Resolution No. 2049RESOLUTION NO 2049 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING TENTATIVE PARCEL MAP NO 78-3 - WITH CONDITIONS WHEREAS an application was made by Constitution Savings and Loan Association to divide 1 85 acres into two lots located at 5900 Ball Road, Cypress, and WHEREAS, the City Council considered evidence presented by the Applicant, City staff and other interested parties at a public meeting held with respect thereto NOW, THEREFORE, the City Council of the City of Cypress, DOES HEREBY RESOLVE as follows. 1 The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that. a The map will facilitate the development of a deep parcel of land into uses compatible with the long-range development projections as outlined in the Land Use Element of the General Plan b The property within the boundaries of the proposed division has frontage on the southerly side of a primarily arterial street which has previously been fully improved in accordance with the projections of the Circulation Element of the General Plan and City development standards 2 The design and improvement of the proposed subdivision as designated on the tentative parcel map and supplemented by the conditions attached hereto as Exhibit A , and incorporated herein by reference, are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a The lot configuration of the proposed division is designed to facilitate development compatible with the commercial zoning designation for the property and with the land use designations of the General Plan The resultant lot sizes are in accordance with the regulations of the City Zoning Ordinance All off-site improvements normally required as a condition of development including necessary street dedications and improvements and utilitiy extensions have been provided to the subject site as a condition of previous land divisions 3 None of the findings set forth in Government Code Section 66474 can be made 4 The discharge of waste from the proposed subdivision into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed subdivision pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seg ) Denial of a subdivision for violation of the proposed waste discharge standards or an addition to an existing violation thereof is a ground for denial of the tentative parcel map, although such denial is not mandatory NOW THEREFORE BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Tentative Parcel Map No 78-3 subject to the conditions attached hereto as Exhibit 'A PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the llth day of December 1978 MAYOR OF THE Y OF CYPRESS 40'f ATTEST• R 0 8 CITY CLERK OF THE CITY/ OF CYPRESS STATE OF CALIFORNIA ) SS COUNTY OF ORANGE ) I DARRELL ESSEX City Clerk of the City of Cypress, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted at a regular meeting of the said City Council held on the llth day of December 1978, by the following roll call vote. None ABSENT 0 COUNCIL MEMBERS None CITY ER 0 THE CIT OF CYPRESS EXHIBIT "A" TENTATIVE PARCEL MAP NO 78-3 409 1 The developer shall conform to all applicable provisions of the City Code All requirements of the State Subdivision Map Act and the City's Subdivision Ordinance shall be satisfied 2 Should the existing drainage flow from any adjoining parcel across this development, or if drainage from this development flows across adjoining parcels, then drainage easements shall be obtained and drainage facilities provided to the satisfaction of the City Engineer Sanitary sewer easements and public utility easements shall be provided where necessary 3 The final Subdivision Map filing fee shall be paid per Resolution No 1713 prior to recordation of said map ,1-
