an incombustible ventilating duct free to the outside of the building The ventilating duct for each kitchen shall have a minimum cross-sectional area of twenty-eight (28) square inches An approved forced -draft system of ventilation may be substituted for the natural -draft ventilating system (8) Section 1405 (a) is hereby amended by adding the following paragraph thereto before the 'Exception' thereof 'For the purpose of determining light and ventilation requirements, any room may be considered as a portion of an adjoining room, provided a single unobstructed opening not less than one-half of the area of a common wall between such rooms is provided Such opening need not exceed an area equal to 1/10 of the area of the interior room served but shall be not less then forty-nine (49) square feet (9) Section 1405 (a) is hereby amended by adding the Exception to read as follows 'EXCEPTION Required windows may open into a roofed porch or residential patio where the porch or patio 1 Abuts a street, yard or court, and 2 Has a ceiling height of not less than seven feet (7')• and 3 Has the longer side at least 65 percent open and unobstructed, or, has openable windows or easily removable transparent panels with an area not less than 65 percent in the longer side and not less than one-eighth of the combined floor area of the room and the enclosed porch or patio ' (10) Section 1405 is hereby amended by adding the following subsection (d) thereto '(d) Kitchen Ventilation There shall be installed in the wall or ceiling, approximately over the cooking facilities, a ventilating opening with a minimum area of forty-eight (48) square inches and a minimum 6 -inch dimension connected by an incombustible ventilating duct free to the outside of the building The ventilating duct for each kitchen shall have a minimum cross-sectional area of twenty-eight (28) square inches An approved forced -draft system of ventilation may be substituted for the natural -draft ventilating system ' (11) Section 1711 (b) is hereby amended to read in full as follows* '(b) Shower Areas Shower stalls and the bathtub enclosures used as shower stalls shall be plastered with Portland Cement Plaster as required for the first two coats of exterior work Such plaster shall be carried to a height of not less than six feet above the drain outlet and across the full width of the door jamb In the case of tub enclosures said plaster shall be carried at least four inches beyond the outer edge of the tub Metal reinforcement and backing shall be as required for exterior plastering in Chapter 47 EXCEPTION This Section shall not apply to approved prefabricated shower enclosures ' (12) Section 3205 (d) is hereby amended to read as follows. '(d) Ventilation. Enclosed attics shall have clear ventilation area to the outside of not less than one square inch (1 sq in ) per ten square feet (10 sq ft ) of horizontal attic area Ordinance Nn_ 177 'The required ventilation shall be by not less than two equal sized openings providing cross ventilation covered with one- quarter inch (1/4") non -corrosive mesh screen (13) Table 54-D is hereby amended as follows* In the first column after the words, 'Laminated' 'Fully Tempered', and 'Wired', add a superscript X65 Said footnote X65 shall read. 'Shall be used in all H and I Occupancies where required in Section 5406 ' '(b) The following amendments are made to the Uniform Building Code, 1967 Edition Volume II, the 'Uniform Mechanical Code', adopted by this chapter (1) Section 202 is hereby added to read as follows. 'Sec 202 It shall be unlawful for any person, firm or corpora- tion to erect, install, alter, repair relocate, add to, replace use or maintain heating ventilating, comfort cooling or refrigeration equipment in the jurisdiction, or cause the same to be done, contrary to or in violation of any of the provisions of this Code Maintenance of equipment which was unlawful at the time it was installed and which would be unlawful under this Code if installed after the effective date of this Code, shall con- stitute a continuing violation of this Code 'Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued oer permitted and upon conviction of any such violation such per- son shall be punishable by a fine of not more than $500 00, or by imprisonment for not more than six months, or by both such fine and imprisonment (2) Section 303 is hereby amended by adding the following subsection (d) thereto: '(d) Any person who shall commence any work for which a permit is required by this Code without first having obtained a permit therefor shall if subsequently permitted to obtain a permit, pay double the permit fee fixed by this Section for such work, with an additional charge of $10 00• provided, however, that this provision shall not apply to emergency work when it shall be proved to the satisfaction of the Building Official that such work was urgently necessary and that it was not practical to obtain a permit therefor before the commencment of the work In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit the applicant shall pay a double fee as herein provided with an additional charge of $10 00 (3) Chapter 5 is further amended by adding the following Sections 509 through 513 thereto. 'Sec 509 Electrical connections Equipment regulated by this Code, requiring electrical connections of more than fifty (50) volts, shall have a positive means of disconnect adjacent to and in sight of the equipment served A 120 volt ranptical shall be located within 25 feet of the equipment for service and maintenance purposes Low voltage wiring of fifty (50) volts or less within a structure, shall be installed in a manner to prevent physical damage Such wiring, exposed to weather, shall be installed in conduit approved for exterior use Ordinance No. 377 'Sec 510 Condensate and Waste Water Adequate means shall be provided for the collection and disposal of condensate from every air cooling coil to a drain conforming with the Plumbing Code Every such condensate drain shall be of approved corrosion -resistant pipe at least three-fourths of an inch (3/4") nominal pipe size The overflow and drain of every eva- porative cooler, cooling tower, evaporative condenser and other water supplies equipment shall discharge into a drain conforming to the Plumbing Code Every such drain shall be of approved corrosion -resistant pipe and not less in size than the drain outlet of the equipment Under no condition shall such condensate or waste water be permitted to drain onto any open surface or public way EXCEPTION. A suitable drainage pit or disposal area may be approved by the Building Official 'Sec 511 Prohibited Locations Equipment regulated by this Code shall not be located in any required front or side yard as established by the Building Code or Zoning Ordinances 'Sec 512 Screening Equipment regulated by this Code, when located on the roof or outside of the building, shall be screened from public view Such screening shall conform to the architecture of the building 'Sec 513 Noise Abatement Equipment regulated by this Code shall be installed so that it will not produce a sound level above the limits set forth in the ordinance enforced by the Building Official ' (4) Section 710 is hereby amended by deleting subsection (e) in its entirety (5) Section 1107 (b) is amended to read as follows '(b) Prevention of Grease Accumulation Every duct system shall be so constructed and installed that grease cannot become pocketed in any portion thereof, and the system shall slope not less than one inch (1") per lineal foot toward the hood or toward an approved grease reservoir 'EXCEPTION* This slope may be reduced to one-fourth inch (4") per lineal foot provided this portion of the horizontal duct does not exceed seventy-five feet (75 ) in length and the entire duct system is equipped with an approved fire extinguishing system 'When a centrifugal fan is used it shall be positioned so the discharge outlet is in a bottom horizontal position and the air shall be so diverted that there will be no impingement on the roof, other equipment or parts of the strucutre ' (6) Section 1109 (b) is amended by adding a subparagraph number 8 thereto, to read as follows: '8 Every grease hood shall be equipped with an approved automatic fire extenguishing system ' (7) Section 1202 is amended to read as follows 'Location of confort cooling equipment shall comply with the zoning ordinance 'Cooling coils installed as a portion of, or in connection with, any warm -air furnace shall be arranged to comply with the requirements of Section 705 'No direct refrigerating system containing any Group 2 refrigerant shall serve any air cooling or air conditioning system used for human confort Ordinance No. 377 262 'When any confort cooling equipment other than ducts and piping is suspended from the underfloor construction, a minimum clearance of not less than six inches (6") shall be provided between the base of the equipment and the ground 'Comfort cooling systems shall comply with Sec 502 'Air cooled heat pumps, condensors or cooling towers located within a building or confined space shall have the air discharge directly to the outside of the building 'Every comfort cooling unit shall be bolted or otherwise permantently secured in position in a location with the sides and top of such units having a clearance of not less than six (6) inches from an adjoining construction 'Heat pumps or cooling coils located in an attic shall have an auxiliary drip pan installed at least two (2) inches below the entire unit having not less than a two (2) inch lip and six (6) inches larger than the unit and not less than No 26 guage galvanized iron or equivalent Each pan shall have a separate drain line terminating in an exposed location ' "(c) The following amendments are made to the Uniform Building Code, 1967 Edition, Volume IV, Dangerous Buildings, the 'Uniform Code for Repair, Vacation or Demolition of Dangerous Buildings' adopted by this chapter. (1) Section 201 (c) 3 is added as follows. 'Sec 201 (c) 3 No owner or occupant or any other person having charge, care or control of any building or premises shall fail or refuse, after proper demand made as herein provided to promptly permit entry therein by the Building Official or his authorized representative for the purpose of inspection and examination pursuant to this Code Any person violating this subdivision shall be guilty of a misdemeanor (2) Section 203 is added as follows 'Sec 203 No person, firm, or corporation, whether as owner, lessee, sublessee, or occupant, shall erect construct enlarge, alter, repair, move, improve remove demolish equip use occupy or maintain any building or premises, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Code, or any order issued by the Building Official hereunder Any person violating the provisions of this Section shall be guilty of a misdemeanor for each day such violation continued ' SECTION 3 Severability If any section subsection sentence clause phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the d ecision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance The City Council of the City hereby declares that it would have adopted this Ordinance and each section subsection sentence clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases, or portions be declared invalid or unconstitutional PASSED AND ADOPTED by the City Council of the City of Cypress, at a regular meeting held on the 10th day of June,1968 ATTEST.
