Resolution No. 1920RESOLUTION NO 1920 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING VARIANCE NO 77-5 THE CIT' COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS 1 That an application was filed for a Variance from the terms of the Zoning Ordinance of the City of Cypress to establish lots of less than the minimum area required by the City s Zoning Ordinance 2 That the City Council after proper notice thereof, duly held a public hearing on said application as provided by law 3 That the City Council hereby finds that. a Because of special circumstances applicable to the property the strict application of the Zoning Ordinance deprives such property of the privileges enjoyed by other property in the vicinity and under identical zoning classification in that: In order to implement the goals and objectives of the City's General Plan which call for the establishment of a broad range of industrial/commercial uses in the area of the subject property a flexible approach to the subdivision and the development patterns must be provided and this flexible approach necessitates a reduction in the minimum lot sizes to 20 000 square feet in area b The Variance as granted and as conditioned does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which the property is situated in that A flexible zoning and development approach has been employed in the area of the subject property in the past Approval of this variance will allow this same flexibility to be applied to the subject property as is currently being employed on other properties in the same area and in the same zone classification c The granting of the Variance will not be detrimental to the public health safety or welfare or materially injurious to properties or improvements in the vicinity in that Standards of development and performance will be incorporated into the use regulations for the subject property which will mitigate any adverse impact of industrial development of the subject property on adjacent properties These standards will include such things as masonry walls landscape buffers, building setbacks and noise limitations and restrictions on the types of outdoor activities that may be conducted 4 The City Council does hereby GRANT said Variance PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 14th day of November 1977 ATTEST• fid' yy�G� Y/ -4W CITLY OF CYPRESS 74f) MAYOR OF THE CJTY OF CYPRESS 15? 158 STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) I, DARRELL ESSEX, City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the 14th day of November 1977, by the following roll call vote AYES• 3 COUNCILMEN: Lacayo, Sonju and Hudson NOES 0 COUNCILMEN None ABSENT 1 COUNCILMEN• MacLain CIT CLERK OF THE CITY OF CYPRESS
