Resolution No. 1872ala-/ 65 RESOLUTION NO 1872 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE SUBDIVISION MAP NO 9837 - WITH CONDITIONS WHEREAS an application was made by MEB Investments to divide 70 acres of land into 10 lots yielding a density of 12.8 units per acre located at 4370 Lincoln Avenue, Cypress, and WHEREAS, the City Council considered evidence presented by the applicant, City staff, the Planning Commission and other interested parties at a public meeting held with respect thereto NOW, THEREFORE, the City Council of the City of Cypress DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that. a The proposed density of development is less than the permitted density designated on the Land Use Element of the General Plan b The proposed residential units will contribute to the current housing stock within the City falling within the current range of medium-priced houses 2 The design and improvement of the proposed subdivision as designated on the tentative tract map and supplemented by the conditions attached hereto as Exhibit "A" and incorporated herein by reference are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that The design of the project as provided for in this subdivision map and further supplemented by the accompanying Conditional Use Permit will insure a quality of development compatible with the general objectives specified in the Land Use and Housing Elements of the City's General Plan 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 12000 et seq ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the tentative subdivision map, although such denial is not mandatory NOW THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Tract Map No 9837 subject to the conditions attached hereto as Exhibit "A" PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the llth day of July, 1977 ATTEST A7.1,1/e 4c CITY CLERK -OF THE CITY OF CYPRESS (2) MAYOR OF THE CI ' OF CYPRESS STATE OF CALIFORNIA ) COUNTY OF ORANGE )SS I DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the llth day of July 1977 by the following roll call vote: AYES 3 COUNCILMEN. Lacayo, MacLain and Hudson NOES• 1 COUNCILMEN Sonju ABSENT. 0 COUNCILMEN: None CITY CLERK fF C OF CYPRESS EXHIBIT "A" TENTATIVE TRACT MAP NO 9837 1 Final subdivision map filing fees shall be paid in accordance with City of Cypress Resolution No 1713 2 All requirements of the State Subdivision Map Act and the City's Subdi- vision Ordinance shall be satisfied 3 Installation of cable T V shall be subject to any City ordinances or regulations which are in effect at the time of recording of the final map 4 The conditions of the Conditional Use Permit shall apply to all parcels created, altered or otherwise affected by this subdivision map 5 Recreation and Parks fees shall be paid in accordance with the City of Cypress Subdivision Ordinance 6 An easement for ingress shall be recorded along the north end of Lots 12 and 13, in favor of the owners of Lot 11 7 CC&R's shall be recorded to provide for reciprocal parking agreements between Lots 11 and 12 to be used if and when Lot 12 develops commercially 8 Proposed Lot 13 shall have a minimum paved width of thirty feet (30') An agreement shall be recorded with this map to clearly define maintenance requirements for all users of Lot 13 This agreement shall be approved by the City Attorney and City staff prior to recordation 9 The owner(s) of Lot 11 shall grant an easement or quit claim to the Condominium Homeowners' Association shall cover maintenance and irrigation of the proposed landscaped areas directly behind the existing commercial building CC&R's for the Homeowners' Association shall cover maintenance and irrigation of these areas
