RESOLUTION NO 1964
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
SETTING FORTH THE LOCAL CONDITIONS AND THE PUBLIC SAFETY
FACTORS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE
CITY COUNCIL THAT CERTAIN MODIFICATIONS TO THE 1976 EDITION
OF THE UNIFORM BUILDING CODES. UNIFORM BUILDING CODE
UNIFORM MECHANICAL CODE UNIFORM HOUSING CODE, UNIFORM CODE
FOR THE ABATEMENT OF DANGEROUS BUILDINGS, UNIFORM FIRE CODE
AND UNIFORM BUILDING CODE STANDARDS ARE REASONABLY REQUIRED
BY LOCAL CONDITIONS AND PUBLIC SAFETY FACTORS WITHIN THE
CITY OF CYPRESS
THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, Health and Safety Code Section 17958 requires the City of Cypress
to adopt the 1976 edition of the Uniform Building Codes, and
WHEREAS Health and Safety Code Section 17958 5 provides for the City Council
to make changes or modifications in the 1976 edition of the Uniform Building
Codes as may be reasonably necessary because of local conditions, and
WHEREAS, the City Council also has authority to modify said Codes based
upon public safety considerations* and
WHEREAS, the Building Official of the City of Cypress has determined and
recommended that, based upon factors of public safety and local conditions with-
in the City of Cypress the modifications to the 1976 edition of the Uniform
Building Codes contained in Ordinance No 612 are reasonably required to be
adopted by the City of Cypress* and
WHEREAS, Health and Safety Code Section 17958 7 requires the City Council
to make express findings of the necessity for modifications in the 1976 edition
of the Uniform Building Codes,
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Cypress
that the amendments and modifications to the 1976 edition of the Uniform Building
Codes contained in Ordinance No 612 are hereby found to be reasonably necessary
due to considerations of public safety and local conditions as follows.
I UNIFORM BUILDING CODE
Section 205 Violations and Penalties
This is an Administrative section and has been amended
to assess a fine and length of time for imprisonment to
conform to other Uniform Codes This raises the fine from
three hundred dollars ($300 00) to five hundred dollars
($500 00) and length of time from ninety (90) days to six
(6) months This amendment was originally adopted by
Ordinance No 377 dated 6/10/68
Section 303-D Reinspection Fee
Is amended to add a clarification as to the reason why
a reinspection fee was charged* Negligence or failure to
comply with previous correction instructions This amend-
ment was originally adopted by Ordinance No 377 dated
6/10/68
Section 303-E Refund of Building Permit Fees
In the event that any person has obtained a building
permit and no portion of the work or construction
covered by such permit has been commenced, and such
permit has not expired, or been suspended or revoked,
the permittee shall be entitled to a refund of eighty
percent (80%) of the fee paid, upon presentation to
the Building Official by a written request This
item was originally adopted by Ordinance No 377

Section 1711-D Shower Areas
This section does not mention the width of that "non-
absorbent materials are to be used around a shower
or tub enclosure Said materials shall be carried at
least four inches (4") beyond the outer edge of the
tub to protect the door jamb and material edge from
undue moisture"
Chapter 53 Energy Conservation
Building insulation and energy conservation was added by
the City Council in March 1974 to conform to the energy
crises In October 1976, a entire Chapter on Energy
Conservation was added to the U B C and will conform
to the guidelines set forth by the California Energy
Conservation standards Their(the State's) regulations
are set forth in Section T-20 - 1400 through T-20 - 1542
of Title 24 of the California Administrative Code
II UNIFORM MECHANICAL CODE
Section 511 Prohibited Location
A new section has been added to regulate the location
of the installation of Mechanical Equipment Equipment
regulated by this Code shall not be located in any
required front or side yard as established by the
Building Code or Zoning Ordinances
III UNIFORM HOUSING CODE
Section H -201-A & B Authority
Has been amended to add the Orange County Health Officer
as one of the officials to help administer and enforce
all the provisions of this Code
IV UNIFORM FIRE CODE - 1976 Edition
Section I-216
This edition was "updated" by the Orange County Fire
Marshall and the sections amended were written in the
Ordinance as corrected The Publications are recognized
by national authority and techical organizations and are
adopted by reference as part of this Code as though set
forth in full
Section 1 403 Definitions
Is amended to add "Authorized Representative" to the
definitions as one of the officers named in Sections
1 204 1 205 and 1 206 This would include the Chief
of the Fire Department Fire Marshall, Bureau of Fire
Prevention, and Chief of Police
Section 10 106 -F Stairway Numbering System
Add a new sub -paragraph to the construction of stairways
to help verify locations when conducting fire fighting
operations or when used as an exit, it is important that
the fire personnel and the building occupants know as
much as possible about the stairway system of the building,
i e which stairway landing he is on the upper and lower
terminus of the stairway and whether that particular
stairway extends through the roof Companion changes to
the Uniform Building Code have been submitted to correlate
the requirements

Section 10 114 Malls
Article 10 has been amended to add Section 10 114-A through
I, to set up some guidelines and Fire Department regulations
in the construction and maintenance of a "mall"
Section 12.102-B Manufacture, Sale and Discharge Fireworks
Fireworks were authorized under Section t1 of the City of
Cypress Municipal Code as referred td 'by Ordinance No 308
dated 4/11/66 and No 347 dated 4/24/67 The current
Ordinance No 524 adopted March 11, 1974 amended this Code
by repealing former Chapter 11 and included the updated
guidelines in sub -section (b) of Section 12 102 Seventeen
(17) conditions were added to this section and must be
approved before a "Business License to sell can be obtained
Section 13.208-A Accessway for Fire Apparatus
A "editorial" error has been corrected to change Division 1
to Division 3 as listed in the exception
Section 13 209 Premise Identification
This section was added to provide for the continued premises
identification once a building is built
Section 13 301 (B,C.F & G) are amended to add
Required duration" and the type of Fire Hydrants to be in
accordance with appropriate water company standard plan and
required private hydrants to be approved by the Chief
Section 13.302A Maintenance
This section has been amended as the Code at this time does
not adequately cover situations where existing buildings are
altered, added to, or remodeled This condition is critical
in sprinklered buildings where new rooms or areas are created
and the built-in fire protection is not extended to those
areas Although it may be argued that additions and remodeling
are covered by the Building Code and the necessary augmentation
or alteration of the sprinkler system would therefore, also be
covered it is a fact that this does not happen in reality
Minor alterations, which can create unprotected areas are
often done without a building permit Frequently when
remodeling or additions are done with a permit, building
officials are not made aware that buildings are sprinklered
and therefore, do not require system revision or augmentation
It is usually the fire department that discovers these situat-
ions, and it falls on them to obtain correction
Presently the Code deals only with the maintenance of the
systems in an 'operative condition' but does not deal with
the maintenance of protection coverage The proposed
amendment provides the needed wording for the maintenance
provision
Section 13 311 Wet Standpipes
Exception No 1 to Section 13 311 is hereby amended to clarify
use of wet standpipes They wet standpipes, are required
in all buildings used, all or partially, for the storage of
high piled combustible stock

Section 15 102 Flammable and Combustible Liquids
Sub -paragraph 'F" is amended to update the method of test
for flash point from ASTM -D56-61, and D93-69 to D56-70 and
D93-71 respectively
Sub -paragraph (G) has been added to define 'Swing Joint'
permissible
Section 15 103
Has been amended to add sub -paragraph 4 requireing a permit
for the extraction of liquids from underground tanks
Section 15.113
Has been added to require "Warning Signs" in hazardous areas
Section 15.216-C
Sub -paragraph C has been added to require a pressure test
for thirty (30) minutes after a fibreglass tank has been
installed as abrasions and structural injury frequently
occur during installation
Section 15 404-E
Sub -paragraph E has been added to provide for exit facilities
in accordance with the Uniform Building Code Sub -paragraph
(F) refers to proper drainage systems which must be provided
to prevent or control the spread of flammable liquids beyond
the room or area
Section 15.703-F
Sub -paragraph F has been added to assist in the control of
using service stations as bulk plants
Section 15 705-E-4
Was amended to correct printing error Change section 15 209
to 15 216
Section 15.709(b)
Was amended to be consistant with NFP A and the policy
stipulated in the Fire manual Also, 5 units of "B" type
extinguishment is not adequate
Section 15.710(d-3)
Was amended to maintain greater safety and uniformity with
N FPA #30
Section 30.121
Is hereby amended to add special requirement for air supported
structures This section will clarify the construction of
these structures by use of poles, stanchions, cables or other
similar equipment which will prevent collapse of the structure

Section 35 High Piled Combustible Stock
Has been amended and rewritten to reflect various changes that
have been submitted to the Uniform Fire Code Committee for
adoption into the U F C A section by section analysis is
given as follows
1 Section 35 105(a) Change 20,000' to "12,000" to be in
conformity with U B C Section 3802(b) 8 approved by the
F&L Subcommittee
2 Section 35 105(a) Add at the end of the sentence,
"inclusive of aisles "
3 Section 35 105(b) Change NFPA-13 date to 1976
4 Section 35 105(c) Change to read: "The fire extinguish -
iii systems shall be designed by a licensed engineer or
Approved designer "
Reason It was felt that due to the various types of
licenses and qualifications of engineers and
designers, the change would permit better
regulation of fire protection designers
5 Section 35 105(d) Add new subsection to read: "(d) The
design of automatic fire extinguishing systems for Special
Hazard Commodities shall be as approved by the Chief
The Chief shall be guided by the standards and recommend-
ations of the National Fire Protection Association Factory
Mutual Engineering and other nationally recognized fire
protection authorities
Reason. The proposed code change did not address what to
do with Special Hazard Commodities
6 Section 35 107(b) Add between "The" and "fans" the
following "Air handling system '
Reason. Clarification of which fans
7 Section 35 107(b) Change NFPA 90A-1975 to "1976"
8 Section 35 111(a) Change to read A Class II standpipe
system shall be provided for all high piled storage areas
that are not protected byautomatic sprinklers '
One and one half inch hose connections complying with NFPA
13-1976, Section 3-7 6 shall be provided in high piled
storage areas which are protected by automatic sprinklers
Reason They are necessary to assist in fire protection
in the early stages of fire development and
overhaul of fire area
The two types of systems are needed to differentiate
between a separate system for non-sprinklered areas and
an intergrated system for sprinklered areas

BE IT FURTHER RESOLVED that a copy of this Resolution, together with
Ordinance No 612 adopting the 1976 edition of the Uniform Building Codes as
amended be filed with the State Department of Housing and Community Development
by the City Clerk of the City of Cypress
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 13th day of March 1978
