Ordinance No. 384ORDINANCE NO 384 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS AMENDING SECTIONS OF THE CYPRESS CITY CODE RELATING TO BUSINESS LICENSES AND TIP SHEETS THE CITY COUNCIL OF THE CITY OF CYPRESS DOES ORDAIN AS FOLLOWS* SECTION 1 Section 15-51 of the Cypress City Code is amended hereby to read as follows* 'Sec 15-51 Tip sheets, Handicapping, etc Every person who by any means engages in the business or practice of disseminating, distributing, passing out giving away, handing out, selling, offering for sale, or soliciting for the sale of any information recommendation opinion or advice from any place within the City or to any person within the City whether by oral, written, pictorial or other communication, including but not limited to any telephonic, telegraphic, or electronic communication or any other form of voice or picture transmission or by any sheet dodger hand bill circular letter, booklet, or any other printed, typewritten, mimeographed or written matter of any kind, pertaining to any horse race, choice of a horse or horses, recommending any horse or horses or otherwise pertaining to a horse race or contest of endurance or speed between horses or beasts, and whether at a fixed place of business within the City or otherwise, shall pay an annual license tax of $100 00; provided, that the provisions of this section shall not prohibit or require a license or the payment of a fee for the sale, distribution or delivery of newspapers of general circulation, as defined by Section 6000 of the Government Code of this State; and provided further, that the provisions of this section shall not prohibit or require a license or the payment of a fee by any radio or television station licensed by the Federal Communications Commission The number of persons allowed to distribute such material under any one license shall not exceed six (6) persons during any day " SECTION 2 Section 17-10 of the Cypress City Code is amended hereby to read as follows: "Sec 17-10 Tip sheets Handicapping, etc - license Every person who by any means engages in the business or practice of disseminating distributing passing out giving away, handing out, selling, offering for sale, or soliciting for the sale of any information, recommendation, opinion, or advice from any place within the City or to any person within the City, whether by oral written pictorial or other communication including but not limited to any telephonic,telegraphic, or electronic communication, or any other form of voice or picture transmission, or by any sheet, dodger, hand bill, circular, letter, booklet or any other printed, typewritten mimeographed or written matter of any kind, pertaining to any horse race, choice of a horse or horses, recommending any horse or horses, or otherwise pertaining to a horse race or contest of endurance or speed between horses or beasts and whether at a fixed place of business within the City or otherwise shall pay a license fee as provided in Chapter 15 of this Code, provided, that the provisions of this section shall not prohibit or require a license or the payment of a fee for the sale, distribution or delivery of newspapers of general circulation as defined by Section 6000 of the Government Code of this State, and provided further, that the provisions of this section shall not prohibit or require a license or the payment of a fee by a radio or television station licensed by the Federal Communications Commission No person shall be entitled to act pursuant to such license until there has been filed with the Chief of Police the name, address and photograph of the licensee " Ordinance Nn. 1R4 282 SECTION 3 Section 17-11 of the Cypress City Code is amended hereby to read as follows* "Sec 17-11 Same - information to be filed with Chief of Police daily No person shall sell, solicit for sale or offer for sale any of the materials or information described in Section 17-10 of this Code upon any day unless a true written copy of such materials or information has been filed in the office of the Chief of Police on or before 11 00 a m of such day in the event that such day is a day on which daytime racing will be conducted and at or before 5:00 p m of such day in the event such day is a day on which night time racing will be conducted SECTION 4 Section 17-12 of the Cypress City Code is amended hereby to read as follows: 'Sec 17-12 Same - sale, distribution, etc ,on streets prohibited. No person shall sell solicit for sale or offer for sale any of the materials or information described in Section 17-10 upon the City streets The violation of this section, in addition to any other penalty, shall be grounds for the cancella- tion by the City Council of any license issued pursuant to Chapter 15 of this Code SECTION 5 This Ordinance is an urgency ordinance of the City of Cypress to take effect immediately upon its adoption and is necessary for the immediate preservation of the public peace, health, and safety The facts constituting such urgency are as follows The racing season within the City will begin on July 23, 1968, and for the first time will include both day and night time racing within the City Certain new handicapping practices also have developed which are not now regulated by the Cypress City Code It is deemed necessary by the City Council to have this Ordinance in effect prior to the commencement of such racing, in order properly to license and control the business and activities included herein PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 22nd day of July, 1968 MAYOR OF THE CITY OF CYPRESS ATTEST* /7 CITY 1;iI5ERK 0 TH CIT OF CYPRESS STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Ordinance was adopted at a regular meeting of the said City Council held on the 22nd day of July 1968 by the following vote* AYES: 5 COUNCILMEN.
