Resolution No. 1854642 RESOLUTION NO 1854 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE SUBDIVISION MAP NO 9849 - WITH CONDITIONS WHEREAS an application was made by Dr Robert B Nevin to divide 75 acres of land into 31 lots yielding a density of 18 6 units per acre located at 6101 Orange Avenue, Cypress WHEREAS, the City Council considered evidence presented by the applicant, the Planning Commission, City staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives policies general land uses and programs specified in the General Plan of the City of Cypress in that: a The density of development is in accordance with the objectives and standards established by the Land Use Element of the General Plan b The subdivision of the property will provide for the improvement of the adjacent arterial street in accordance with the Circulation Element of the General Plan c The proposed development being implemented through this map will improve the housing stock of the City in accordance with the general guidelines set forth in the Housing Element 2 The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibit "A" and incorporated herein by reference are compatible with the objectives, policies general land uses and programs specified in the General Plan of the City of Cypress in that. a The subdivision will facilitate the development of a project and the improvement of a parcel of land which will be compatible with adjacent land uses, will provide added housing for existing and future residents of the City and will provide for overall improvements to the surrounding neighborhood 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof is a ground for denial of the tentative subdivision map, although such denial is not mandatory NOW THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Tract Map No 9849 subject to the conditions attached hereto as Exhibit A PASSED AND ADOPTED at a regular n+aeting of the City Council of the City of Cypress on the 25th day of April 1977 ATTEST. Sonju 1 CI `CL� F TH� RK TY OF CYPRESS EXHIBIT "A" TENTATIVE TRACT MAP NO 9849 1 All conditions of approval of Conditional Use Permit No. 77-5 shall be a part of the approval of Tentative Tract Map No 9849 2 All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 3 The Tract Map shall be dimensioned to show a twenty foot (20') setback from the Orange Avenue right-of-way line to building lot lines and a ten foot (10') setback from the alley right-of-way line 4 Each garage unit shall be assigned an individual parcel number 5 Final subdivision map filing fees shall be paid in accordance with City of Cypress Resolution No 1713
