A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
PERTAINING TO THE CONSUMER PRODUCTS SAFETY COMMISSION'S
CONTROVERSIAL ARCHITECTURAL GLAZING STANDARDS PREEMPTING
PROVISIONS OF THE UNIFORM BUILDING CODE AND ITS LOCAL
ADOPTION

THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS
WHEREAS the Uniform Building Code published by the International Conference
of Building Officials contains provisions responsibe to the public need and
consistent with national standards, with respect to the regulation of glazing, and
WHEREAS, these regulations are adopted throughout the United States and are
enforced at the local level to assure safety to building occupants and the
general public, and
WHEREAS such enforcement is made prior to building occupancy and is made
independent of self certification by manufacturers and installers, and
WHEREAS the Consumer Products Safety Commission in their Architectural
Glazing Standard has now preempted provisions of the model codes and their local
adoption, and
WHEREAS, such preemption inhibits local interpretation, enforcement and
verification of compliance with safety glazing standards and
WHEREAS such action is inimical to the general health and safety of
the public,
NOW, THEREFORE BE IT RESOLVED that the membership of the International
Conference of Building Officials in session this 15th day of September 1977, in
Coronado, California through their Board of Directors initiate a petition to the
Consumer Products Safety Commission and to the Congress, if necessary to take
immediate steps to recognize the equivalency of the requirements of the Uniform
Building Code as enforced and interpreted at the local level to the regulation
adopted by the Consumer Products Safety Commission and
BE IT FURTHER RESOLVED that the City of Cypress as one of the members of the
International Conference of Building Officials be urged to send copies of this
resolution to their congressional representatives urging that such action be
taken, and
BE IT FURTHER RESOLVED that the model code agencies be encouraged to take
similar action to insure the continued safety of the public
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 14th day of February 1978
